1975 12 23 I ) ~I SPECIAL CHANHASSEN CITY COUNCIL MEETING DECEMBER 23, 1975 Mayor Klingelhutz called the meeting to order at 7:15 p.m. with the following members present: Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. Russell Larson was present. LOP~N LAW: Mr. Law explained the progress he has made in finding candidates for the position of City Clerk-Administrator. He suggested that each Councilman individually meet with each candidate. A motion was made by Councilman Shulstad and seconded by Councilman Hobbs to authorize Loren Law to proceed with the further screening of candidates requesting that no more than five candidates be reviewed and recommended before the Council by January 10, 1976, at 9:00 a.m. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. Mr. Law will mail information to the Council prior to the meeting. GARY CARLSON PROJECT 75-5: Gary Carlson was present. The City Attorney reviewed his reports of December 18, 1975, and December 23, 1975. The assessed valuation of Lot 4, Schmid's Acres is $33,700. The City Attorney has talked with Mr. Carlson about a cash payment and Mr. Carlson stated he is not able to raise any cash at this time. Mr. Carlson has asked for one unit against Lot 6 and nine units against Lot 4. Mr. Carlson would accept an accelerated assessment. The City Attorney recommended that the Council assess three deferred units against the Howard Verlo property, three deferred units against the Vernon H. Peterson property, three units assessed against Lot 4 and one unit assessed against Lot 6. The three units against Lot 4 could be paid on an accelerated basis in equal installments over a period of four years. An alternate proposal of one unit payable to be assessed against Lot 6 and nine units assessed against Lot 4, payable in equal installments over a period of 4 to 6 years was auggested. RESOLUTION 75-66: Councilman Hobbs moved the adoption of a resolution that the Council rescind Resolution #75-52 dated November 17, 1975, dealing with the assessment of the Watermain Project 75-5 placing five water assessments against Lot 6 and five water assessments against Lot 4 of Mr. Gary Carlson's property on Project 75-5. Resolution seconded by Councilman Neveaux. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. RESOLUTION 75-67: Councilman Neveaux moved the adoption of a resolution placing one water unit against that part of the east 200.00 feet of Lot 6, Schmid's Acres Tracts, Carver County, Minnesota, according to the recorded plat thereof, which lies south of the north 435.50 feet, Plate 191 DO, to be paid immediately, and three water units against Lot 4, Plate 189 DO, payable over a four year period. The first installment to be due and payable with taxes in 1976 at an interest rate of 8%. Resolution seconded by Councilman Shulstad. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. Motion carried. Mr. Carlson stated he will be platting Lot 4 in the near future. --- Special Council Meeting December 23, 1975 -2- A motion was made by Councilman Neveaux and seconded by Councilman Hobbs that the three units pending against the Verlo property and three units pending against the Peterson property be discussed after a recommendation is submitted by the City Attorney at the January 5, 1976, meeting. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative ,votes. Hotion carried. The Acting Administrator will set up a meeting with Vernon Peterson, the City Attorney, and himself. Mr. Verlo has agreed to a pending assessment. DECEMBER 26: The City Employees have asked to have December 26 as a holiday. The Council felt that the City Offices should not be closed. It was felt that holidays should be negotiated at the beginning of each year. A motion was made by Councilman Shulstad Kurvers to adjourn. The following voted Councilmen Hobbs, Neveaux, Shulstad, and Meeting adjourned at 9:15 p.m. and seconded by Councilman in favor: Mayor Klingelhutz, Kurvers.
