CHANHASSEN VILLAGE COUNCIL MINUTES - November 2, 1970
The regular Chanhassen Village Council meeting on November 2, 1970,
at 7:30 p.m. was opened with the Pledge to the Flag. The
following members were present: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson.
COUNCIL MINUTES: A motion was made by Councilman Klingelhutz and
seconded by Councilman Pearson to approve the Council Minutes of
October 26, 1970. The fOllowing voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson.
No negative votes. Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Pearson and seconded by Councilman Bennyhoff that the Planning
Commission Minutes of October 27, 1970, be noted and read. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
~RS. ADAMSON: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils to grant a variance on Ordinance #33
allowing the filing and recording of Mrs. Adamson's property by
metes and bounds under Section 13.02. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No negative votes. Motion carried.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Pearson that the purchaser of this preperty be allowed
a building permit as a variance from Resolution #420702, provided
the perculation tests meet the Village standards. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Pearson. No negative votes. Motion carried.
PARK AND RECREATION: A motion was made by Councilman Bennyhoff and
seconded by CounciTman Pearson to approve the co-sponsorship of the
teenage dance. Village share is $40.00. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No negative votes. Motion carried.
PARK AND RECREATION (WARMING HOUSE): Steve Wolf explained the cost
and size of a 14 x 20 stucco garage-that the Jaycee's have located
to be used as a warming house. Cost is $400.00 delivered to the
site.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson to give preliminary approval to the idea but more details
to be furnished before final approval will be given. The following
voted in favor thereof: Mayor Coulter, Councilmen, Bennyhoff,
Klingelhutz, Neils and Pearson. No negative votes. Motion carried.
PARK AND RECREATION (HOCKEY RINK): A motion was made by Councilman
Bennyhoff and seconded by Councilman Klingelhutz to approve the
Magnuson-Morris bid of $460.00 for replacing poles and lights at the
hockey rink. All poles to be guide. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils

and Pearson. No negative votes. Motion carried.

STREET NAME: After much general discussion by the residents along
Great Plains Boulevard, the following motion was made:
A motion was made by Councilman Klingelhutz and seconded by
Councilman Pearson to approve the Planning Commission's recommendation
and change Great Plains Boulevard to Great Plains Trail from
Arboretum Boulevard to the southern boundary of the Village.
The following voted in favor thereof: Councilmen Klingelhutz and
Pearson. Mayor Coulter and Councilman Neils voted no. Councilman
Bennyhoff abstained. Motion defeated.
Councilman Neils would like to see these people work on the
historical name of 101 from Elk River to Shakopee so that it would
not be necessary to change the name of the road more than once.
ANTIQUE SHOP: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils that Jerry Holl be given first chance
to renew the lease for the Old Village Hall for the year of 1971.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.

A motion was made by Councilman Pearson to table action on this
bid, at this time. The motion died for lack of a second.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Neils to approve the bid of Westerman Lumber in the
amount of $3,069.00. This to be paid from surplus funds. The
following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. Mayor Coulter voted no. Motion carried.
ANIMAL CONTROL CONTRACT: A motion was made by Councilman Bennyhoff
and seconded by CounclIman Pearson to approve the contract with
Tonka Kennels for the year of 1971 as submitted. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Pearson. No negative votes. Motion
carried.

4TH STREET: A motion was made by Councilman Bennyhoff and
seconded by Councilman Klinge1hutz to set the date for the Public
Hearing for 4th Street Improvement for December 7, 1970 at
7:30 p.m. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative
votes. Motion carried.
TEEN REPORT: There was a general discussion on the Youth Seminar
to be" held" November 23, 1970. It was decided that the Park and
Recreation Commission would be in charge and be the overall
coordinator of this meeting.. Councilman K1ingelhutz will be
present at the Park and Recreation Commission Meeting on
November 5, 1970.
CURFEW ORDINANCE: A. motion was made by Councilman Klingelhutz and
seconded by Councilman Pearson to approve Ordinance #43. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. "No negative votes.
Motion carried.
MAINTENANCE: A motion was made by Councilman Pearson and seconded
by Councilman Klingelhutz to authorize the Maintenance Superintendent
to extend the yellow no parking line in front of Mary Kerber's
house lS feet. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No
negative votes. Motion carried.
STORM SEWER: The Engineer explained his letter and report dated
September 29, 1970, on the Western Hills storm sewer.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff that the Maintenance Department proceed with this
project as recommended by the Engineer, if possible, this fall.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
The Minutes should reflect that the cost 9f this project should
not be taken from the Maintenance Departmènt.
ORDINANCE #9 (DISCHARGE OFPIRE ARMS): A motion was made by
Councilman Pearson-ana-secondedby Councilman Neils that no
shooting permits be granted for the area north of Highway #5
(Arboretum Boulevard). The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson.
No negative votes. Motion carried.
VILLAGE HALL: A motion was made by Councilman Bennyhoff and
seconded by Councilman Klìngelhutz to approve the installation of
a flood light on the back of the Village Hall. To be done by
Magnuson-Morris ata cost of $65.00. The following voted in favor
thereof: Ma~or Coulter, Councilmen Bennyhoff, Klingelhutz, Neils
and Pearson. No negative votes. Motion carried.
