1970 07 21 r I I I ~ CHANHASSEN VILLAGE COUNCIL MINU~ES ~J~~~ 2¡J ¡970 The regular Chanhassen Village Council meeting on July 21, 1970, at 7:00 p.m. was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Neils and Pearson. Councilmen Bennyhoff and K1ingelhutz were absent. COUNCIL MINUTES: A motion was made by Councilman Pearson and seconded by Councilman Neils to approve the Council minutes of July 13, 1970. The following voted in favor thereof: Mayor Coulter, Councilmen Neils and Pearson. No negative votes. Motion carried. . . PLANNING COMMISSION MINUTES: A motion was made by Councilman Pearson and seconded by Councilman Neils that the July 14, 1970, Planning Commission minutes be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Neils and Pearson. No negative votes. Motion carried. Councilman Bennyhoff arrived. PARK AND RECREATION: The Village Attorney explained what progress had been made to date, on the Lawcon Application. A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff to authorize the Mayor and the Clerk to execute such documents, as may be necessary to facilitate and as may be required by the BOR and the State Planning Agency for the application for Lawcon Funds. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried. The Village Attorney explained the Trust Agreement that is being drawn up on the Welter Property. JURGEN JOHNSON - CARVER BEACH ROAD: The Johnson's request was, that the Village maintain the road in front of their property. The Council Committee on Maintenance is to meet with the Maintenance Superintendent and the Administrator, on the site, and submit a report to the Council at the next meeting. BILLS: A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to approve payment of all bills as submitted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried. . UTILITY DEPARTMENT: A motion was made by Councilman Pearson and seconded by Councilman Neils to authorize the Treasurer to transfer all water meter funds from the Sinking Fund to the Utility Fund. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried. ~ CHANHASSEN VILLAGE COUNCIL MINUTES - July 21, 1970 -2- S~NNEN PROPERTY: A motion was made by Councilman Pearson and I seconded by Councilman Bennyhoff to grant a Variance in Ordinance #33, under Section 13 - 13.02 so that the following property can be filed and recorded with the Register of Deeds by metes and bounds: That part of the West Half of the Northeast Quarter of Section 13, Township 116 North, Range 23 West of the 5th Principal Meridian described as follows: Commencing at the northwest corner of said West Half of the Northeast Quarter; thence south, along the west line of said West Half of the Northeast Quarter, a distance of 1272.70 feet to the point of beginning of the land to be described; thence east, at right angles to said west line, a distance of 656.00 feet; thence south, at a right angle, a distance of 150.00 feet; thence west, at a right angle, a distance of 656.00 feet to the West line of said West Half of the Northeast Quarter; thence north, at a right angle, along said west line, a distance of 150.00 feet to the point of beginning. EXCEPT that part of the following described 75 foot strip of land which lies within the above described tract. The westerly line of said 75 foot strip is described as follows: From a point on the east line of Section 12, Township I 116 North, Range 23 West, distant 8.2 feet north of the southeast corner thereof, run westerly at an angle of 88 degrees, 31 minutes and 12 seconds with said east section line (measured from north to west) for 673.14 feet; thence deflect to the left at an angle of 32 degrees, 21 minutes and 15 seconds for 2310.21 feet to the point of beginning of the line to be described; thence deflect to the left at an angle of 57 degrees and 04 minutes for 298.3 feet and there terminating. FENSTERMAKER: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to grant a one year extension of the Conditional Use Permit to W. T. Fenstermaker, as originally approved, for a fee of $35.00. All original requirements are to be continued. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried. STORM SEWER POLICY: A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff that the general Storm Sewer Policy be as follows: That areas to be assessed in a Storm Sewer Project would be at the following ratios: one for residential, two for multiple and schools and 3 for commercial. Streets are not to be included in the total square footage. CIGARETTE LICENSE: A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to approve a Cigarette License for the last six months of 1970 for Chalet Pizza. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried. SCHOOLS: A motion was made by Councilman Pearson and seconded by Councilman Neils to authorize the Administrator and the Chairman of the Park and Recreation Commission to attend the July 31, 1970, meeting on grant programs. Registration in the amount of $6.00 each, plus mileage. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried. STREETS: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils that upon receipt of a letter requesting a street improvement under Ordinance 1-J for Hummingbird Road. The Maintenance Department is authorized to proceed with seal coating. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried. O.E.O.: A motion was made by Mayor Coulter and seconded by Councilman Pearson to approve the O.E.O. placement of one person with the Village of Chanhassen. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried. BI-ANNUAL ELECTIONS: The Village Attorney explained, to the Council, some of the ramifications of having Bi-Annua1 Elections under Minnesota Statute 412.022. A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to authorize the Village Attorney to draft up an Ordinance on Bi-Annual Elections to be submitted at next meeting. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion carried.
