1970 08 24 ~ I I I l~ PUBLIC HEARING - (ASSESSMENT) ~ PROJECT 69~2 - SEWER AND WATER EXTENSION - 7:00 p.m. The Chanhassen Village Council met on August 24, 1970, for the above special meeting. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. The Clerk-Administrator read the published notice of the hearing. There were no persons present objecting to the proposed assessment. A motion was made by Councilman Neils and seconded by Councilman Klingelhutz to adjourn the Public Hearing at 7:15 p.m. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. The Clerk-Administrator read the published notice of the hearing. The Village Engineer explained how the proposed assessment roll was made up. MR. WARD filed the following written objection: Notice of Objection to Proposed Assessment on Sewer No. 68-3 TO THE VILLAGE COUNCIL -OF THE VILLAGE OF CHANHASSEN, MINNESOTA AND TO ADOLPH TESSNESS, VILLAGE CLERK: YOU WILL PLEASE TAKE NOTICE that the undersigned Martin J. Ward residing in Section 13 in the Village of Chanhassen does hereby object to the proposed assessment on land owned by him in said Section 13 for said Sewer No. 68-3 and files this objec- tion to said proposed assessment and to the proposed hearing thereon now set for Monday, August 24# 1970, at 7:15 p.m. pur suant to Order of the Village Council dated August 3, 1970. That the rate of taxation for said proposed assessment is not uniform among the several landowners and taxpayers claimed to be liable for said assessment. I 2. That the rate of taxation for said proposed assessment is arbitrary, capricious, unequal and inequitable, and favors one taxpayer over others of similar status and position. Ward Box 213 Chanhassen, Minnesota This written notice was filed with the Village Clerk on August 21, 1970, at 5:00 p.m. Copies of said objection were delivered, by the Police Department, to the Council, the week- end of August 21, 1970. MAYOR COULTER brought up the fact that the Lazy C property has already been assessed for sewer. FRANKLIN KURVERS stated that his lot survey stakes have not been replaced and should be before this project is completed. I DANIEL KLINGELHUTZ stated that he had given an easement, at no cost, and was being charged an assessment. He asked if this was normal. Answer: This is normal and the easement on the Daniel Klingelhutz property was only a temporary easement for initial construction. SUSAN KLINGELHUTZ (Daniel Klingelhutz spoke in her behalf) : He stated that the ditch area abutting the east property line of Susan Klingelhutz was not restored to its natural state. A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to continue this Public Hearing until September 15, 1970, at 7:00 p.m. and any objections by persons to be assessed to be written and filed with the Village Clerk no later than September 4, 1970, at 4:30 p.m. The following voted in favor thereof: Mayor Coulte4 Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. The Chanhassen Village Council met on August 24, 1970, for the above special meeting. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. The following persons were present concerning the Public Hearing: Ron Mielke, Albin H.Olson, Clara Johnson, Helen Johnson, Larry Heuer, Tom Lentz, Hubert T. Forcier, Francis Bjornson, Bob Phillips, Tom Klingelhutz and Doug Hanson. The Clerk-Administrator read the published notice of the hearing. The Village Engineer explained the proposed assessment roll. It was decided to dispense with all formalities. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhuts, Neils and Pearson. CHANHASSEN VILLAGE COUNC¡L M~NU~ES ~ ~ugußt, 24, 1970 ~4~ BANDIMERE HEIGHTS 2ND ADDITION: A motion was made by Councilman Klingelhutz and seconded by Councilman Pearson to authorize the Mayor and the Clerk to sign the development contract and final plat upon receipt of a bond in the amount of $2500.00. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. DON STODOLA: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to authorize the Mayor and the Clerk to sign the rezoning agreement on the Stodola property upon receipt of said agreement from the petitioners. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. ZONING ORDINANCE: There was a general discussion on when the Village Attorney would have the final draft of the proposed Zoning Ordinance. No exact date was set. However, the Council stressed that it should be finalized as soon as possible. WELTER OPTION: A motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to authorize the Mayor and the Clerk to execute such documents, as in the opinion of the Village Attorney, shall be required to execute the Welter Option for the purchase of park lands. The Village Treasurer shall have available $186,500.00 in nego~able funds for the trust agreement on September 1, 1970. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried.
