1970 10 19 ~ I I I CHANHASSEN VILLAGE COUNCIL MINUTES - October 19, 1970 The regular Chanhassen Village Council meeting on October 19, 1970, at 7:00 p.m. was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. COUNCIL MINUTES: A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff to approve the Council Minutes of October 5, 1970. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motio~ carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Pearson and seconded by Councilman Neils that the Planning Commission minutes of October 13, 1970, be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. PARK AND RECREATION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson that the Park and Recreation Commission Minutes of October 6, 1970, be noted and read, noting that they should read as follows: WELTER PROPERTY: There was a report on the meeting with Russell Larson, Al Klingelhutz, Steve Wolf and the Welter family. Judge Ludloff granted the Welter family (guardians) permission to sell the property to the Village of Chanhassen. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. KNOLLWAY ESTATES: The Council referred to theP1anning Commission Minutes of September 22, 1970. General discussion on the preliminary sketch plan. A motion was made by Councilman Bennyhoff and seconded by Mayor Coulter to approve the sketch plan dated September 10, 1970, in general concept. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. POLICE: The monthly police report was presented to the Council. Officer Klein was present, requesting the Council consider lowering the curfew to 9:00 p.m. A motion was made by Mayor Coulter and seconded by Councilman Bennyhoff that one hour be set aside at the next meeting to discuss lowering the curfew and general teenage problems. The following voted in favor thereof: Mayor Coulter, Counc~lmen Bennyhoff, K1ingelhutz, Neils and Pearson. No negative votes. Motion carried. '., ~ CHANHASSEN VILLAGE COUNCIL MINUTES ~ October 19, 1970 -2- LAWCON: A motion was made by Councilman K1ingelhutz and seconded I by Councilman Neils to adopt Resolution #101970-2, entitled Park Development Project: WHEREAS, the Village of Chanhassen is in the procèss of acquiring 26.75 acres of land from the Estate of Anna Welter, Ward, for park purposes, and WHEREAS, said tract of land indludes two farm buildings of no value for park purposes: NOW, THEREFORE, BE IT RESOLVED that the farm buildings on the 26.75 acres of land to be acquired from the Estate of Anna Welter, Ward, have no value for park purposes and that the Village has no present contemplation of utilizing said structures in it park development program. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. The Administrator l gave a report to the Council with regard to the approval. The Administrator informed the Council that we had received a letter from the Bureau of Outdoor Recreation stàting that our application had been approved. I' Councilman Klingelhutz gave a report on the meeting with the owners of the Welter Property and stated that th~ final agreed price is $189,000.00. A motion was made by Councilman Klingelhutz and seconded by Councilman Pearson authorizing the Mayor and the Administrator to sign the Trust Agreement for the acquisition of the Welter Property at the negotiated acquisition price of $189,000.00. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. MAINTENANeE DEPARTMENT: The Council discussed the problem of storin~ sand and salt at the maintenance site. A motion was made by Councilman Neils and seconded by Councilman Klingelhutz to advertise for bids for a 40 x 60 pole barn to be placed on Highway 41. The following voted in favor thereoft Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. Mayor Coulter voted no. Motion carried. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. UTILITY DEPARTMENT: A motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to pay the storm sewer assessment for Project 68-lB for Lot 7, Block 1, Scholer's 2nd Addition, in the amount of $202.52, Qut of the Utility Department Operating Fund. The following votèd in favor~thereof: Mayor Coulter, Councilmen, Bennyhoff, Klingelhutz, Neils and Pearson. No negative vote~. Motion carried. FIRE DEPARTMENT: A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to approve the advertising for bids on theFire Department pumper. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klin~elhutz, Neils and Pearson. No negative votes. Motion carried. POLICE CONTRACT: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to approve the dollar amount in the proposed police contract. The following voted in favor thereof: Councilmen Bennyhoff, Neils and Pearson. Councilman Klingelhutz and Mayor Coulter voted no. Motioh carried. The Village Attorney is to check into the working of the agreement and repoit back to the Council at thè next meeting. WESTERN HILLS ESCROW ACCOUNT: Á motion was made by Councilman Pearson and seconded by M~yor Coulter to release the amount of money in the Escrow Account needed for the storm sewer assessment if Hanson & Klingelhutz can present a performance bond to cover the amount. The following voted in favor thereof: Mayør Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. A motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to release the balance of the Escrow Account with the exception of the amount required to pay the storm sewer assessment in full for Western Hills 1st Addition. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. ' ADMINISTRATION: A motion was made by Councilman Bennyhoff arid seconded by Councilman Neils to set Fran Clark's salary at $400.00 per month effective October 15, 1970. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. ENGINEERING: A motion was made by Councilman Klingelhutz and seconded by Councilman Neils that the Administrator and the Treasurer are to prepare a report on the Engineering costs in relation to all projects and report back to the Council. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. SHOOTING ORDINANCE: Mrs. Olson was present to request that the Council revise the Shooting Ordinance not allowing any shooting in the areas that were in the game refuge or at least not in the Greenwood Shores or Lake Lucy area. The Council informed her that they would consider her request. BUDGET: The proposed Budget was discussed. A motion was made by Hayor CCDulter and seconded by Councilman Klingelhutz that all employees be given an 8% raise for the year I 1971. A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to table the motion setting the salaries at 8% per employee for the year 1971. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. A motion was made by Councilman Klingelhutz and seconded by Councilman Pearson that program 4~43l, item #2 be set at $2,000.00. The following voted in favor thereof: Councilmen Klingelhutz and Pearson and Mayor Coulter. Councilmen Bennyhoff and Neils voted no. Motion carried. A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff that program 6-451, item #6 in the amount of $1,200.00 be deleted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. Park and Recreation: A motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to postpone the purchase of a truck for the maintenance of the skating rinks. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. A.motion was made by Councilman Pearson and seconded by Councilman NeL1s to remove from the table the following motion: Mayor Coulter moved and Councilman Klingelhutz seconded that all employees be given an 8% raise for the year 1971. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. . A motion waà made by Councilman Pearson and seconded by Councilman Neils to set the Administrator's salary at $10,800.00 for the year 1971 plus a $75.00 per month car allowance. The following voted in favor thèreof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. Councilman Bennyhoff made a motion and Councilman Neils seconded to set the salaries for all employees except the Administrator at an 8% increase over their 1970 salary, to the nearest dollar. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No, negative votès. Motion carried. A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff to adopt Resolution #101970-1 entitled Resolution Setting the 1971 Budget~ The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes. Motion carried. A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff to adjourn.
