1976 10 18 I I I REGULAR CHANHASSEN CITY COUNCIL MEETING OCTOBER 18, 1976 Mayor Klingelhutz called the meeting to order at 7:30p.m. with the following members present: Councilmen Hobbs, Neveaux, and Kurvers. Councilman Waritz came at 8:00 p.m. Bill Brezinsky, Bill Schoell, Russell Larson, and Craig Mertz were present. The meeting was opened with the Pledge to the Flag. APPROVAL OF AGENDA: A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to approve the agenda as presented with the addition of discussion on the assessment for Helen Jacques. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. ERIE AVENUE SEWER AND WATER PROJECT 75-7 - AWARD BID:. RESOLUTION #76-82: Councilman Hobbs moved the adoption of a resolution awarding the project to Northern Contracting Company of Hopkins in the amount of $7,461.00 including a deduct of $457.00 for the use of ABS plastic pipe. Resolution seconded by Councilman Neveaux. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. TRAFFIC CONTROL SIGNS - AWARD BID: RESOLUTION #76-83: Councilman Kurvers moved the adoption of a resolution awarding the low bid to EarlF. Anderson and Associates Inc. of Minneapolis in the amount of $9,179.96. Resolution seconded_by Councilman Neveaux. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. The City Engineer will prepare a letter to the State Highway Department requesting an extension of the completion date on the project. MINUTES: A motion was made by Councilman Kurvers and seconded by Councilman Hobbs to approve the Frontier Trail Street Improvement Project 75-4 Assessment Hearing minutes of September 30, 1976. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. Amend the first paragraph, second sentence under RED CEDAR POINT STREET IMPROVEMENTS - FINAL ACCEPTANCE in the October 4, 1976, Council minutes to read: As a part of that settlement the city assumes future responsibility for streets in Project ~l-lE except for County Road 15 which is the county's obligation. Councilman Kurvers stated he had talked with residents living along the cartway at Cathcart Field and they stated that the "no parking" signs have not been installed by the City of Shorewood. . A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to approve the October 4, 1976, Council minutes as amended. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. . A motion was made by Councilman Kurvers and seconded by Councilman Hobbs to approve the October 6, 1976, Council minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. NO negative votes. Motion carried. Council Meeting October 18, 1976 -2- A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to approve the October 11, 1976, Council minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. I A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to note the October 5, 1976, Park and Recreation Commission minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Kurvers. No negative votes. Motion carried. EAST LOTUS LAKE PRD: Len Swedlund, Dick Knutson, and Al Michals were present. Councilman Waritz came at 8:00 p.m. A revised Plan F was presented showing a trail system through the interior of the proposed development. This plan has approximately the same number of lots as Plan F. It shows two ponds rather than one large pond and the south access road has been moved to the north. Mr. Michals asked if there could be a joint meeting with the Planning Commission, Council and developer to work out something that everyone can live with. Mayor Klingelhutz called a special meeting for Monday, October 25 at 7:30 p.m. and requested staff to inform Planning Commission members that the Council requests their presence at that meeting. ED HJERMSTAD - FILL PERMIT: Mr. Tessness was unable to attend the meeting at the required agenda time. I A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to table this item until later in the evening. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. STREET IMPROVEMENTS - MINNEWASHTA WOODS: All improvements have been completed. The Engineer has not completed an inspection of the improvements. A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to table further action until receipt of the Engineer's report. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. 1977 POLICE SERVICE CONTRACT: The city has received a new contract from Carver County. No mention is made in the contract about the l~ mill reduction by the county. A motion was made by Councilman Hobbs and seconded by Councilman Kurvers to accept the Police Service Contract as presented to the Council from the County Commissioners with items 1 through 6 being included as they were in the City Administrator's letter dated I September 13, 1976, to the Mayor and City Council with the exception that item 1) be changed to 1 3/4 mills. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. I I I -3- council Meeting October 18, 1976 Mayor Klingelhutz asked that after the first of the year the new council should set up a police taskforce to look into Chanhassen's own policing so that an alternate route would be ready if the city has problems similar to this year.. ZONING ORDINANCE AMENDMENT - R-IA USE DISTRICT: A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to accept the recommendation of the Planning Commission and the additional.. recommendations of staff in a report dated September 28, 1976, to allow churches as a conditional use in the R-IA Residential~ Agricultural District with conditions. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. BILLS: A motion was made by Councilman Neveaux and seconded_by Councilman Hobbs to approve the September bills as presented. .The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. ST. HUBERT'S CHURCH PARKING LOT: Don Schmieg was present to discuss a maintenance assistance program for the church parking lot. This item will be placed on a future.agenda. LAREDO DRIVE - CARVER BEACH: Several residents were present requesting the city blacktop Laredo Drive. The street is to remain gravel as per the Carver Beach Guide Plan. Harriet Norum - That is not what I consider a mountable curb. I think it's still a nuisance. Laredo goes down a hill. There is a washout constantly at the end of it because of the gravel. It's not properly maintained. _ I don't see why somebody can decide that I have to move my parking area, they have to move their driveway, down to these tar roads. I don't understand why you are not tarring my road. I paid taxes out there for-18 years. Why isn't my road worthy of being tarred like everybody elses? Why can't I drive on a tar road and not have dust on my windows? Bill Brezinsky - All people would have access to a street but it wouldn't be blacktopped unless it was designated for blacktop on the Carver Beach Development Guide Plan. It was the attorney's opinion that since that was the way the feasibility study and the plans were accepted that any change in that would require a public hearing which we held for Huron and several other streets. Councilman Neveaux - You would be willing to pay for an. additional street? Harriet Norum - Yes, I would be willing to pay my additional. assessment because I.think that this certainly isn't going to do my property any good at all. I feel, maybe I am wrong, that I am paying an assessment for all the people that live on the main roads and their property is increasing in value. My property is not going to increase because at the foot of the property there is a tar road there. When I built my house again if somebody would. have told me this I would have faced it the other way. ' Bill Brezinsky - They are already being assessed for a blacktop road. The road they actually get access from is gravel and the back part of the property is on blacktop road. Council Meeting October 18, 1976 -4- A motion was made by Councilman Kurvers and seconded by Councilman Hobbs to refer the question of blacktopping Laredo Drive to the Planning Commission for review and recommendations. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. SECTION 8, RENT SUBSIDY PROGRAM: Lila Fiumano was present requesting the city enroll in the Section 8, Rent Subsidy Program carried out through the Metropolitan Housing and Redevelopment Authority. The city could ask the Metro HRA to make application for funds and the city could administer the rest of the program. I RESOLUTION #76-84: Councilman Neveaux moved the adoption of a resolution supporting the section 8, Rent Subsidy Program in the City of Chanhassen and request the Metro HRA to make application for funds for such for the city. Resolution seconded by Councilman Waritz. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. ORDINANCE AMENDMENT - NO PARKING CHAN VIEW: The city has received a petition for limiting parking to one side of Chan View from Great Plains Blvd. to Laredo Drive. Staff recommended the Council limit parking to the south side of Chan View. The Council placed the ordinance amendment on first reading. FILL PERMIT - MICHAEL SORENSON: Staff recommended approval conditioned upon 1) all fill be placed in accordance with the survey plan, and I 2) Riley-Purgatory Creek Watershed District approve the permit. A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to approve the fill permit for Michael Sorenson at 7604 Erie Avenue contingent upon the recommendations of the City Administrator in a memorandum dated October 18, 1976. The following voted in favor: Councilmen Hobbs, Neveaux, Waritz, and Kurvers. Mayor Klingelhutz abstained. Motion carried. CONSTRUCTION AND DEBT SERVICE ANALYSIS STUDY: The Administrator asked for authorization of this study to provide a base level of information on debt service funds. A motion was made by Councilman Hobbs am seconded by Councilman Kurvers to accept the City Administrator's memorandum of October 18 and authorize a audit of financial study of the construction and debt service funds. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. CONSULTING ENGINEERS - INCREASE FEES: Staff recommended approval of the increase effective October 1, 1976. A motion was made by Councilman Neveaux and seconded by Councilman I Hobbs to approve the rates as submitted by Schoell and Madson for engineering and surveying services according to their letter of September 14, 1976. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. I I I Council Meeting October 18, 1976 -5- PAY CLASSIFICATION PLAN - CONTRACT APPROVAL: Staff recommended that the contract as originally presented by Loren Law be approved. A motion was made by Councilman Kurvers and seconded by Councilman Hobbs to accept the recommendation of the Administrator dated October 18, 1976. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. 1977 COUNCIL SALARIES - ORDINANCE AMENDMENT: A motion was made by Councilman Neveaux and seconded by Councilman Waritz to waive the rules of procedure for two readings of an ordinance amendment. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. A motion was made by Councilman Neveaux and seconded by Councilman Waritz to approve an ordinance amendment establishing compensation for members of the Chanhassen City Council and set Council compensation at $95.00 a month with additional compensation of $25.00 a month for the Mayor. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Kurvers, and Waritz. No negative votes. Motion carried. HELEN JACQUES ASSESSMENT - CARVER BEACH PROJECT: Councilman Hobbs asked the Engineer for a study on exactly what the city has provided for Mrs. Jacques and how she can utilize the benefit. DUCK LAKE TRUNK SEWER: The City Attorney has asked for time on the Eden Prairie Council Agenda for Tuesday, October 26 to request authority to hook into the line. The City Attorney and Mayor Klingelhutz will attend the meeting. The City Engineer will prepare a cost estimate of an alternate sewer line through Chanhassen.
