CaA~RA$$E~ V¡LLAGE COUNCIL MEETING - March 16, 1970
The Regular Chanhassen Village Council Meeting was opened with
the Pledge to the Flag at 8:00 P.M. on March 16, 1970 in the
Chanhassen Village Hall. The following members were present:
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, and Hill. Councilman
Pearson was absent.
Councilman Pearson arrived at the Council Meeting at 8:15 p.m.
COUNCIL MINUTES A motion was made by Councilman Klingelhutz
and seconded by Councilman Hill to approve the Council minutes
of March 2, 1970, with the following amendments:
WATER RATES: A motion was made by Councilman Hill and seconded
by Councilman Pearson to set the water rates as follows: Commercial-
$3.00 minimum monthly statement, 75¢ per 1000 gallons for the
first 10,000 gallons, 45¢ per 1000 gallons allover 10,000 gallons.
Residential - $7.50 minimum quarterly statement, 75¢ per 1000
gallons for the first 10,000 gallons, 45¢ per gallons allover
10,000 gallons.The following voted in favor thereof: Mayor Coulter,
Councilman Klingelhutz, Pearson, and Hill. No negative votes.
Motion carried.
TREASURERS REPORT: A motion was made by Councilman Pearson
and seconded by Councilman Klingelhutz to authorize the Treasurer
to invest such excess funds that are available in consultation with
whomever the Treasurer deems necessary. The following voted in
favor thereof: Mayor Coulter, Councilmen Klingelhutz, Pearson,
and Hill. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hill to approve the March 9, 1970 Council minutes with the following
amendment:
MAINTENANCE: A motion was made by Councilman Pearson and
seconded by Councilman Hill to rescind the motion made on March 2,
1970, authorizing the advertising of bids for a used street sweeper.
The following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Bennyhoff, Pearson, and Hill. No negative votes. Mbtion

A motion was made by Councilman Hill and seconded by Councilman
Klingelhutz to purchase a used mobile street sweeper from the City
of St. Paul for $1,800.00. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson, and Hill.
No negative votes. Motion carried.
The Mayor stated that because of the unemployment situation some
taxes may become delinquent and that the Village should hold all
capital expense to a minimum.
PLANNING COMMISSION: March 10, 1970 A motion was made by Councilman
Hill and seconded by Councilman Bennyhoff that the Planning Commission
minutes of March 10, 1970 were noted and read. The following voted
in favor thereof; Mayor Coulter, Councilmen Klingelhutz, Bennyhaff,
and Hill. No negative votes. Motion carried.

PARK AND RECREATION MINUTES: March 3, 1970 A motion was made
by Councilman Bennyhoff and seconded by Councilman Hill that
the Park and Recreation Minutes of March 3, 1970, were noted
and read.

BILLS: A motion was made by Councilman Hill and seconded by
Councilman Pearson to approve the bills. The following voted
in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
Pearson, and Hill. No negative votes. Motion carried.
WARRANTS: Councilman Hill moved the adoption of the following
RESOLUTION:" BE IT RESOLVED that the following bills be paid
in warrants:
1966-2 Building Fund - American National Bank in the amount of
$4,110.51. Check # 185 (Sinking Fund)
1967-5 Building Fund - First National Bank of Saint Paul in the
amount of $1,816.40. Check # 187
GENERAL FUND - in the amount of $6,000.00 Check # 1167
RESOLUTION SECONDED by Councilman Pearson. The following voted
in favor thereof: Mayor Coulter, Councilman Hill, Pearson,
Klingelhutz, and Bennyhoff. No negative votes. Motion carried.
HOUSING FOR,THE.EJLDERLY: Councilman Hill explained to the Council I
of his meeting with the Administrator and the Office of Economic
Opportunity. A motion was made by Councilman Hill and seconded
by Councilman Klingelhtuz that a fact funding committee of one
or two men be set up to research what type of Federal funds are"
available and report back to the Council.
MINNEWASHTA HEIGHTS LOTS: The Village Attorney explained the existing
covenants on the Minnewashta Heights Subdivisions with regards to
registering the deeds on the three lots that the Village has acquired.
A motion was made by Councilman Hill and seconded by Councilman
Bennyhoff to authorize the Village Attorney to reg!$ter the deeds
to the Lots in Minnewashta Heignts, without seeking releasement
of covenants relating to single family use. The following voted
in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
Pearson, and Hill.
HAZARDOUS BUILDINGS: The Village Attorney stated the reason why
we should proceed with care as condemnation of a building is only
an action of last resort. The Administrator informed the Council
of six different structures that should be condemned. It was the
decision of the Council to contact the owners of these structures to
take immediate action.

CHANHASSEN VILLAGE COUNCIL MINUTES - March 16, 1970
PLUMBING CODE ORDINANCE: A motion was made by Councilman Hill
and seconded by Councilman Bennyhoff to adopt Ordinance # 30B,
"An Ordinance amending sections l, 4, and 7 of Ordinance # 30,
the Chanhassen Plumbing Code". The following voted in favor
thereof: Councilmen Klingelhutz, Bennyhoff, Hill, and Pearson.
Mayor Coulter voted no. Motion carried.
LIQUOR LICENSE: A motion was made by Councilman Klingelhutz and
seconded by Councilman Pearson to approve the on and off-sale
intoxicating and the on and off-sale non-intoxicating liquor
license applications submitted by Pauly's Bar, Inc., Jerry's
Old West Bar, The Top-of-the-Bluff Recreational Development, and
the Chanhassen Dining Theater, and the Sunday Liquor sales of
the Chanhassen Dining Theater. The off-sale non-intoxicating
for Ed's Super Fair and the off-sale non-intoxicating and the on
sale non-intoxicating for the Chanhassen American Legion Post
# 580. The following voted in favor thereof: Mayor Coulter,
Councilmen Klingelhutz, Pearson, Hill, Bennyhoff. No negative
votes. Motion carried.
MONTHLY REPORT: Fire Department: The Fire Chief reported on the
action of the Fire Department this past month and requested that
he be authorized to attend the State Fire School. A motion
was made by Councilman Pearson and seconded by Councilman Bennyhoff
that the Fire Chief attend the State Fire School April 27-30, 1970,
with regular pay. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Pearson, Hill, and Bennyhoff. No
negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson to authorize the payment of $7.00 per day for registration
to the State Fire School. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson, and Hill.
No negative votes. Motion carried.
UTILITY DEPARTMENT: No special problems were reported at this
time.
SSSD: The Mayor gave a report as to the status of the SSSD¡ also
the Force Main that is being considered to serve the Village of
Chanhassen.
SEWER STUDY: Questions were asked of the Village Engineer with
regards to how long it would take for a feasibility study for
the Minnewashta area, estimated cost, and so forth.
A motion was-made by Councilman Hill and seconded by Councilman
Klingelhutz that the Village Engineer present at the next meeting
recommendations for a feasibility stu~y and his estimated timing
of proposed projects. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Pearson, Hill, and Bennyhoff. No
negative votes. Motion carried.

FISCAL AGENP: Mr. Elhers will be present at the next meeting
at 8:00 p.m. to explain what he can do as a fiscal agent for
the Village of Chanhassen

MUNICIPAL AID STREET DESIGNATION: A motion was made by Councilman
Hill and seconded by Councilman Klingelhutz to approve the
preliminary proposed municipal aid street designation map, dated
March 16, 1970. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Pearson, Hill, and Bennyhoff.
No negative votes. Motion carried.
PARK AND RECREATION: A motion was made by Councilman Bennyhoff
and seconded by Councilman Hill to approve a $50.00 expenditure
for the Park Practices Program. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson,
and Hill. No negative votes. Motion carried.
CIVIL DEFENSE: A motion was made by Councilman Hill and seconded
by Councilman Bennyhoff to appoint Ernie Keefer as CivilLDefense
Chief at a rate of $25.00 per month for a period of 3 months.
At this time a comprehensive report will be submitted to the
Council. The following voted in favor thereof: Mayor Coulter,
Councilmen Klingelhutz, Bennyhoff, Pearson, and Hill. No negative
votes. Motion carried.
TAX COMMITTEE: A motion was made by Councilman Klingelhutz and I
seconded by Councilman Pearson to appoint Gedney Tuttle to
the Tax Committee. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson, and Hill.
No negative votes. Motion carried.
MOLINE PROPERTY: A motion was made by Councilman Pearson and
seconded by Councilman Hill to authorize the Planning Commission
at hold the rezoning Public Hearing on the Moline Property March
31, 1970, at 7:30 p.m. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Pearson, Hill, and Bennyhoff.
No negative votes. Motion carried.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Pearson to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson, and Hill.
No negative votes. Motion carried.
