CHANHASSEN VILLAGE COUNCIL MJ:NUTES- June 8, 1970
The Special Chanhassen Village Council meeting was held on
June 8, 1970, at 8:00 p.m., in the Chanhassen Village Hall.
It was decided to dispense with all formalities. The following
members were present: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz and Pearson.
STODOLA REZONING: The Village Engineer, Planning Commission and
Park and Recreation Commission reports had been mailed to all
the Council. The Village Attorney gave a verbal report.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to rezone the following tract of land:
That part of the Southeast \ of Section 12, Township 116 N.
Range 23 W. described as follows: beginning at a point on
the East line of said Southeast \ ac~istance of 743.83 feet
North from the Southeast corner thereof, said point being
the intersection of east line of said Southeast quarter and
the Northwesterly right of way of the Chicago, Milwaukee,
St. Paul and Pacific Railroad Company (which said point is
marked by a judicial landmark), thence Southwesterly 1519.8
feet more or less along said Northwesterly right of way line
to a point on the Southerly extension of the Easterly line
of Blocks 2 and 3, Original Town of Chanhassen, 35.45 feet
more or less North from the South line of Section 12 (which
said point is marked by a judicial landmark); thence North
along said extension to a point 116.6 feet North from the
South line of Section 12 (which said point is marked by
a judicial landmark); thence Northeasterly 1727.6 feet to a
point on the East line of Section 12 a distance of 449.89
feet North of the point of beginning (which said point is
marked by a judicial landmark}; thence South to a point of
beginning.
to Residence District "c" with a stipulation that this property
will comply with the R-4 District of the proposed Zoning Ordinance.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz and Pearson. No negative votes. Motion
carried.
JONATHAN: The Mayor opened the discussion on this topic, by
stating what had happened in the past.
Councilman Klingelhutz~~tated that he felt the Jonathan
sign would fall within the limits of Section 2, Subsection (f)
"Directional Sign" is a sigÐ erected on private property for the
purpose of directing vehicular and pedestrian traffic.
The Village ~ttorn~ stated that Section 3.19 limited
direction signs as follows: Directional signs shall be permitted
in all districts. Directional signs shall bear no advertising
and shall not exceed four (4) square feet in area.

Mr. Trumbl~ representing the Jonathan Company, stated
that we in Jonathan do not beleive in billboards but, the
sign being proposed should be considered a directional sign.
The sign being proposed would be 25 feet high with different
sized panels, the center panels to be 8 feet by 8 feet. This
sign would not be illuminated. We hope that the controls in
your Ordinance would be so designed that the proposal would
be judged on their merit. We feel that the request for this
sign has been well designed and would hope that you would
jUdge it on its merit.

A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz that a decision will be made at 8;30 p.m.,
June 15, 1970, on this request for a sign variance. The following
voted in favor thereof: Mayor Coulter, Councilman Bennyhoff,
Klingelhutz and Pearson. No negative votes. Motion carried.
Tom Klingelhutz asked a question of Mr. Trumble. "Why
is Chanhassen not shown in the Jonathan Brochure as the other
surrounding communities are?1I
ORDINANCE~~ - AMENDMENT #36A: There was a general discussion
on why this variance stated that all applications shall be referred
to the Planning Commission for their recommendation and report.
The Mayor questioned why this Variance Amendment was drawn up
requiring 4/5's vote of the full Council rather than the
traditional majority. After much discussion, it was decided
that since a request would be made, requesting a variance from
the Ordinance, that a requirement of 4/5's would not be
unreasonable. The Mayor stated that he still felt that only
a majority or 3/5's should be required in all matters.

The questions was also raised of why the recommendation could not
come from the Board of Adjustments and Appeals.
BUILDING CODE: A general discussion on the preconstructed homes
and how inspections could be made was held. A specific request
has been made,by Hilton Homes, for their home to be placed in
Greenwood Shores.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Pearson to deny the application for a Building Permit
for the preconstructed Hilton Home. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz
and Pearson. No negative votes. Motion carried.
The Mayor turned the meeting over to Action Mayor Al Klingelhutz.

AUDITOR'S SUBDIVISION 2~ LOT 12: The Village Attorney explained,
to the Council, the status and the need of acquiring an easement
on the drainage way or condemnation of Lot 12.
Tom Klingelhutz stated that being 1/21st owner of this lot,
"I would donate my share to the Village".
A motion was made by Councilman Bennyhoff and seconded by
Councilman Klingelhutz requesting that the Park and Recreation
Commission make a recommendation on this lot with regard to an
easement or condemnation. Also that the owners be present at
the next Council Meeting, June 15,1970. The following voted
in favor thereof: Councilmen Bennyhoff, Klingelhutz and Pearson.
No negative votes. Motion carried. The Mayor abstained from
action on this motion as he is part owner of this lot.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to instruct the Village Attorney to proceed with
acquiring an easement across the Zetah and Bloomberg property.
The following voted in favor thereof: Councilmen Bennyhoff,
Klingelhutz and PearSOfl. No negative votes. Motion carried.
The Mayor abstained.
The Mayor again presided over the Meeting.
ELECTION LAWS: Chapter 405 was discussed, pertaining to the
Village Elections being held every two years at the same time as
the general elections. No decision was made at this time.
COUNCIL APPOINTMENT: The Mayor stated that the following people
have indicated an interest in serving on the Council:

Steve Wolf
Anne Neils
John Neveaux
Tom Gabbert
Dick Lyman, Sr.
ENVIRONMENTAL COMMITTEE: The Mayor explained the proposed
Environmental Committee and stated that he would like to have
Mr. Bobby Phillips at the next Council Meeting as a possible
appointee to serve on this committee.
COUNCIL MEETING: Councilman Bennyhoff stated he would not be
present at the July 6, 1970, Council Meeting, as he will be a
judge at the Frontier Days Beauty Contest.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Pearson.
No negative votes. Motion carried.
