CHANHASSEN VILLAGE COUNCIL MINUTES - April 20, 1970
The regular Chanhassen Village Council Meeting on April 20, 1970,
at 8:00 p.m. was opened with the Pledge to the Flag. The
following members were present: Mayor Coulter, Councilmen
Pearson, Hill and Bennyhoff. Councilman Klingelhutz was
absent.
Persons present at this Meeting were as follows: T. E. Gallagher,
Esther and George Nugent, Peg Gallagher, Walter arid Charlotte
Cleveland, H. Ray and Margaret Brenden, Elzada Martin,
Nancy Sotherlund, Amy and Henry Moline, Conrad Fiskness,
Mr. and Mrs. B. R. Paramore, Mr. and Mrs. Harold Kerber,
Al Harvey, Ward Passe, Dan Herbst, Terrance R. O'Brien,
Mr. and Mrs. L. D. Sparks, Mr. and Mrs. Clark Nicholson,
Mr. and Mrs. Darrell D. Johnson, Mr. and Mrs. Halvor Bang,
George Steller, Freg Niggeler, Bernard Benz, Ken Sotherlund,
O. H. Larson, J. Orville Martin.
COUNCIL MINUTES: A motion was "'mâ.àe;=þy by Councilman Pearson
and seconded by Councilman Hill to approve the Council minutes
of April 6, 1970. The following voted in favor thereof:
Mayor Coulter, Councilmen Pearson, Hill and Bennyhoff. No
negative votes, Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made
by Councilman Hill and seconded by Councilman Bennyhoff that
the April 14, 1970, Park and Recreation Commission be noted
and read. The following voted in favor thereof: Mayor Coulter,
Councilmen Pearson, Hill and Bennyhoff. No negative votes.
Motion carried.
PLANNING COMMISSION MINUTES: ~ motion was made by Councilman
Pearson and seconded by Councilman Bennyhoff that the
Planning Commission minutes of April 7, and April 14, 1970, be
noted and read. The following voted in favor thereof:
Mayor Coulter, Councilmen Pearson, Hill and Bennyhoff. No
negative votes. Motion carried.
INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilman
Pearson and seconded by Councilman Bennyhoff that'the
Industrial Commission minutes of April 8, 1970, be noted and
read. The following voted in favor thereof: Mayor Coulter,
Councilmen, Pearson, Hill and Bennyhoff. No negative votes.
Motion carried.
PARK AND RECREATION COMMISSION: The Chairman of the Park and
Recreation êommission , St:eve Wolf, presented a number;'of
slide pictures on the proposed major park site and explained
the overall park concept plan,and explained how acquisition
would be handled by phases. Mr. Wolf requested some sort of
an indication from the Council if they approved the general
direction that the Park Commission is proceeding on.
Councilman Pearson stated that with regard to the general plans
that have been presented tonight, that he was in basic agree-
ment. The Mayor stated that he would like to call a Special

Meeting for APFi141ì970, at which time a detailed report could I
be given on the status and future plans of the Park and
Recreation Commission.
MOLINE PROPERTY: The Village Attorney made an opening
statement with regard to this property, that in his opinion,
the Public Hearing that was held by the Planning Commission
did not fulfill the legal obligations. He further said
that the Village Council must hold a Public Hearing for the
rezoning. Mr. Scholer stated what action had been taken do
date, by the Planning Commission.
k motion was made by Councilman Hill and seconded by Councilman
Pearson to set a date for a Public Hearing on the Moline
Property for May 11, 1970, at 7:30 p.m., for rezoning from
Farm Residence District to Residence District 'IC". The
following voted in favor thereof: Mayor Coulter, Councilmen
Pearson, Hill and Bennyhoff. No negative votes. Motion
carried.
PUBLIC HEARINGS: A motion was made by Mayor Coulter and
seconded by Councilman Pearson that prior to any public
hearing, the Village Attorney would approve all documents and
the format of the publication. The following voted in favor
thereof: Mayor Coulter, Councilmen Pearson, Hill and Bennyhoff.
No negative votes. Motion carried.
BILLS: A motion was made by Councilman Hill and seconded by
Councilman Pearson to pay all bills, as submitted and to pay
$8.00 registration fee for the Governors Conference on
Drug Abuse and Youth Environment. The following voted in favor
thereof: Mayor Coulter, Councilmen Pearson, Hill and Bennyhoff.
No negative votes. Motion carried.

A motion was made by Councilman Hill and seconded by Councilman
Pearson to adopt the following RESOLUTION: BE IT RESOLVED
that the following warrant be paid off:
GENERAL FUND - Check dated April 21, 1969, check number 156,
in the amount of $1,087.00.
The following voted in favor thereof: Mayor Coulter, Councilmen
Pearson, Hill and Bennyhoff. No negative votes. Motion
carried.
Councilman Hill moved the adoption of the following RESOLUTION:
BE IT RESOLVED that the following bill be paid in a warrent:
GENERAL FUND - Lake and feasibility study - in the amount of
$1132.50 by check number 1235.
RESOLUTION SECONDED by Councilman Pearson. The following voted
in favor thereof: Mayor Coulter, Councilmen, Pearson, Hill and
Bennyhoff. No negative votes. Motion carried.
A motion was made by Councilman Bearson and seconded by
Councilman Hill for approval of writing a Warrenty in the amount
of $800.00 for the 69-2 Project.

HIGHWAYS 212 - 169 - 41: The Village ~ttorney explained the
legal requiements that the State Highway Department must meet
before this corridor system can be given final approval.
SSSD: The Village Attorney explained the Resolution that was
being submitted.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Pearson adopting the following Resolution #420701.
A RESOLUTION AUTHORIZING AND DIRECTING THE SOUTHWEST SANITARY
SEWER DISTRICT BOARD TO TRANSFER ASSETS AND PROPER~Y TO THE
METROPOLITAN SEWER BOARD AS REQUIRED BY LAW.
The following voted in favor thereof: Mayor Coulter. Councilmen
Pearson, Bennyholf and Hill. No negative votes. Motion carried.
PURGATORY - RILEY CREEK WATERSHED DISTRICT: Mr. Ray Peterson,
a member of the Watershed District, was present to explain what
the Watershed Didstrict had done tò date.
DEVELOPMENT: A motion was made by Councilman Pearson and
seconded by Councilman Hill adopting the following Resolution
#420702, which reads as followš:~
WHEREAS, the Village Council of the Village of Chanhassen is in
agreement with the policy announced in the Metropolitan
Development Guide of January 22, 1970, relating to the prohibition
of the discharge of effluent into all lakes in the Metropolitan
area, and
WHEREAS, private individual sewage disposal systems have proven
unsafe and unreliable in many instances in the Chanhassen area
in that there has been contamination of underground water supplies
and the surfacing of sewage effluent to the serious detriment of
public health, and
WHEREAS, duplication of sewage service installation costs to the
property owner result from the practice of permitting building
construction in areas where public sewage'disposalis not
presently available, and
WHEREAS, the furnishing of public sanitary sewer services to all
areas óf the Village is not feasible at the present time, with the
consequences that priorities need be established for the
furnishing of said service to the more critical-need areas.
NOW, THEREFORE, BE IT RESOLVED that the Village Council adopts
the following policy:
1. That future proposals for subdivision plats be approved
only for Village areas served by public sanitary sewers.
2. That residential building permits in the Village areas
not now platted be limited to one (1) permit for each
,five (5) acre tract.
3. That all future proposals for' commercial, industrial,
and multiple areas must be served by sanitary sewer.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Village Council
recommends that the Village pursue the installation of public
water at the same time sanitary sewers are installed to limit
double expense to the public.

The following voted in favor thereof: Mayor Coulter, Councilmen
Pearson, Bennyhoff and Hill. No negative votes~ Motion carried.
POLICE: Lt. Klein presented and explained his monthly report
to the Council, also the problem of mini-bikes and explained
that the Park. & Recreation Commission is setting up an area
for the children, in the area, to ride their mini-bikes.

MA~NTENANCE DEPARTMENT: The Village Superintendent gave his
monthlg-reportto the Council. There were no special problems
since the last monthly report.
UTILITY DEPARTMENT: Jerry Schlenk gave his monthly report on
his miscellaneous problems in the Utility Department and
requested the Council to install an overflow line from the
water tower to the storm sewer line.
A motion was made by Mayor Coulter and seconded by Councilman
Pearson to authorize the Engineer to prepare a report on plans
and estimated cost to install an overflow line from the water
tower to the storm sewer line. The following voted in favor
thereof: Mayor Coulter, Councilmen Pearson, Bennyhoff and Hill.
No negative votes. Motion carried.
FIRE DEPARTMENT: The Fire Chief gave his report on Fire
Department activities of last month, stating that there had
only been two grass fires in this time.

OAKMOUNT: A motion was made by Councilrµan Bennyhoff,· and
seconded by Councilman Pearson to set the date of May 25, 1970,
at 8:30 p.m. for a Public Hearing for rezoning of the Oakmount
Property from Farm Residence District to Residence District "C".
The following voted in favor thereof: Mayor Coulter, Councilmen
Pearson, Bennyhoff and Hill. No negative votes. Motion carried.
STODOLA: A motion was made by Councilman Pearson and seconded
by Councilman Bennyhoff to set the date of May 25, 1970, at
7:30 p.m. for a Public Hearing for rezoning of the Stodla
Property from Farm Residence District to Residence District "C".
The following voted in favor thereof: Mayor Coulter, Councilmen
Pearson, Bennyhoff and Hill. No negative votes. Motion carried.
ADMINISTRATION: A motion was made by Councilman Bennyhoff and
seconded by Councilman Hill to hire Francene C. Clark for a
salary of $350.00 per month. The following ~oted in favor
thereof: Mayor Coulter, Councilmen Pearson, Bennyhoff and Hill.
No negative votes. Motion carried.
BOARD OF ADJUSTMENTS AND APPEALS: The following report was
submitted bY-the Board of Adjustments and Appeals:

A request made by Monahan Builders for a building permit which
was denied because the perculation test did not pass the maximum
per rate of sixty. The two test holes indicated a rate of 120
and 160.
A motion was made by Ward Passe and seconded by Dean Scheff to
recommend that the Council deny the building permit on the grounds
of the perculation test.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to approve the report as submitted by the Board of
Adjustments and Appeals. The following voted in favor thereof:
Mayor Coulter, Councilmen Pearson, Bennyhoff and Hill. No
negative votes. Motion carried.
AUDITOR'S SUBDIVISION 2, LOT 12: A motion was made by Councilman
Hill and seconded by Councilman Bennyhoff to arrange with the
Engineer to survey the water course of Lot 12. The following
voted in favor thereof: Mayor Coulter, Councilman Pearson,
Bennyhoff and Hill. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Pearson, Bennyhoff and Hill. No
negative votes. Motion carried.
