1970 05 18 r I I I ~ PUBLIC _~EARING~-.sTREE.!...::IMPR9VEME~T '.BLl!Ei~~Y ßT~ET) The Chanhassen Village Council met on May 18, 1970, for the purpose of conducting a public hearing on street improvement of Blue Jay Street. - Mayor Coulter, Councilmen Bennyhoff and Klingelhutz were present. Councilmen Pearson and Hill were absent. The Public Hearing began at 7:30 p.m. Also present were the Village Attorney, Village Administrator, and residents Donald J. Rippel, Channing Elliott and Wendell Gravlun. The Village Administrator read the official publication and also read the list of names of residents who were sent notification. The Village Engineer explained the preliminary report dated April 30, 1970. An alternate plan was also discussed, in which, there would be no excavation with an addition only of three inches of gravel at this time. The total cost of this alternate plan would cost approximately $550.00. MR. GRAVLUN: I feel that a minimum amount of cost should be incurred at this time because the street will be torn up when sewer and water is installed. The street should be brought up to the Village standards to be accepted for maintenance. CHANNING ELLIOTT: I also feel that a minimum amount of work should be done-to bring the street to the minimum acceptable standards. Mayor Coulter stated that written testimony would be accepted until 4:30 p.m. on May 22, 1970. The Council will make a decision at the June 1, 1970 meeting. A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz to adjourn the Public Hearing. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. CHANHASSEN VILLAGE COUNCIL MINUTES - May 18, 1970 The regular Chanhassen Village Council Meeting on May 18, 1970, at 8:00 p.m. was held at the Chanhassen Village Hall. The following members were present: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz~ Councilmen Pearson and Hill were absent. COUNCIL MINUTES: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to approve the Council minutes of April 27, 1970, May 4, 1970 and May 11, 1970. The following voted in favor thereof: Mayor Coulter, Coun-cilmen Bennyhoff and Klingelhutz. Not negative votes. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. I INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by" Cö"lincilman Klingelhutz that the Industrial Commission minutes of May 13, 1970, be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. LAKEVIEW HILLS SEWER EXTENSION: The Engineer explained the feasibility study that had been made by the Southwest Sanitary Sewer District on the Lakeview Hills Sewer Extension. Also, the status of the preliminary study made last year on the Lake Ann trunk line. A motion was made by Councilman Bennyhoff and seconded by Mayor Coulter to authorize the Village Engineer to update the feasibility study of the Lake Ann trunk line and the Lakeview Hills trunk line into a combined report showing the proposed assessable areas and the estimated cost. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. TAX COMMITTEE REPORT: A letter was read from the Tax Committee Study Chairman, Bill Naegele. I ENVIRONMENTAL COMMITTEE: Mayor Coulter explained that he has discussed, with Jim Lord, the possibility of being the Chairman for an Environmental Committee with four Sub-Committeemen to serve under him. A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz that the Mayor proceed along the lines that have been discussed with his recommendations for committee members to be presented to the Council for final approval at a later date. The following voted in favor thereof: Mayor Coulter Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. PLANNING COMMISSION: The Mayor read the letter of resignation from Robert Scholer. A motion was made by Councilman Klingelhutz and seconded by Mayor Coulter to approve the risignation of Robert Scholer from the Planning Commission. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No I negative votes. Motion carried. / r I I I ~ CHANHASSEN VILLAGE COUN~ILMINUTES - May 18, 1970 -3- SEWERS: The Cherne Industrial Company presented a movie IIWhat Happened" which dealt with infiltration into sewer lines. The Cherne Company manufactures a low pressure air test system. The movie was explaining how the sewer lines could be tested and save money in the future. BILLS: A motion was made by Councilman Bennyhoff and seconded by Councilman Klipg~lhutz to approve payment of all bills as submitted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. COPIER: The Administrator is to look into a Service Contract before the copier is purchased. METROPOLITAN SEWER BOARD: The Village Attorney explained his meeting with Mr. Hay concerning the take over of our sewer plant and the ·Southwest Sanitary Sewer District on JUDe 1, 1970. ALDRITT: The Village Attorney explained to the Council the status at this time, stating that the Judge had been out to look at the site plue the Village Health Officer, two repre- sentatives from the State Health Department and a representative from the State Fire Marshall's Office. Th~se officials will testify at the next court appearance. LAKE RILEY IMPROVEMENT ASSOCIATION: Mr. Robert Lindahl acted as spokesman for the:,A.ssócfation, stating that they were here again requesting money for a copper sulfate treatment for Lake Riley. They stated that they felt the Village should be obligated because the effluent from our Sewage Plants is entering Lake Riley and causing the problem. Further stating that they were not here by choice but by necessity b.ecause- the-pEoblem is here now. Mayor Coulter stat~d that there were only three Council Members present and he would prefer that the full Council be present to make a decision. He also asked the Village Attorney to have a report for the Council on the legality. A decision will be made at the June 1, 1970, meeting. DOGS: The Village Attorney explained to the Council the case that has been taken to the Municipal Court of two dogs bitting residents in Chanhassen Estates. CARVER BEACH: The Village Attorney informed the Council of the meeting the Carver Beach Association he14 in which, they voted to dedicate their park property to the Village. A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff that the Village pay the current taxes on the Carver Beach Park Property. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. 1 CHANHASSEN VILLAGE COUNCIL MINUTES - May 18, 1970 -4- BANDIMERE HEIGHTS 2ND ADDITION: The Village Attorney explained I a number of items that should be included in the Development Contract. PRE-CONSTRUCTED HOMES: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to table the approval of any permits pending further engineering and legal investigating. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. PARK AND RECREATION COMMISSION: A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz to authorize the Mayor and the Clerk to sign the Contract with Brauer and Associates, Inc., after the Village Attorney has approved, saying the Contract meets the Village requirements. The fOllowing voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried. WESTERN HILLS: A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz to authorize the release of $5,632.94 from the Western Hills escrow account. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried.
