~UBLIC HEARING ~ (ASSESSMENT) ~ SEAL COATING - 7:00 p.m.
·The Chanhassen Village Council met on August 31, 1970, for the
above special meeting. The following members were present:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson.
The following persons, affected by the assessment, were present:
Norman Remus, Lawrence Klein, James E. Mielke, Walter Griepentrog,
Russell L. Frederick, R. Eide and G. Neft.
The Clerk-Administrator read the published notice of the hearing.
The Maintenance Council Committee explained the overall cost and
how the proposed assessment roll was determined.
CHARLES NEFT,stated that he did not object to the gravel
and dust, as it was there when be bought his property. He
felt that the request for seal coating was made by only a
few. He also stated that since this road hqs been improved,
the speed of the cars had increased because of the road
being improved.
LAWRENCE KLEIN felt that the Lake View Hills people were
benefiting more than he, as a ·farmer, benefits.
NORMAN REMUS stated that he felt that a stop sign should
be placed at the exit from Lake View Hills onto Lake
Riley Blvd. Also that cars are parked on boths sides of
the road near his home, almost blocking passage and creating
a traffic hazard. Also that there should be a sign placed
at the edge of his property indiā¬ating a culvert opening.
JAMES MIELKE stated that he was satisfied with the seal
coating costs and his concern was that the traffic speed
had increased on the Lake Lucy Road since the improvement
and he felt that more speed limit signs should be installed.
RICHARD EIDEstated that he felt that most of the problem
had arisen from the Lake View Hills Apartments (165 units)
traffic. He feels that the residents who live on this
road are paying an unfair share of the cost of this
seal coating.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to continue this Public Hearing until September 15, 1970,
at 8:ÓO p.m. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative
votes. Motion carried.

The special Chanhassen Village Council meeting was held on
August 31, 1970 at 7:55 p.m., in the Village Hall. It was
decided to dispense with all formalities. The following
members were present: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Pearson.

JONOTHAN SIGN VARIANCE REQUEST: Julius Smith presented the
application for a sign variance request as had been presented
to the Planning Commission August 25, 1970. The Administrator
read the minutes of the Planning Commission meeting in regard
to the Jonothan application.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Klingelhutz to approve the sign variance as recommended
by the Planning Commission August 25, 1970. Councilman Bennyhoff
voted yes. The following voted no: Mayor Coulter, Councilmen
Klingelhutz, Neils and Pearson. Motion defeated.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to approve the alternate sign requested by Jonothan
and depicted in photograph entitled Exhibit A. The size and
dimensions depicted on a drawing dated May 18, 1970, entitled
sign #2. This sign will have no illumination or reflecting I
paint. The top panamon the sides will have one word
"Jonothan", the lower side panaJs will have the Jonothan logo
and the end panals will be decorative with no text. There will
be a time limit of 5 years.and the overall height of 28 feet
from the existing ground level. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz, Neils and
Pearson. Councilman Bennyhoff voted no. Motion carried.
LUTHERAN CHURCH (CHURCH OF THE LIVING CHRIST): There was a
general discussion on the church plans and specifications. The
main problem, at this time, is that the church does not have
a permanent easement to Highway #5.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Neils to approve and grant a building permit as soon
as the permanent roadway easement has been resolved. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
STATE BANK OF CHANHASSEN VARIANCE REQUEST: The Mayor turned
the meeting over to Acting Mayor Klingelhutz, as he is a
Director of the bank.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Neils to approve the variance requested with the
following conditions:

1. Access of Tract B to County Road 16 be limited to the
southeast corner of Tract B.
2. The Schneider Agency, Inc., agrees that the remainder of
Tract A be platted in accordance with the subdivision
ordinance prior to any further subdivision of Tract A,
and that the Bank include Tract B in any such plat.
3. A utility easement be reserved along the east line of
Tract B and that all utilities be placed underground.
4. Entrance or driveway from Tract B to County Road 16
shall be hard surfaced.

All that part of the East 990 feet of the Southwest Quarter of the
Southwest Quarter of Section 12, Township 116, Range 23, Carver
County, Minnesota, lying Southerly of the North 864.98 feet
thereof, excepting therefrom the East 433 feet thereof.
TRACT B
Commencing at a point 433.06 feet West of the Southeast corner
of the Southwest Quarter of the Southwest Quarter of Section 12,
Township 116, Range 23, Carver County, thence Westerly 140.0 feet,
thence Northerly at right angles 278.20 feet, thence Easterly at
right angles 140.00 feet, thence Southerly at right angles 278.20
feet, to the point of beginning, containing nine-tenths of an
acre, more or less, according to the map or plat thereof on file
in the office of the Register of Deeds in and for said County and
State.
Subject to existing roads and highways.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Pearson to approve the building permit for the state
Bank of Chanhassen as submitted, providing all plans meet the
specifications of the Building Code. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils
and Pearson. No negative votes. Motion carried.
Acting Mayor Klingelhutz turned the meeting over the the Mayor.
PLANNING COMMISSION: The Council asked miscellaneous questions
of James Mielke, the applicant recommended by the Planning
Commission.

A motion was made by Councilman Neils and seconded by Councilman I
Bennyhoff to accept the recommendation of the Planning Commission
and appoint James Mielke to the Planning Commission, his term
to expire December 31, 1970. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No negative votes. Motion carried.
FIRE DEPARTMENT: A motion was made by Councilman Pearson and
seconded by Councilman Bennyhoff to authorize the Village
Administrator to advertise for bids on the Fire Department tanker.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson to authorize the Administrator to receive bids on
miscellaneous items that are in the 1970 Fire Department Budget
under New Equipment. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson. No negative votes. Motion carried.
PARK AND RECREATION (WELTER OPTION): The Village Attorney
explained the status of the Trust Agreement. He also presented
the Trust Service Quotation from First National Bank of I
Minneapolis and Northwestern National Bank of Minneapolis.

A motion was made by Councilman Klingelhutz and seconded by
Councilman Bennyhoff to designate the First National Bank of
Minneapolis as Trustees on the Trust Fund for the Welter Property.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
PROJECT 67-4 (SUNRISE HILLS SEWER AND WATER EXTENSION): There
was a general discussion on the final costs presented on the
67-4 project.

A motion was made by Councilman Neils and seconded by Councilman
Klingelhutz to set the date for the reassessment Public Hearing
for September 28, 1970, at 7:00 p.m.

Motion carried.
PROJECTS: The Mayor stated that there would be a Special Council
Meeting on September 3, 1970, at 7:30 p.m., to discuss only
the projects that are being completed and are being presented
for the assessment rolls.
WESTERN HILLS: The Administrator read a letter from Hansen &
Klingelhutz stating that the road in Western Hills 1st Addition
are completed as of August 14, 1970, in accordance with Village
standards and they are requesting acceptance of the roads as
of that date.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to accept the roads in Western Hills 1st Addition
as of August 14, 1970, and that the Performance Bond would be
held by the Village for one year from the date of acceptance.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
ARBORETUM DRIVE: The Village Administrator read a letter from
the University of Minnesota Landscape Arboretum requesting that
Arboretum Drive be vacated.
A motion was made by Councilman Neils and seconded by Councilman
Klingelhutz to set the date for the Public Hearing for vacation
of Arboretum Drive as soon as possible. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No negative votes. Motion carried.
A motion was made by Councilman Neils and seconded by Councilman
Bennyhoff to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson. No negative votes. Motion carried.
