1970 08 17 r I I I ~ CHANHASSEN VILLAGE COUNCIL MINUTES - August 17, 1970 The regular Chanhassen Village Council meeting on August 17, 1970, at 7:00 p.m. was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Neils and Klingelhutz. Councilman Pearson arrived after the minutes were approved. COUNCIL MINUTES: A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to approve the Council Minutes of August 3, 1970. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Neils. Councilman Klingelhutz abstained from voting as he was not present at the August 3, 1970, meeting. Motion carried. PARK AND RECREATION MINUTES: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff that the July 21, 1970 and the August 4, 1970, Park and Recreation Commission minutes be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Neils. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils that the August 11, 1970, Planning Commission minutes be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Neils. No negative votes. Motion carried. Councilman Pearson arrived. BILLS: A motion was made þy Councilman Pearson and seconded by Councilman Klingelhutz to authorize the payment for Project 70-3 to be taken from the $90,000.00 bond proceeds for utility Improve- ments. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Neils and Pearson. No negative votes. Motion carried. A,!motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to approve payment of all bills as submitted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils, Klingelhutz and Pearson. No negative votes. Motion carried. KERBER (MOLINE PROPERTY): A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to authorize the Mayor and the Clerk to sign the agreement as submitted by the Village Attorney with the following amendment: 3. Petitioners agree that the Village may prohibit the issuance of building permits for construction on the foregoing tract of land for uses other than those permitted under Exhibit A, proposed P-l, PLANNED RESIDENTIAL DEVELOPMENT, hereto attached and incorporated herein. 1 " CHANHASSEN VILLAGE COUNCIL MINU~ES - August ~7, 1970 -2- The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. I MOLINE ADDITION: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to give final acceptance to 65th street, in the Moline Addition, and release the bond that the Village is holding. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. BIENNNIAL ELECTIONS: A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff to adopt an Ordinance calling for Biennial Election ,system with the first Biennial Election following in 1972. The following voted in favor thereof: Mayor Coulter, Councilman Bennyhoff, Klingelhutz and Pearson. Councilman Neils voted no. Motion carried. STODOLA: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to approve tha rezoning agreement as submitted by the Village Attorney with the following amendment: 2. Petitioners agree that the Village may prohibit the issuance of building permits for construction on the foregoing tract of land for uses other than those permitted under Exhibit A, proposed R-4, MULTIPLE RESIDENCE DISTRICT, hereto attached and incorporated herein. I The following voted in favor thereof: Mayor Coulter, Councilman Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. MAINTENANCE DEPART~ENT: It was explained to the Council how some pieces of .equipment can be purchased under what is considered "Total Costll bidding. The Maintenance Superintendent requested that the Council purchase a loader. A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to authorize the Administrator to draft up specifications and advertise for bids for a loader. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. SEAL COATING: A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to set the date for the Public Hearing on seal coating for August 31, 1970, at 7:00 p.m. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. A motion was made by Councilman Klingelhutz and seconded by Mayor Coulter that the Public Hearing be set for September 28, 1970, at 7:00 p.m. on the proposed adoption of amendments to sections 4 and 6 of Ordinance #29. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. LAWCON: The Village Attorney brought the Council up to date on our Lawcon Application. A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to adjourn.
