CHANHASSEN VILLAGE COUNCIL MEETING - FEBRUARY 2, 1970
The Chanhassen Village Council meeting on February 2, 1970
was opened with the Pledge to the Flag at 8:00 p.m. in the
Chanhassen Village Hall. The following members were present:
Mayor Coulter, Councilman Klingelhutz, Bennyhoff, Pearson,
and Hill.
COUNCIL MINUTES: A motion was made by Councilman Bennyhoff
and seconded by Councilman Hill to approve the Council Minutes
of January 12, 19, and 20, 1970. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson,
and Hill. No negative votes. Motion carried.
INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilman
Klingelhutz and seconded by Councilman Pearson that the January 14,
1970, Industrial Commission minutes be nored and read. The following
voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz,
Bennyhoff, Pearson, and Hill. No negative votes. Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Hill and seconded by Councilman Pearson that the January 13, 1970,
Planning Commission minutes be noted and read. The following
voted in favor thereof: Mayor Coulter, Councilman Bennyhoff,
Pearson, Klingelhutz, and Hill. No negative votes. Motion carried.
ß-OARD OF ADJUSTMENTS & APPEALS: The Richard Kartak request for
a side yard" variance was tabled until February 16, 1970. Mr.
Kartak and Mr. Otterdahl are to be notified of what nme they will
be on the Agenda.
HIGHWAYS 101 & 5: A motion was made by Councilman Hill and seconded
by Councilman Pearson to approve the State Highway Departments
request to locate two 400 watt lamps on this intersection as per
layout on filè, dated January 19, 1970. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Pearson, and Hill. No negative votes. Motion carried.
The minutes should reflect that the Village feels that these two
poles should be the break-away type if this is to be a permanent
installation. The Administrator will notif"y the Highway Department
of the Council's feelings on this matter.
HORSE ORDINANCE: The Village Administrator read the proposed Shorewood
Horse Ordinance. The Village Attorney explained the differences from
the existing ordinance and the proposed Shorewood Ordinance. He also
discussed the ramifications of commercial stables in the Village of
Chanhassen. Mayor Coülter asked the question on item 7 of Section 3
which reads as follows: "Only the horses owned by the applicant
or member of applicants household shall be allowed to be kept on the
premises." Would this be good? He further questioned Subsection
9 of Section 3 which reads as follows: "The keeping, storing,
or stabling of said animal on the premises shall not contribute to
the pollution of any public bodies of water", as being very hard to
inforce. Councilman Klingelhutz stated that this proposed Shorewood
Ordinance does not have any section dealing with stables.

VILLAGE COUNCIL MINUTES - February 2, 1970
The followirug residents who are concerned with the Horse
Ordinance were present: Jerry Yanisch, A.W. Owens, Bert Pierce,
Al Harvey, Mildred O'Brien, Terry O'Brien, Sally Larson, Richard I
D. Eide, Thomas o. Klingelhutz, Jack Swedlund, Tim Tierney,
Nancy DeMun, Dave HeadIer, Marilyn Larson,A.K. Evaus, Merald
Krogstad. The Mayor, Eugene Coulter, asked if there were any
questions from the floor concerning this Horse Ordinance. Jerry
Yanisch stated, " I would like to suggest we as horse owners
in Chanhaqsen form an association and police our own horse problems."
Al Harvey stated that he fel£ the existing ordinance is as good as
the proposed Shorewood Ordinance. Councilman Pearson stated that
he liked Mr. Yanisch's suggestion. A motion was made by Councilman
Bennyhoff and seconded by Councilman Klingelhutz to table any further
action on this matter at this time. The following voted in favor
thereof: Mayor Coulter, Councilman Klingelhutz, Bennyhoff, Pearson,
and Hill. No negative votes. Motion carried.
Mayor Coulter asked Mr. Yanisch to report back on February 16, 1970,
on what he had done in contacting and forming a local association.
CARVER BEACH PROPERTY: The Village Attorney gave a report on what
had been done at this time. Councilman Hill explained to the rest
of the Council what the status of the Carver Beach Association
was at this time. Councilman Klingelhutz made a motion to authorize
Mr. Hill to meet with the Carver Beach people and report back to
the Council. Councilman Bennyhoff seconded the motion. The following
voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz,
Bennyhoff, Pearson, and Hill. No negative votes. Motion carried.
POLICE REPORT: Lt. Klein gave his first monthly report. Mr.
Klein explained the report that was turned in and other miscellaneous
duties that the Police Department does which were not noted in the
report. The police committee and the Administrator will meet with
the Police Department and submit a report back to the entire Council.

VILLAGE SUPERINTENDENT: Henry Wrase gave a report on the seminar
that he attended on pesticides. He stated that he felt this was a
very informative school. Mr. Wrase submitted a written report which
is on file. Mr. Wrase stated that he would be meeting with the
Maintenance Committee soon to discuss general maintenance work that
will be done this summer.
HANSEN & KLINGELHUTZ FUTURE DEVELOPMENT: The Administrator was
instructed to prepare a report on the capacity of the sewer plant
that is used now and what the total committed capacity would be.
The report will be presented at the February 16, 1970 meeting.
MINNESOTA VALLEY GAS COMPANY: The Mayor explained to the Council
what has been done on the new gas rates at this time~ He also
explained that the City of Litchfield, Minnesota, is also concerned
with this increase and is considering setting up a meeting of any
and all municipalities interested.

~LUMBING CODE: A motion was made by Councilman Hill and seconded
by Councilman Klingelhutz authorizing the Village Attorney to
prepare an admendment to the plumbing ordinance adopting the
current Minnesota State Plumbing Code. The following voted in
favor thereof: Mayor Coulter, Councilmen Klingelhutz, Pearson,
Hill, and Bennyhoff. No negative votes. Motion carried.
PARK AND RECREATION COMMISSION: A motion was made by Councilman
Hill and seconded by Councilman Bennyhoff to approve the request
from the Park and Recreation Commission for $40.00 to be spent
on the teenage dance, February 14, 1970, Valentines Day. cThe
following voted in favor thereof; Mayor Coulter, Councilmen
Klingelhutz, Bennyhoff, Pearson, and Hill. No negative votes.
Motion carried.
WELTER OPTION: The Village Attorney explained to the Council the
length of this option and some items that should be worked out
beofre further action is taken.
ZONING ORDINANCE: The Village Attorney explained his view point
on a number of items in the Zoning Ordinance.
A motion was made by Councilman Hill and seconded by Councilman
Bennyhoff to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson, and
Hill. No negative votes. Motion carried. Meeting adjourned.
