PUBLIC HEARING
VACATION OF KIRKHAM ROAD
JUNE 30, 1975, AT 8:00 P.M.

Acting Mayor Frank Kurvers called the Public Hearing to order with
the following members present: Councilmen Shulstad and Neveaux.
Councilman Hobbs and Mayor Klingelhutz were absent. The Public
Hearing was opened with the Pledge to the Flag.
The Deputy Clerk read the official Notice of Public Hearing. Ken
Smith was present requesting the Vacation of Kirkham Road south
of Leach Road, sometimes referred to as Red Cedar Point Road, or
some portion thereof.
Schöell and Madson's, Consulting Engineers, report stated that a
cul-de-sac should be built on the westerly end of South Cedar Drive.
Their report also recommended that the portion of Kirkham Road
north of South Cedar and south of Red Cedar Point Road not be
vacated because part of the sump is located in the right-of-way of
Kirkham Road. The Council felt there should be a drainage easement
of 12 feet on the easterly side of Lot 35, so that in the event of
Lots 9-14, Block 3, Red Cedar Point being developed, there would be
a way to drain the sump.
A motion was made by John Neveaux and seconded by Craig Shulstad to
continue the Public Hearing to July 21, 1975 at 7:45 p.m. because
a 4/5 vote is required and the Council felt the entire Council should
be present to review this request. The following voted in favor
thereof: Acting Mayor Kurvers, Councilmen Shulstad and Neveaux. No
negative votes. Motion carried.

CONTINUATION OF THE BOARD OF REVIEW
JUNE 30, 1975
The Continuation of the Annual Board of Review Meeting was called
to order at 8: 35 p.m. by Acting Mayor Kurvers. The following members
were present: Acting Mayor Kurvers, Councilmen Shulstad and Neveaux.
Absent were Mayor Klingelhutz and Councilman Hobbs. Mr. Waldo
Bunger was also present.
There was a discussion with Mr. Bunger and a letter was read from
Mr. William E. Huskins.

A motion was made by Councilman Neveaux and seconded by Councilman
Shulstad that the Council approve resolution #75-10 which states
that the City of Chanhassen is extremely upset over the way the
State and County Assessing Procedures have been handled this year
and the City Council authorizes either Mr. Gerald Schlenk or Mr.
Russell Larson to present this petition to the Carver County Board
of Review at the Carver County Courthouse on Tuesday, July 1, 1975,
representing Mr. Waldo Bunger and Mr. William E. Huskins. The City
of Chanhassen also requests written response to be sent to both the
aforementioned individuals with copies also being sent to the City
of Chanhassen. The following voted in favor thereof: Acting Mayor
Kurvers, Councilmen Shulstad and Neveaux. No negative votes. Motion
carried.

A motion was made by Councilman Shulstad and seconded by Councilman
Neveaux that the City also answer the letters from Mr. Waldo Bunger
and Mr. William E. Huskins. The following voted in favor thereof:
Acting Mayor Kurvers, Councilmen Shulstad and Neveaux. No negative
votes. Motion carried.

JOHN BEAR VARIANCE REQUEST: A motion was made by Councilman Shulstad
and seconded by Councilman Neveaux to grant John Bear, 508 W. 76th
Street a 4 ft. 5 in. variance on side yard regulations of Ordinance 47,
Section 7, Subsection 7.05 so that he can build a 26 ft. x 26 ft.
attached garage, as per the recommendation of the Board of Adjustments
and Appeals. The following voted in favor thereof: Acting Mayor
Kurvers, Councilmen Shulstad and Neveaux. No negative votes~ Motion
carried.
LAKE ANN PARK GATE CHARGES: A motion was made by Councilman Neveaux
and secondedhy Councilman Shulstad that the Park Gate Attendants
will be on duty on July 4, 1975 at Lake Ann Park but there will be
no charge for the use of the Park on Saturday and Sunday, July 5 & 6,
1975, due to Frontier Days. The following voted in favor thereof: Acting
Mayor Kurvers, Councilmen Shulstad and Neveaux. No negative votes.
Motion carried.
A motion was made by John Neveaux and seconded by Councilman Shulstad
to adjourn the meeting. The following voted in favor thereof: Acting
Mayor Kurvers, Councilmen Shulstad and Neveaux. No negative votes.
Motion carried.
