CHANHASSEN VILLAGE COUNCIL MINUTES-""7 June ),5, 1970
The regular Chanhassen Village Council Meeting on June IS, 1970,
at 8:00 p.m. was opened with the Pledge to the Flag. The
following members were present: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz and Pears9n.
COUNCIL MINUTES: A motion was made by Councilman Klingelhutz
and seconded by Councilman Bennyhoff to approve the Council
minutes of June 1, 1970 and June 8, 1970. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz and Pearson. No negative vote~. Motion carried.
The Mayor wants the minutes to reflect that he thought a
variance should not require more than 3/5 or a majority of the
Council vote.
PARK AND RECREATION MINUTES: A motion was made by Councilman
Bennyhoff and seconded by Councilman Klingelhutz that the
June 2, 1970, Park and Recreation Commission minutes be noted
and read. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz and Pearson. No negative votes.
Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Bennyhoff" and seconded by Councilman Pearson that the June I, 1970
and the June 9, 1970, Planning Commission minutes be noted and
read. The following voted in £avor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz and Pearson. No negative
votes. Motion carried.
ENVIRONMENTAL COMMITTEE: The Mayor stated that Mr. Bobby Phillips
had indicated to him on Sunday, that he would be unable to head
up this Committee.
JONATHAN SIGN VARIANCE: In the Village Attorney's opinion the
Council could act on this request tonight. The Village Attorney
explained how the Council could grant a variance and to what
extent a variance could be granted.
A motion was made by Councilman Klin~elhutz and seconded by
Councilman Pearson to grant the variance application with a
height limitation of 25 feet, no artificial lighting with a
Conditional Use Permit for 6 months to see the reation of the
Community. Sign to be used as a directional sign on the
southeast corner of Highways 5 and 41. South side would read
"You are now in Chanhassen". Mayor Coulter, Councilmen Pearson
and Klingelhutz voted yes. Councilman Bennyhoff voted no.
Motion defeated. .
Ordinance # 36A - Variance, requires 4/5 vote of the full Council.
The Mayor turned the meeting over to Acting Mayor Klingelhutz.

AUDITOR'S SUBDIVISION 2, LOT 12: The Village Attorney I
explained to the residents present, who are part owners of
Lot 12, the necessity of the Village acquiring either an
easement on drainage way or acquiring the lot. The question
discussed at some length was, should the Village acquire Lot 12
through Eminent Domain or if it is possible that all 21 owners
would dedicate.

I would have no objection to dedicating an
easement.
HUBERT FOCIER:
FLORENCE JENKENS AND GLENN MATTSON: We agree with Mr. Focier.
EUGENE COULTER: I feel that Niles Holding Co. has broken
faith with the people who have purchased
property by not turning over their share
of this Lot when their property was sold.
SALLY DE LANCEY: The Park and Recreation Commission does
not have a specific recommendation at this
time. The feelings of the people present
tonight will be discussed at the next
Park and Recreation Commission Meeting.
GENERAL DISCUSSION BY THE PARK AND RECREATION COMMISSION:
The Park and Recreation Commission feels that this -
type of lot should stay somewhat like it is for local
use only.

A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to authorize the Village Attorney to proceed with
acquiring Lot 12 of Auditor's Subdivision 2 with the least possible
expense but, to proceed with Eminent Domain if necessary.
The following voted in favor thereof: Acting Mayor Klingelhutz,
Councilmen Bennyhoff and Pearson. No negative votes. Motion
carried.
The Village Attorney will discuss, with the owners of Lot 12, what
action is pending prior to taking any final action.
The Mayor again presided over the Meeting.
BILLS: A motion was made by Councilman Pearson and seconded by
Councilman Bennyhoff that the tractor being purchased from West
Tonka Sales for $1,075.20 be approved for payment with $806.40
to be taken from the Park and Recreation Budget and $268.80 from
the Utility Department Budget. Councilmen Pearson, Bennyhoff
and Klingelhutz voted yes. Mayor Coulter voted no. Motion
carried.

A motion was made by Councilman Bennyhoff and seconded by
Councilman Pearson to approve and pay all bills submitted.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz and Pearson. No negative votes. Motion
carried.
ADMINISTRATION: A motion was made by Councilman Bennyhoff and
seconded by Councilman Pearson to approve a $25.00 per month
raise for Francene C. Clark. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Pearson.
No negative votes. Motion carried.
DICK TEICH: Mr. Teich was present to explain his request that
billboard-Signs be allowed on his property. The Council explained
what action had been taken earlier on an application for a sign
variance and stated that the Ordinance definitely ruled out
billboards. No further action was taken.
FIRE DEPARTMENT: The Mayor instructed the Administrator to
find out the reason for the Chanhassen Fire Department not
participating in the water fight at Assumption Seminary Festival
and submit to the Council a full report. The Administrator also
to write a letter to the Seminary to apologize for the Fire
Department not participating in this event.
POLICING: A Resolution should be submitted to the Council at
the next meeting relating to County Wide Policing, to be paid
for by a general County mile rate.
ASSESSING: A Resolution will be submitted to the Council at the
next meeting to be given to the County Commissioner requesting
County Wide Assessing.
COMMISSIONER LYMAN: stated that he felt that County Wide
Assessing will become a reality before
County Wide Policing.
PLANNING COMMISSION: Mayor Coulter stated that he had requested
Ward Passe to be present as a proßþective member for the Planning
Commission.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to appoint Ward Passe to the Planning commission until
December 30, 1970. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz and Pearson. No
negative votes. Motion carried.
MAYOR COULTER: Mayor Coulter instructed the Planning Commission
to submit to the Council within 6 weeks, a recommendation on
modular and mobile home construction and how it would relate to
the proposed Zoning Ordinance.

COUNCIL APPOINTMENT: The Mayor stated that a Mr. Herb DeVaan
would be interested in serving on the Council.

A motion was made by Councilman Pearson and seconded by
Councilman Klingelhutz to table any action on the Council
appointment until June 29, 1970. Councilmen Bennyhoff,
Klingelhutz and Pearson voted yes. Mayor Coulter voted no.
Motion carried.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Pearson to adjourn. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and
Pearson. No negative votes. Motion carried.
