CHANHASSEN VILLAGE COUNCIL MINUTES - July 13, 1970
The special Chanhassen Village Council meeting on July 13, 1970,
at 8:00 p.m., was opened with the Pledge to the Flag. The
following members were present: Mayor Coulter, Councilmen
Bennyhoff, Neils and Pearson. Councilman Klingelhutz was absent.
COUNCIL MINUTES: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils to approve the June 29, 1970,
Board of Review and Council minutes and the July 8, 1970,
Board of Review and Council minutes with the following amendment
to the July 8, 1970, Board of Review minutes:
MR. HUSKINS: Mr. Huskins was present to request a change
in the valuation that was placed on his property by the
Village Assessor.
A motion was made by Mayor Coulter to set Mr. Huskins valuatîon
at $42,500.00. Motion died for a lack of a second.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Pearson that Mr. Huskin's market value be set at
$44,000.00. The following voted in favor thereof: Councilmen
Klingelhutz, Neils and Pearson. Mayor Coulter voted no. Motion
carried.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Neils and Pearson. No negative votes. Motion carrîed.
PARK AND RECREATION MINUTES: A motion was made by Councilman
Bennyhoff and seconded by Councilman Pearson that the June 30, 1970,
and the July 7, 1970, Park and Recreation Commission minutes
be noted and read. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No
negative votes. Motion carried.
COUNCIL MEETINGS: A motion was made by Councilman Neils and
seconded by Councilman Pearson that until further notice, all
Council Meetings will start at 7:00 p.m. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils
and Pearson. No negative votes. Motion carried.
A motion was made by Councilman Neils and seconded by Councilman
Pearson to change the regular meeting night of July 20, 1970, to
July 21, 1970. The following voted in favor thereof: Mayor
Coulter, Councilmen Bannyhoff, Neils and Pearson. No negative
voteè. Motion carried.
ZONING: Mr. Roy Farr was present to explain his problem with
relationship to the complaint that had been placed with the
Administrator concerning his sale of used furniture and miscellaneous
items on his property with is zoned Farm Residential.

Mr. Farr stated that he could present, to the Council, written
statements from his neighbors concerning this problem. A
written statement on the complaint is to be forwarded to all
Council members.

A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to table any action on this problem until more
information has been gathered. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson.
No negative votes. Motion carried.
COMMISSION APPOINTMENTS: A motion was made by Councilman Neils
and seconded by Councilman Bennyhoff that when a vacancy occurs
on any of the Commissions, the members of the Commission shall
seek out, interview and recommend to the Council, the names of
one or more qualified applicants within 30 days of said vacancy.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Neils and Pearson. No negative votes. Motion carried.
A motion was made by Mayor Coulter and seconded by Councilman
Bennyhoff to add to the Personal Data Sheet questions of the
position desired.· What the applicants qualifications are for
the desired position and what his reasons are for applying?
Also, a section for the Commission to list its opinion of the
applicant. The complete date sheet to be submitted to the I
Council with any recommendations. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson.
No negative votes. Motion carried.
PARK AND RECREATION COMMISSION: A motion was made by Councilman
Bennyhoff and seconded by Councilman Pearson to authorize the
Village Surveyor to proceed with surveying the Welter Property.
The cost to be charged against Park Bond Issue Moneys. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Neils and Pearson. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson to authorize the Park and Recreation Commission to
interview appraisers for the appraisal work to be done on the
Welter Property and submit their recommendation to the Council
for final approval. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No
negative votes. Motion carried.
FISCAL CONSULTANT: A motion was made by Mayor Coulter and seconded
by Councilman Neils to appoint the firm of Ehlers and Associates,
of which Mr. Ehlers will be the liaison member, as the Village
Fiscal Consultant. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No
negative votes. Motion carried.
AUDIT: Mr. Hoffman gave a report and answered miscellaneous
questions.

PARK AND R~CREATION: A motion was made by Councilman Pearson
and seconded by Councilman Bennyhoff to approve the plans and
specifications for grading the Village Hall site, Well Site #2
and the Carver Beach site #l and approve the advertising for
bids. The following voted in favor thereof: Mayor Coulter!
Councilmen Bennyhoff, Neils and Pearson. No negative votes.
Motion carried.
PROJECTS 70-2 AND 70-3: A motion was made by Councilman Pearson
and seconded by Councilman Bennyhoff to approve the plans and
specifications for Projects 70-2 and 70-3 and to authorize the
Administrator to advertise for bids. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff! Neils and
Pearson. No negative votes. Motion carried.
STORM SEWER: The Village Engineer presented a status report and
a total project cost for 68-lB and requested some direction from
the Council for making up a preliminary assessment role.
A motion was made by Councilman Pearson and seconded by Councilman
Neils to defer any action on setting storm sewer policy until the
next meeting. The following voted in favor thereof: Mayor Coulter!
Councilmen Bennyhoff, Neils and Pearson. No negative votes.
Motion carried.
FIRE DEPARTMENT: A motion was made by Councilman Pearson and
seconded by Councilman Bennyhoff to approve the payment to
Waconia Motors of $5,373.00, for the Fire Department tanker
chasis to be taken from the Bond Issue Moneys. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils
and Pearson. No negative votes. Motion carried.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to defer any action, at this time, on the specifications
and advertising for bids for the l500 gallon tanker. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Neils and Pearson. No negative votes. Motion carried.
ZONING ORDINANCE: Councilman Pearson presented and explained some
of the facts with regard to the sound level regulations that are
in the proposed I-I District and the planned Industrial District
of the proposed Zoning Ordinance. No definite action was taken
at this time.
POLICING: A motion was made by Councilman Pearson and seconded
by Councilman Bennyhoff to adopt Resolution #7l370-l, entitled:
RESOLUTION IN SUPPORT OF COUNTY-WIDE POLICING.

WHEREAS, certain municipalities, at their expense, including
the Village of Chanhassen, have contracted for the furnishing by
Carver County of policing services within said municipalities
through the office of the County Sheriff; and

WHEREAS, in addition to the contract cost for said policing I
services, and municipalities are subjected to the county-wide
tax levy needed to meet the expense of the County Sheriff's
Department for county police services, and with the consequence
that said municipalities bear a disproportionate share of the cost
of said county police services, and
WHEREAS, it is the opinion of the Council of the Village of
Chanhassen that county-wide policing of the entire Carver County
area, including its cities and villages, would provide economical
and efficient law enforcement in the county with a more equitable
distribution of the cost thereof; and
WHEREAS, it is the opinion of this Council that a fair and
reasonable method for the sharing of the cost of county-wide
policing should be on the basis of assessed valuation.
NOW, THEREFORE, BE IT RESOLVED, that the Council of the Village
of Chanhassen recommends to the Board of Commissioners of Carver
County that said Board establish county-wide policing of the entire
county area, including its cities and villages, and that the cost
thereof be shared on the basis of assessed valuation.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Neils and Pearson. No negative votes. Motion I
carried.
ASSESSING: A motion was made by Councilman Bennyhoff and seconded
by Councilman Neils to adopt Resolution #7l370-2, entitled:
RESOLUTION IN SUPPORT OF COUNTY-WIDE ASSESSING.
WHEREAS, it is the opinion of the Council of the Village of
Chanhassen that the practice of assessment of property by local
assessors within the separate political subdivisions of Carver
County lends itself to inequality of assessment as between local
government untis with the consequence that the property tax burden
is neither uniformly nor equitably imposed throughout Carver
County, and
WHEREAS, the Carver County Board and the office of the County
Assessor are better able than local government units to assemble
the skilled and knowledgeable personnel required for the efficient,
accurate and equitable assessment of property, and
WHEREAS, any county is authorized and empowered by Chapter 989,
Laws of 1969, to provide for the exclusive assessment of all taxable
property in the county by the County Assessor.
NOW, THEREFORE, BE IT RESOLVED that the Council of the Village I
of Chanhassen recommends to the Board of Commissioners of Carver
County that said Board establish exclusive county-wide assessing
by the County Assessor of all taxable property in the county
pursuant to Chapter 989, Laws of 1969.

Bennyhoff, Neils and Pearson. No negative votes. Motion carried.
UTILITY DEPARTMENT: A motion was made by Councilman Pearson and
seconded by Councilman Bennyhoff that the Village Treasurer be
authorized to pay all accumulated overtime to Jerry Schlenk.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Neils and Pearson. No negative votes. Motion
carried.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No
negative votes. Motion carried.
