I I I ~ CHANHASSEN V¡LLAGE COUNC¡L M¡NU~E~ ~ pe~~~mÞ~~ 2~, ~970 The regular Chanhassen Village Council meeting on September 21, 1970, at 7:00 p.m. was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Neils, K1inge1hutz and Pearson. COUNCIL MINUTES: A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff to approve the Council Minutes of August 17, 1970, August 24, 1970 and August 31, 1970. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Pearson. No negative votes. Motion carried. PARK AND RECREATION MINUTES: A motion was made by Councilman Pearson and seconded by Councilman K1inge1hutz that the August 18, 1970, August 25, 1970, and September 8, 1970, Park and Recreation Commission minutes be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Pearson. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman K1inge1hutz ãnd seconded by Councilman Pearson that the Planning Commission minutes of August 25, 1970, be approved with an amendment changing the State Bank property size to read 202 x 140. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Pearson. No negative votes. Motion carried. LOADER: The Village Administrator informed the Council that the bids were opened at 2:00 on September 21, 1970, and the Village received only one bid from Ziegler, Inc. as follows. 1. Net Bid (Purchaser pays this amount) $20,573.00 2. Maintenance expense for 5 years or 7,000 hours, whichever occurs first, shall not exceed 1,250.00 3. Guaranteed "Minimum repurchase in 5 years or 7,000 hours, whichever occurs first, covered by performance bond for amount of bid figure for this time 11,650.00 4. Total Cost Bid (Item #1 plus Item #2, Minus Item #3 10,173.00 A motion was made by Councilman Klinge1hutz and seconded by Councilman Bennyhoff to have the Village Attorney review the bid and submit an opinion at the next meeting. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Pearson. No negative votes. Motion carried. VARIANCE - SIGN ORDINANCE #36 (HANSON & KLINGELHUTZ): A motion was made by Councilman K1inge1hutz and seconded by Councilman Bennyhoff to grant the variance requested by Hanson & K1ingelhutz for an area identification sign. The sign to be located on the Chanhassen Mileage property identifying Western Hills. ~ 1 I I CHANHASSEN VILLAGE COUNCIL MINUTES - September 21, 1970 -2- The sign to be a two sided sign not to exceed 100 square feet per side. The variance required of placing it on other than the area it is identifying is granted due to the following extenuating circumstances: I 1. The area identified is located some distance from any throughway carring traffic. 2. The area is considered beneficial to the development of Chanhassen. 3. The sign as presented will take the place of the necessity of a directional sign and any temporary real estate signs. 4. This sign to be used in lieu of an Area Identification Sign located on the premises. 5. The variance to be granted is for a period not to exceed two years. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Pearson. No negative votes. Motion carried. ELECTION JUDGES: A motion was made by Councilman K1ingelhutz and seconded by Councilman Pearson to pay the Election Judges $1.50 per hour for the 1969 - 70 elections. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. I BILLS: A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to approve payment of the bills with the exception of the bill for assessing which should be deferred at this time a~d excluding the Western Hills bills. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. WESTERN HILLS: A motion was made by Councilman Bennyhoff anq seconded by Councilman Neils to approve the release of funds from the escrow account at follows: 1. $4,220.31 to Northern Contracting 2. $19,536.65 to Anderson Excavating 3. $670.00 to Mills Engineering The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz, Neils and Pearson. No negative votes. Motion carried. TRAFFIC SIGNS: A motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to approve Exhibit A, dated September 21, 1970, regarding the placement of traffic signs on Lake Lucy Road, Lyman Boulevard and Lake Riley Boulevard. I I I ~ CHANHASSEN VILLAGE COUNCIL MINUTES - September 21, 1970 -3- TRAFFIC SIGNS (cont): The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. EXPLOSIVE ORDINANCE: The Council discussed the proposed Explosive Ordinance as submitted by the Village Attorney. A motion was made by Mayor Coulter and seconded by Councilman Bennyhoff to defer any action until a later date. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz and Pearson. Councilman Neils voted no. Motion carried. FIRE DEPARTMENT: Howard Meuwissen gave the monthly report and informed the Council that there were three calls in the month of August. One was the ready mix truck which overturned and the Fire Department was called to flush out the mixer. One was a rescue call. One was a car fire on Hwy 41 and 5. A motion was made by Councilman Neils and seconded by Pearson to bill Western Concrete, $50.00 for the Fire being called. The following voted in favor thereof: Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and No negative votes. Motion carried. Councilman Department Mayor Pearson. Howard Meuwissen also informed the Council that six men will be going to Fire Training School. MAINTENANCE DEPARTMENT: General discussion on read maintenance problems by the Maintenance Superintendent and the Council. The Maintenance Superintendent requested that the Council approve installing indoor plumbing in the Maintenance Building. No action was taken at this time. HENNEPIN COUNTY HIGHWAYS: The Mayor gave a brief report on the meeting he attended on September 17, 1970, stating that no basic action was taken. LAKE VIEW HILLS: The Administrator informed the Council of his meeting with the Metro Sewer Board. He stated that the Metro Sewer Board would take over the Maintenance of the sewer plant under our existing contract. Final agreement will be presented at a later date. BIENNIAL ELECTION: Councilman Pearson wanted the Minutes to reflect that he was concerned about extending the Councilmen's term from three to four years, feeling that it is too long a term. INTERSECTION HWYS 5 & 101: The Council instructed the 'Administrator to draw up a Resolution to present at the next meeting, requesting action by Senator Metcalf and Representative Jopp to obtain street lights and a flasher at this intersection as was agreed by the State Highway Department a year ago. POLICE DEPARTMENT: Patrolman Allen Wallin gave the monthly I Police report and discussed the new reports that were presented for the months of April thru August. A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to-adjourn. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz, Neils and Pearson.
