CHANHASSEN VILLAGE COUNCIL MIN1)TES " May 4, 197.Q
The regular Chanhassen Village Council Meeting on May 4, 1970,
at 8:00 p.m. was opened with the Pledge to the Flag. The
following members were present: Mayor Coulter, Councilmen
Pearson, Klingelhutz and Bennyhoff. Councilman Hill was absent.
COUNCIL MINUTES: A motion was made by Councilman Pearson and
seconded by Councilman Bennyhoff to approve the Council minutes
of April 20, 1970, with the following amendment:
AU~ITOR'S SUBDIVISION 2, LOT 2: Mayor Coulter
abstained from-action on this motion as he is part owner of this
lot. The following voted in favor thereof: Councilmen, Pearson,
Klingelhutz and Bennyhoff. No negative votes. Motion carried.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to approve the Council minutes of April 27, 1970.
The following voted in favor thereof: Mayor Coulter, Councilmen
Pearson, Klingelhutz and Bennyhoff. No negative votes. Motion
carried.
Councilman Klingelhutz would like the minutes to reflect that he
was absent when Resolution #420702 was approved. He would like
to state that he felt effluent flowing into lakes caused as much
problem as good working dra~!l/fields.
~ARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Pearson and seconded by Councilman Bennyhoff that the
April 21, 1970, Park and Recreation Commission minutes be noted
and read. The following voted in favor thereof: Mayor Coulter,
Councilmen Pearson, Klingelhutz and Bennyhoff. No negative votes.
Motion carried.
HOMESTEA~: A motion was made by Councilman Bennyhoff and seconded
by Councilman Klingelhutz to allow a Homestead on Lot 4, Block 1,
Chanhassen Estates. The following voted in favor thereof:
Mayor Coulter, Councilmen Pearson, Klingelhutz and Bennyhoff. No
negative votes. Motion carried. .
BEIERSDORF APARTMENT UNITS: Mr. Ben Gingold and Mr. Bill Silvers
presented the land sketch plan and the proposed preliminary
building plans. They explained the proposed scheduling of
construction.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson that preliminary approval be given on sketch plans given
on April 20, 1970. Additional information will be delivered to the
Village pertaining to the Village Engineer's report on this
proposed sketch plan specifications commenting on surface drainage.
The owner to comment on the controls relating to the use and the
maintenance of the common open space. The revised plans should
also show one (1) enclosed garage per each apartment unit. Plans
should also include a typical cross section of the garages. The
owner to dedicate the service road area. A proposed development
schedule should be submitted.

BLUE JAY ST~EET: A motion was made by Councilman Bennyhoff and
seÒondec1by - Councilman Pearson ·to hold a Public Hearing on the
improvements for Blue Jay Stree·t at 7: 30 p.m. on Monday, May 18,
J970. The following voted in favor thereof: Mayor Coulter,
Councilmen Pearson, Klingelhutz and Bennyhoff. No negative votes.

COUNTY HIGHí\TAY POLICY: A mot:ion was made by Councilman Bennyhoff

not give final approval to their proposed County Highway Policy

CHASKA SEWER EXTENSION: A motion was made by Councilman Klingelhutz
a-ncr-se-c~onded bY·Ô)uncllman Pearson that the Village Engineer submit.
a roport to the Village Council on how the extension would effect
the Village and what areas could use a sewer trunk line. Also a
letter be sent to the MeiTopo1i tan Council explaining what action
has been taken. The following voted in favor thereof:
Mayor Coulter, Councilmen Pearson, Klingelhutz and Bennyhoff.
No negative votes. Motion carried.
67-4: The Council Committee gave its report and recommendation
that a Reassessment Hearing be held. Mr. Scholer stated that
he should have final plans on Rose Lane soon.

A motion was made by Councilman KlingeJ.hutz and seconded by
Councilman Pearson to table the setting of any Reassessment Hearing
until the first meeting in June.
A motion was made by Councilman KlingeJ.hutz and seconded by
Councilman Pearson to authorize the Village Engineer to proceed
with construction plans and specifications for sewer and water
to complete this project. The following voted in favor thereof:
Mayor Coulter, Councilmen Pearson, Klingelhutz and Bennyhoff. No
negative votes. Motion carried.
I<ENNEL PERMITS: A motion was made by Councilman Bennyhoff and
seconded~by Councilman Pearson to approve Kennel Permi ts for
Joe Kenyon and John Malakowsky. The foJ.lowing voted in favor
thereof: Mayor CouJ.ter, Councilmen Pearson, Klingelhutz and
Bennyhoff. No negative votes. Motion carried.
DEVELOPMENT RESOLUTION: The Village Attorney stated that he
felt fEat th]~ResoTution was a reasonable police power and I
that it was within the rights of the Village Council to enforce.

OUTDOOR METERS: A motion was made by Mayor Coulter and seconded
by Councilman Pearson to defer any action for thirty days. The
following voted in favor thereof: Mayor Coulter, Councilmen
Pearson, Klingelhutz and Bennyhoff. No negative votes. Motion
carried.
REZONING: The Village Attorney explained the rezoning procedure.
The Village Attorney will attend the May 12, 1970, Rezoning Meeting
and discuss the rezoning procedure.
BOARD OF REVIEW: The Annual Board of Reviews will be Monday,
June~2, 1970, at 7:30 p.m., at the Chanhassen Village Hall.
CARVER COUNTY REDISTRICTING: A motion was made by CQuncilman
Pearson and secdnded by Councilman Klingelhutz adopting
Resolution #5470-1 which read as follows:
RESOLUTION IN SUPPORT OF THE REDISTRICTING COMMISSIONER DISTRICTS
IN CARVER COUNTY.
WHEREAS, the Fourteenth Amendment to the Federal
Constitution forbids the election of local officials from districts
of disparate size, and
WHEREAS, citizens qualified to vote have the right under
the law to an equally effective voice in the election process, and
WHEREAS, Minnesota Statutes, Section 375.02, requires that
County Commissioner districts shall contain as nearly as
practicable an equal population, and
WHEREAS, it appears evident that the First District of
Carver County contains a population substantially greater than any
of the other districts in the county; and that in all probability,
the 1970 Federal Census will establish that the population of the
First District will exceed the 30% limitation of the above statute,
and
WHEREAS, the disproportionate population of the First
District in relation to the other districts of the county denies
the citizens of the First District their right under the law to an
equal effective voice in county government and thereby constitutes
a contravention of their constitutional guarantee,
NOW, THEREFORE, BE IT RESOLVED by the Council of the
Village of Chanhassen:
1.
That the Carver County Board of Commissioners be, and
hereby is, urged to institute redistricting proceedings
without undue delay in order to correct the serious
imbalance in the representation of the citizens of the
First District in county government.

That all citi~ehs of the Village of Chanhassen
and of the First District be, and hereby are,
urged Lo take an active and vigorous part in
seeking the redistricting of Carver County for
the purpose of insuring their right to proportional
representation in county government.

carried.
HAZARDOUS BUILDINGS: A report was given by the Administrator

that were termed hazardous.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Pearson to adjourn. The following voted in favor
thereof: Mayor Coulter, Councilmen Pearson, Klingelhutz and
Bennyhoff. No negative votes. Motion carried.
