CHANHASSEN VILLAGE COUNCIL MINUTES - March 2, 1970
The regular Chanhassen Village Council Meeting on March 2, 1970,
at 8:00 p.m. in the Village Hall, was opened with the Pledge to
the Flag. The following members were present: Mayor Coulter,
Councilmen Klingelhutz, Pearson, and Hill. Councilman Bennyhoff
was absent.
COUNCIL MINUTES: A motion was made by Councilman Pearson and
seconded by Councilman Hill to approve the Council minutes of
February 16 and 23, 1970. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Pearson, and Hill. No
negative votes. Motion carried.
PARK AND RECREATION COMMISSION: A motion was made by Councilman
Pearson and seconded by Councilman Klingelhutz that the revised
minutes of November 25, 1969, and the February 17, 1970 minutes
be noted and read. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Pearson, and Hill. No negative
votes. Motion carried.
PLANNING COMMISSION: A motion was made by Councilman Klingelhutz
and seconded by Councilman Hill that the February 10, 1970, minutes
be noted and read. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Pearson, and Hill. No negative
votes. Motion carried.
CIGARETTE LICENSE: A motion was made by Councilman Pearson and
seconded by Councilman Klingelhutz to approve the cigarette license
application for Leach's Resort. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz, Pearson, and Hill.
No negative votes. Motion carried.
RICES RESORT: Councilman Klingelhutz explained that Mr. Roy Kelm
is considering purchasing Rices Resort. The resort has been renting
non-motorized fishing boats for the past 23 years. Mr. KeIrns .
question was that if he purchased this resort, would he be able to
continue the same operation. It was decided that Mr. KeIrn should
appear before the Planning Commission. After the Planning commission
has considered this request, it would forward its recommendation on
to the Council.
SSSD: A motion was made by Councilman Hill and seconded by Councilman
Klingelhutz to approve Resolution #3270~ I1A Resolution approving the
letting of a contract for the construction of the first stage of the
sewage treatment plant and outfall in the town of Eaglecreek, Scott
County, by the SSSD Board. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Pearson, and Hill. No negative
voted. Motion carried.
The Mayor explained the status of the force main extending east from
the Village of Chanhassen stating that no definate construction date
has been set at this time.

MAINTENANCE DEPARTMENT: The Village Superintendent gave an
oral report on his proposed upgrading on the priority gravel
roads. A motion was made by Councilman Hill and seconded by
Councilman Pearson that the proposed upgrading of the gravel
roads with a surfacing of oil and chips be approved. The following
voted in favor thereof: Mayor Coulter, Councilman Klingelhutz,
Pearson, and Hill. No negative votes. Motion carried.

The following roads were listed in the proposal:
Lyman Boulevard - East of Highway 101
Lake Luch Road
Yosemite
63rd Street
Cardinal
A section of Carver Beach Road
A section of Red Cedar Point Road
A motion was made by Councilman Pearson and seconded by Councilman
Hill to authorize the advertising of bids for a used street sweeper.
The following voted in favor thereof: Mayor Coulter, Councilman
Klingelhutz, Pearson, and Hill. No negative votes. Motion carried.
POLICE: Lt. Klein gave the Council a monthly report on police
problems in the Village of Chanhassen. Lt. Klein also stated that
he felt that the speed limit should be reduced on Highway 5 at I
least to the intersection of trunk highway 5 and 41. Also trunk
highway 7 to the west boundary of the Village. He recommended
a speed limit of 50 MPH. No action was taken on this at this time.
FRONTIER DEVELOPMENT PARK: The Village Attorney explained to the
Council "the proposed Frontier Development Park Development Contract.
This development contract would allow the final plat to be filed.
No building permits would be issued in this plat until the Council
has agreed upon some arrangement for the improvements. A motion was
made by Councilman Pearson and seconded by Councilman Klingelhutz
to approve the final plat and the development contract for the Frontier
Development Park authorizing the Mayor and Clerk to sign said agree-
ment and final plat. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz and Pearson. Councilman Hill voted
no. Motion carried.
SEWER AND WATER RATES: Sewer Rates - A motion was made by Councilman
Pearson and seconded by Mayor Coulter to set the sewer rate at $10.00
per quarter per unit. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Pearson, and Hill. No negative votes.
Motion carried.
Water Rates - A motion was made by Councilman Hill and seconded by
Councilman Hill to set the water rates as follows:
Minimum - $3.00 I
75¢ per 1000 gallons for the first 10,000 gallons
45¢ per 1000 gallons allover 10,000 gallons
The following voted in favor thereof; Mayor Coulter, Councilman
Klingelhutz, Pearson, and Hill. No negative votes. Motion carried.

ASSISTANT CpUNTY ATTORNEY: A motion was made by Councilman Klingelhutz
and seconded by Mayor Coulter to move the following Resolution:
WHEREAS, the 1969 Minnesota Legislature did enact Chapter 748,
entitled The Carver County Municipal and Conciliation Courts; said
act becoming effective July 1, 1969; and -"
WHEREAS, it appears that a financial report of said County Court
System for the first six months of operation indicates that the
revenues received by said court system exceeded the cost of operation
and maintenance of said court system; and
WHEREAS, the Board of County Commissioners for Carver County may
authorize the employment of an Assistant County Attorney on a two-day
per week basis; and
WHEREAS, it appears that certain inequities in Chapter 748 as passed
by the Minnesota State Legislature, more particularly, the requirement
that the local prosecuting attorney prosecute all misdemeanors,
including violations of state statutes, occurring within the corporate
limits of the particular jurisdiction in which said prosecutor has
authority; and
WHEREAS, the local municipality receives no portion of the fines
received for violations of state statutes notwithstanding the
requirement that the particúQar municipality must bear thé cost of
prosecuting said statutory violations.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of
Chanhassen as follows:
1. That it is the desire of this Council that the Board of
Commissioners, Carver County, retain as Assistant County Attorney
for the County of Carver.
2. That concurrent with the employment of said Assistant County
Attorney, the Carver County Attorney's office commence prosecution
of all traffic and breach of peace violations occurring within the
County of Carver, including both Ordinance and Minnesota State
Statute traffic and breach of peace violations.
3. That the cost of said prosecution in Carver County be assumed
by the County of Carver.
The following voted in favor thereof: Mayor Coulter, Councilman
Klingelhutz, Pearson, and Hill. No negative votes. Motion carried.
VILLAGE ATTORNEY: A motion was made by Councilman Klingelhutz and
seconded by Councilman Pearson that the Village Attorney is hereby
authorized to retain the service of Attorney Luke Melchert to assist
in the municipal court prosecution. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz, Pearson, and Hill.
No negative votes. Motion carried.
WARRANTS: A motion was made by Councilman Pearson and seconded by
Councilman Klingelhutz that the following warrants be paid:
1968-lB Storm Sewer
1969-2 Sewer & Water
68-2 Well
1968-3 Sewer
The following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Pearson, and Hill. No negative vote$. Motion carried.

CHANHASSEN VILLAGE COUNCIL MINUTES - March 2, 1970
TREASURER'S REPORT The Treasurer explained the total
expenditure in each budget for the year of 1969. Also
passed out a report indicating the total cash flow for the
year of 1969. Another report was submitted indicating the
total general Village expenditures on an accrual basis.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Pearson that the Village Attorney be authorized
to send out letters adding interest on past due accounts.
The following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Pearson, and Hill. No negative votes. Motion
carried.
A motion was made by Councilman Pearson and seconded by
Councilman Klingelhutz to authorize the Treasurer to invest
such excess funds that are available in consultation with the
Village Attorney. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Pearson, and Hill. No
negative votes. Motion carried.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Pearson, and Hill. No
negative votes. Motion carried.
