SPECIAL CHANHASSEN CITY COUNCIL MEETING OCTOBER 6, 1976
Mayor Klingelhutz called the meeting to order at 7~30 p.m. with the
following members present: Councilmen Hobbs, Neveaux, Kurvers, and Waritz.
Bill Brezinsky, Frank Laska, Bill Schoell, and Russell Larson were present.
CARVER BEACH SEWER AND WATER PROJECT 75-2:
PAUL BARNETT - PARCEL 438DO: A motion was made by Councilman Kurvers
and seconded by Councilman Neveaux that with respect to Tax Parcel 438DO
that there be no change in the proposed assessment roll as to this parcel.
The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs,
Neveaux, Kurvers, and Waritz. No negative votes. Motion carried.
PAUL BARNETT - PARCEL 439DO A motion was made by Councilman Hobbs and
seconded by Councilman Neveaux that based on the engineer's recommendation
the area charge on Tax Parcel 439DO be reduced by $410.00. The
following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux,
Kurvers, and Waritz. No negative votes. Motion carried.
MERRILL BARTLETT - PARCEL 39DO: A motion was made by Councilman Neveaux
and seconded by Councilman Hobbs that the assessment roll is amended to
reduce the area charge by $350.00 on Tax Parcel 39DO. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers,
and Waritz. No negative votes. Motion carried.
HARVEY BERG - PARCEL 494DO:A motion was made by Councilman Hobbs and
seconded by Councilman Neveaux that the assessment roll be amended as
follows on Tax Parcel 494DO:
One sewer and water trunk and lateral assessment as to Lots 507-516.
One sewer and water trunk and lateral assessment as to Lots 476-484
and 490-496.

JOHN CLARK - PARCEL 49DO/5: A motion was made by Councilman Neveaux and
seconded by Councilman Kurvers that the assessment roll be amended to
reflect one sewer unit assessment plus an area charge on Tax Parcel
49DO/5. The following voted in favor: Mayor Klingelhutz, Councilmen
Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried.
MARK HEADSTREAM - PARCELS 591DO AND 593DO: These tax parcels have now
been combined to Parcel 591DO.
A motion was made by Councilman Kurvers and seconded by Councilman Neveaux
that with respect to Parcel 591DO covering Lots 1406-1410, 1422-1424,
and 1415-1420, assess two sanitary sewer trunk and lateral and two water
trunk and lateral units. The following voted in favor: Mayor
Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative
votes. Motion carried.
C. A. MACLEOD - PARCEL 678DO: The Macleods are requesting a hardship
deferrment. They are asked to fill out a financial statement and return
it to the city by October 18, 1976.
A motion was made by Councilman Waritz and seconded by Councilman Kurvers
that Parcel 678DO be assessed as proposed in the assessment roll. That
consideration be given to the application for deferrment after receipt
of the financial statement. The following voted in favor: Mayor

negative votes. Motion carried.
KENNETH MILLIS - PARCEL 576DO: A motion was made by Councilman I
Hobbs and seconded by Councilman Waritz that Parcel 576DO be assessed
as proposed on the assessment roll. The following voted in favor:
Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Waritz.
Councilman Kurvers voted no. Motion carried.
FRANK METZIG - PARCEL 690DO: A motion was made by Councilman
Neveaux and seconded by Councilman Hobbs that the sewer and water
assessment units be deleted on Parcel 690DO and that the parcel be
assessed a $1,500 area charge. The following voted in favor:
Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz.
No negative votes. Motion carried.
FRANK MOULTON - PARCEL 215CO: A motion was made by Councilman Hobbs
and seconded by Councilman Neveaux that the assessment as to Parcel
215CO is approved as shown on the proposed assessment roll. The
following voted in favor: Mayor Klingelhutz, Councilmen Hobbs,
Neveaux, Kurvers, and Waritz. No negative votes. Motion carried.
RICHARD L. & M. ROSSING - PARCELS 678DOjl, 683DO, 684DO: A motion
was made by Councilman Hobbs and seconded by Councilman Kurvers that
the assessments as to Parcels 678DOjl, 683DO, and 684DO are approved
as shown on the proposed assessment roll. The following voted in
favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and
Waritz. No negative votes. Motion carried.
GUST VIKAN - PARCELS 512DO, 510jl, AND 519DO: These parcels have
been combined to Parcel 510DO.

A motion was made by Councilman Kurvers and seconded by Councilman
Hobbs that the assessment as to Parcel 510DO is approved as shown
on the proposed assessment roll. The following voted in favor:
Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz.
No negative votes. Motion carried.
MARLOW PETERSON - PARCEL 439DOjl: A motion was made by Councilman
Hobbs and seconded by Councilman Neveaux to amend the proposed
assessment roll by a reduction of $785.00 area charge because of
an error in the square foot measurement for Parcel 439DOjl. The
following voted in favor: Mayor Klingelhutz, Councilmen Hobbs,
Neveaux, Kurvers, and Waritz. No negative votes. Motion carried.
RESOLUTION #76-76: Councilman Hobbs moved the adoption of a
resolution approving the Carver Beach Sewer and Water Improvement
Project 75-2 Assessment Roll as amended this evening. Resolution
seconded by Councilman Kurvers. The following voted in favor:
Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz.
No negative votes. Motion carried.

GREENWOOD SHORES SEWER AND WATER PROJECT 75-3: No appeals were received
regarding this project.
RESOLUTION #76-77: Councilman Neveaux moved the adoption of a
resolution approving the Greenwood Shores Sewer and Water Improvement
Project 75-3 Assessment Roll as presented. Resolution seconded by
Councilman Waritz. The following voted in favor: Mayor Klingelhutz,
Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes.
Motion carried.
FRONTIER-DEVELOPMENT PARK STORM SEWER AND STREET IMPROVEMENT PROJECT 74-lA:
FRANKLIN KURVERS: A motion was made by Councilman Neveaux and seconded
by Councilman Hobbs to accept the assessment for Franklin Kurvers as
presented by the city engineer in the amount of $754.70. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Waritz.
Councilman Kurvers abstained. Motion carried.
CHICAGO, MILWAUKEE, ST. PAUL, AND PACIFIC RAILROAD: A motion was made
by Councilman Hobbs and seconded by Councilman Neveaux that there be no
change made in the assessment as proposed against the railroad property
under date of September 3, 1976. The following voted in favor: Mayor
Klingelhutz, Councilmen Hobbs, Neveaux, and Waritz. Councilman Kurvers
abstained. Motion carried.
MARTIN WARD: A letter was received this evening from Mr. Ward stating
he objects to the assessment and will seek relief of the assessment.
A motion was made by Councilman Neveaux and seconded by Councilman Hobbs
that the Council adopt the engineer's recommendation of September 3,
1976, in regard to the assessment on the Martin Ward property. The
following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux,
and Waritz. Councilman Kurvers abstained. Motion carried.
RESOLUTION #76-78: Councilman Hobbs moved the adoption of a resolution
approving the Frontier Development Park Storm Sewer and Street
Improvement Project 74-lA Assessment Roll as presented. Resolution
seconded by Councilman Waritz. The following voted in favor: Mayor
Klingelhutz, Councilmen Hobbs, Neveaux, and Waritz. Councilman Kurvers
abstained. Motion carried.
FRONTIER TRAIL STREET IMPROVEMENT PROJECT 75-4:
ED HJERMSTAD - PARCEL 12-0/14: A motion was made by Councilman Kurvers
and seconded by Councilman Hobbs that the assessment as to Parcel 12-0/14
is approved as shown on the proposed assessment roll. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers,
and Waritz. No negative votes. Motion carried.
ROBERT SOMERS - PARCEL 255CO: A motion was made by Councilman Hobbs and
seconded by Councilman Neveaux that the assessment as to Parcel 255CO
is approved as shown on the proposed assessment roll. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers,
and Waritz. No negative votes. Motion carried.
T. DE JOODE - PARCEL 252CO: A motion was made by Councilman Kurvers and
seconded by Councilman Waritz that the assessment as to Parcel 252CO
is approved as shown on the proposed assessment roll. The following
voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers,
and Waritz. No negative votes. Motion carried.

HAROLD THEISTE - PARCEL 257CO: A motion was made by Councilman
Neveaux and seconded by Councilman Waritz that the assessment as
to Parcel 257CO is approved as shown on the proposed assessment roll.
The following voted in favor: ~1ayor Klingelhutz, Councilmen Hobbs,
Neveaux, Kurvers, and Waritz. No negative votes. Motion carried.
The question was raised at the assessment hearing whether Lots 8,
9, 20, and 21 were ever assessed for a street improvement. Lots 8,
9, 21, and the north 265 feet of Lot 22 were assessed for street
improvement in 1961.

HUBERT FORCIER: A motion was made by Councilman Hobbs and seconded
by Councilman Neveaux to amend the proposed assessment roll to
assess Mr. Forcier 160 foot frontage and one-half assessment for a
corner lot on the balance of the Forcier tract. The following voted
in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers,
and Waritz. No negative votes. Motion carried.
CITY EASEMENT: A motion was made by Councilman Kurvers and seconded
by Councilman Neveaux that the city be assessed one-half an assessment
on the Coulter Lift station Site. The following voted in favor:
Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz.
No negative votes. Motion carried.
ROGER BONGARD: A motion was made by Councilman Kurvers and seconded
by Councilman Neveaux to amend the assessment roll for Roger Bongard
by assessing the total frontage and defer 50% of that until the
property is built upon. The following voted in favor: Councilmen I
Hobbs, Neveaux, Kurvers, and Waritz. Mayor Klingelhutz voted no.
Motion carried.
RESOLUTION #76-79: Councilman Hobbs moved the adoption of a
resolution approving the Frontier Trail Street Improvement Project
75-4 Assessment Roll as amended this evening. Resolution seconded
by Councilman Neveaux. The following voted in favor: Mayor
Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No
negative votes. Motion carried.
The meeting was moved to City Hall for a discussion on the proposed
1977 Budget.
A motion was made by Councilman Kurvers and seconded by Councilman
Waritz to adjourn. The following voted in favor: Mayor Klingelhutz,
Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes.
