1970 10 05 r I I I I l !I, 1-- l CHANHASSEN VILLAGE COUNCIL MINUTES - October 5, 1970 The regular Chanhassen Village Council meeting on October 5, 1970, at 7:00 p.m. was opened with the Pledge to the Flag. The. following members were present. Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. COUNCIL MINUTES: A motion was made by Councilman Klingelhutz and seconded by Councilman Neils to approve the Council Minutes of September 21, 1970 and September 28, 1970. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Bennyhoff that the Planning Commission minutes of September 22, 1970, be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. TRAILER HOUSE (VARIANCE REQUEST): There was a report by Anne Neils, Chairman of the Board of Adjustments and Appeals. The recommendation of the Board of Adjustments and Appeals is to deny the request for a building permit and to enforce Township Ordinance #1, Section 8~2 invoking a $300.00 a day penalty to be enforced starting October 2, 1970. The reasons are: 1. The size of the lot is not suitable for two dwellings. 2. The trailer was moved into the Village in flagrant violation of the Ordinance. 3. The plans for enclosing the trailer cannot meet the building code. 4. There is no water or sewer. 5. This is not a hardship case. 6. The owners request to let the trailer remain on the property until sold should not be considered. The Board of Adjustments and Appeals does not recommend granting a variance. The Administrator read a letter from Mrs. Seward. FRAN B. SEWARD: Explained the ramifications of why her trailer house was moved to Chanhassen without receiving prior approval. MR. THOMPSON: In the thre(~ years we have lived here, the small existing structure on Mrs. Seward's property has not been lived in on a permanent basis. MR. WRIGHT (Spoke in Mrs. Seward'ssbehalf)and requested that the Council grant a reasonable amount of time to remove the trailer house from the property. The Administrator stated that Mrs. Seward had been in on Thursday, September 24, 1970, and had been told that she could not move the trailer into the Village as it would be in violation of the Ordinance. However, the trailer house was moved in the same day. A motion was made by Councilman Neils to deny the request fora building permit and variance and to enforce Township Ordinance #1, Section 8-2 which invokes a $300.00 a day penalty. Penalty to start October 2, 1970. The owners request to let the trailer remain on the property until sold should not be considered. Reasons are: 1. The Mayor asked Mr. ~mpson what he thought of the trailer house I as a neighboring property owner. Mr. Thompson said he would like to have the trailer house removed as soon as possible. Mrs. Thompson stated that she thought 30 days would be reasonable. A motion was made by Mayor Coulter and seconded by Councilman Bennyhoff to allow the trailer house to be on the property no longer than 12:00 a.m., November 5, 1970, and cannot be used for a residence or as an office. If it is not removed by 12:00 a.m. November 5, 1970, the fine of $300.00 per day, as per the Ordinance, will be invoked. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Pearson. Councilman Neils voted no. Motion carried. WELTER PROPERTY: The Village Attorney ~xp1ained the status of purchasing the Welter Property. YOUTH ADVISORY COMMITTEE REPORT: Jim Lord reported, to the Council, that the Committee had not made any progress and did not have any recommendations to make. BUDGET: There was a general discussion on the Budget. The final Budget will be set at the October 12, 1970, meeting. A motion was made by Councilman BEnnyhoff and seconded by Council- man Neils to adjourn.
