CHANHASSEN VILLAGE COUNCIL MINUTES - October 26, 1970
The special Chanhassen Village Council meeting was held on
October 26, 1970, at 8:00 p.m., in the Chanhassen Village Hall.
The following members were present: MayoxCoulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson.
COUNCIL MINUTES: A motion was made by Councilman Klingelhutz and
seconded by Councilman Pearson to approve ~he Council Minutes
of October 19, 1970. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson. No negative votes. Motion carried.
PARK AND RECREATION MINUTES: A motion was made by Councilman
Pearson and seconded by Councilman Klingelhutz that the Park
and Recreation Commission Minutes of October 20, 1970, be noted
and read, noting that the Park and Recreation Commission clarify
page three, charges for the winter recreation program before
approval of this expenditures can be given. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No ne~ative votes. Motion carried.
CURFEW: Present for discussion were: Officer Klein, Mrs. Terry
Clark, Mrs. Harley Robinson, Mrs. Russell Lawrence, Mrs. Walter
Paulsen, James Mielke and Gordon Freeþurg.
The Mayor explained that the purpose for this meeting is that the
Village Council is considering lowering the curfew from 10~'0 p.m.
to 9:00 p.m.
MRS. ROBINSON: Asked if the curfew would be year round?
ANSWER: Councilman Pearson suggested a 9:00 Central
Standard Time.
RUSSELL LARSON: Stated that the last six weeks of Daylight
Savings Time it is dark at 9:00 p.m.
OFFICER KLEIN: Stated that the surrounding communities have
9:30 p.m. curfews.
GORDON FREEBURG: Stated that the Village should have a curfew
with teeth in it.
COUNCILMAN BENNYHOFF: Suggested that violators be taken down
to the Police Station and the parents be notified to come pick
them up.
The Village Attorney advised that picking up and taking them to
the Police Station would require a citation.

A motion was made by Mayor Coulter and seconded by Councilman
Bennyhoff to amend Ordinance #13, Section 1 to read as follows:
Section 1: It shall be unlawful for any person under the
age-of 16 years to be on or present in any public street,
avenue, alley, park or other public place in the Village
of Chanhassen between the hours of 9:30 P.M. and 5:00 A.M.
of the following day, offical Village time, unless
accompanied by his or her parent or guardian, or person
having lawful custody and control of his or her person or
unless there exists a reasonable necessity therefor. The
fact that said child, unaccompanied by parent, guardian,
or other person having legal ~ustody, is found upon any
street, alley or public place after 9:30 P.M. or before
5:00 A.M. of the following day, shall be prima facie
evidence that said child is there unlawfully and that no
reasonable excuse exists therefor.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, K1inge1hutz, Neils and Pearson. No negative votes.
Motion carried.
It was suggested that something be worked out so that an audible I
signal could be heard at 9:30 P.M., time of curfew.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to amend Ordinance #13, Section 2 to read as follows:
Section 2. It shall be unlawful for any minor of the ages
of 16 or 17 to loiter, loaf or idel on or about any public
street, avenue, alley, park or other public place in the
Village of Chanhassen between the hours of 11:30 P.M. and
5:00 A.M. of the following day, official Village time.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils, and Pearson. No negative votes.
Motion carried.
YOUTH SEMINAR: The Council held a discussion concerning the
youth of today in the Village of Chanhassen. It was decided that
the Council will hold a Youth Seminar on November 23, 1970, at
8:00 P.M. Mayor Coulter will see if the Chanhassen Elementary
School can be used.
There will be a panel discussion on youth problems and a question
and answer session will be held.

POLE BARN: The Village Attorney commented on the specifications
and the zoning of the land, stating that he had reservations as
to whether the land is zoned properly for a pole barn.
A motion was made by Councilman K1ingelhutz and seconded
Councilman Bennyhoff approving the specification for the
barn as submitted, adding the type and gauge of siding.

Motion
POLICE DEPARTMENT CONTRACT: A motion was made by Councilman
Bennyhoff and seconded by Councilman Neils to approve the
Carver County Police Contract with the Village of Chanhassen,
for 1971, as submitted. The "following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson. No negative votes. Motion carried.

FIRE DEPARTMENT: Bids were opened at 2:30 p.m., October 26, 1970,
for-a 1500 gallon water tanker. One bid was received from
Waconia Manufacturing Industries for a total cost of $4,194.00
F.O.B. Waconia.
Councilman Pearson made a motion, seconded by Councilman Bennyhoff
to accept the bid from Waconia Manufacturing for $4,194.00,
r. O. B. Waconia with change noted in item #19 ( will be primed
only, not painted). Money taken from the Bond Issue. The
following voted in favør thereof: Mayor Coulter, Councilmen
Bennyhoff, K1ingelhutz, Neils and Pearson~ No negative votes.
Motion carried.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Pearson to approve the purchase of equipment from
Minnesota Fire Equipment Co. as follows:

TREASURER'S REPORT:_ The Village Treasurer gave a report on the
status öf the 1970 Budget.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Pearson to adjourn. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz,
Neils and Pearson. No negative votes. Motion carried.
