1975 01 20 I I I REGULAR CHANHASSEN CITY COUNCIL MEETING JANUARY 20, 1975 Mayor Klingelhutz called the January 20, ~975, city Council meeting to order at 8:00 p.m. with the following members present: Councilmen Kurvers, Hobbs, Neveaux, and Shulstad. The meeting was opened with the Pledge to the Flag. WARMING HOUSE: Dale Geving, Chanhassen Athletic Association, and John White, Chanhassen Jaycees, presented å $1,000 check to the City as a payment on part of the warming house. MINUTES: A motion was made by Councilman Hobbs and seconded by Councilman Neveaux to approve the January 6, 1975, regular council minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. The Council would like to meet with the Fire Chief to discuss the fire lanes at Colonial Center. A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to approve the January 13, 1975, special council minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Hobbs to note the Planning Commission minutes of January 8, 1975. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Shulstad and seconded by Councilman Kurvers to note the Planning Commission minutes of January 2, 1975. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Hobbs and seconded by Councilman Neveaux to note the Park and Recreation Commission minutes of January 7, 1975, and request the Chairman of the Park and Recreation Commission appear before the Council to discuss the Minnewashta Regional Park. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. A motion was made .by Councilman Kurvers and seconded by Councilman Neveaux to note the Lake Study Committee minutes of October 17, 1974. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Hobbs and seconded by Councilman Neveaux to note the Lake Study Committee minutes of January 9, 1975. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Kurvers, Neveaux, and Shulstad. No negative votes. Motion carried. Jack Bell and Lauren Hillquist of the Lake Study Committee discussed the establishment of a Lake Improvement District in the City with the Council. The Lake Study Committee will appear before the Council on February 3 at 8:45 p.m. to discuss the Lake Improvement District. The Council would like clarification of what are the responsibilities and at what authority the Lake Improvement District will cease. What authority would this group have in regard to taxation? CIVIL DEFENSE: A motion was made by Councilman Neveaux and seconded I by Councilman Hobbs to change the title of our Civil Defense Director . to Emergency Services Director. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. MEETING TI~1E: A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to change the regular meeting hours to a winter schedule of 7:30 p.m. start and an 8:00 p.m. start during the summer months running from April 1 to September 30. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. SIGN ORDINANCE: A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to table the Sign Ordinance proposed changes from the Planning Commission until the Council has the Uniform City Design from the Planning Commission. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. BILLS: A motion was made by Councilman Shulstad and seconded by Councilman Hobbs to amend the bill under Minnetonka Community Schools to $1,125.00 instead of $1,238.00. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Shulstad to approve the bills as amended. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. I 71-4 DORN SEWER AND WATER: Through an error the Gabbert, Gabbert, and Beck property was assessed. They derive no benefit from this improvement. They have paid the first one-half of the 1974 assessment in the amount of $796.44. The City Attorney recommended this money be refunded. A motion was made by Councilman Shulstad and seconded by Councilman Neveaux to refund to Gabbert, Gabbert, and Beck the sum of $796.44 be reason of an erroneous assessment in Project 71-4. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Shulstad, Neveaux, and Kurvers. No negative votes. Motion carried. BURROUGHS ACCOUNTING MACHINE: Mr. Ray Charpentier, Burroughs Corporation, was present to discuss the capabilities of the L-3000 Accounting Machine that the City owns. The City presently is doing the utility billing on the machine. Eight hundred residential bills are sent out quarterly. These bills take six days to process because the meter reading cards do not come in at the same time. He suggested the I billing could be divided so that one-third is billed each month. This would even out the money coming in for utilities. The commercial accounts are billed monthly. Cash receipts from the utility billing are posted by machine. This takes approximately two days per quarter. The City Payroll is not currently done by machine. Mr. Charpentier estimated this would take 1 day a month to do by machine. I I I. II I I Chanhassen City Council Minutes, January 20, 1975 -3- Revenue has been programmed for the machine but is not being used. The City Budget has not been programmed but can be set up. Special assessments are done on the machine. Warrants and bills payable can be done by machine. Mr. Charpentier suggested there be two people trained on all programs for the accounting machine. HAROLD LUND: Mr. Lund was present to complain about the way the Council handled the Fire Marshal appointment. CHANHASSEN VILLAGE: John Natwick, Urban Planning and Design, and Mr. and Mrs. Ken Beiersdorf were present asking for preliminary plat and preliminary development plan approval on 69 acres located on the south side of Highway 5 in Hennepin County. The land is zoned P3. Phases 1 - 3 are proposed multiple, Phase 4 commercial and recreational and Phase 5 future multiple residential. Phases one and two are two story stucco and wood buildings with gabled roofs for a total of 128 units. Phase three is one 128 unit three story building with one-half the parking underground. A temporary access will be located at the old sewer plant road. Mr. Natwick stated they have agreed with all the recommendations proposed by the City Consultants and Staff. Evergreen plantings are proposed as a buffer between this proposal and Chanhassen Estates. Bill Brezinsky stated that they have complied with all the recommendations of the City Engineer. The City Attorney stated he has reviewed the plan and it meets the criteria of the various codes. Mr. Beiersdorf explained that the beginning and eventual<sequence of development is contingent on financing. The first phase can begin as soon as financing is readily available. A motion was made by Councilman Neveaux and seconded by Councilman Kurvers that the City Council approve the preliminary plat and preliminary development plan for Phases 1, 2, and 3 and the conditions recommended by the Planning Commission in their minutes of January 8, 1975, and further that because of an oversite on the Planning Commission's part in recommending a written time schedule for development, the Council will recommend that the project be started within three years of the signing of the development contract and be completed five years after construction starts. The following voted in favor: Mayor Klingelhutz, Councilmen Shulstad, Kurvers, and Neveaux. Councilman Hobbs abstained as he was out of town and did not receive his information until this evening. Motion carried. RAY BRENDEN: Mr. Brenden·s well has gone dry and he would like to connect to the city water. This property was not included in the north service area although the watermain runs along the property. Mr. Brenden's farm is located on Galpin Blvd. A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to allow Mr. Brenden to hook up to the City Water System. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. 68-3 BURDICK PARK ADDITION: Councilman Neveaux moved the adoption of a resolution to split i:Ï1e assessments as per the Ci ty-'Engineer' s letter of January 13, 1975. LILL DRAINAGE PROBLEM: The City Attorney would like authorization I to negotiate with Mr. Lill for a drainage easement not to exceed $500.00. This property is Lot 1, Block 7, Pleasant Acres. A motion was made by Councilman Neveaux and seconded by Councilman Shulstad to authorize the City Attorney to negotiate for a drainage easement not to exceed $500.00. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. METROPOLITAN COUNCIL DEVELOPMENT FRAMEWORK: Bruce Pankonin, Mayor Klingelhutz, and Councilman Hobbs will attend the public hearing January 21 at Brooklin Center City Hall at 7:00 p.m. Bruce Pankonin presented a letter to the Metropolitan Council for City Council discussion. The last paragraph of this letter should read: Thank you for giving us the opportunity to comment on the Development Framework Guide. We trust our comments will be considered constructively. Add a paragraph on page 1: Chanhassen believes that the natural constraints of the land should dictate future land dispositions to the greatest extent compatible with human needs. All land uses are treated with appropriate respect in fact we always utilize the expertise of consulting firms, consulting engineering firms, and foremost the expertise of the soil conservation service. I Page 2, paragraph #1 to read: As shown on attached graphic 1, the City can be correctly described as a area in transition. Presently Chanhassen is changing from an "agricultural based community" to a well planned urban and rural City. The fact that most of the open "agricultural" land is under control of development corporations is not sufficient grounds to designate Chanhassen as an Urban Service Area. However, when this fact is considered in conjunction with the history of the Lake Ann Sewer and the limited amount of tillable land to support agricultural endeavors, the change in land ownership is indeed very rational. Councilman Hobbs left the meeting. ADMINISTRATOR: Councilman Shulstad suggested to better evaluate the persons interviewed the Council should obtain up-dated references. I A motion was made by Councilman Kurvers and seconded by Councilman Neveaux to authorize Councilman Shulstad to obtain up-dated references and any expenses incurred will be reimbursed. There will be a special council meeting Monday evening January 27, 1975, to discuss the Administrator. NSP:-Mayor Klingelhutz read a letter from NSP thanking the City Employees for their help during the recent blizzard.
