CHANHASSEN VILLAGE COUNCIL MINUTES ~ November 30, 1970
The special Chanhassen Village Council Meeting was held on
November 30, 1970, at 8: 00 p.m., in the Chanhassen Village Hall.
The meeting was opened with the Pledge to the Flag. The following
members were present: Mayor Coulter, Councilmen Bennyhoff, Neils,
Klingelhutz and Pearson.
COUNCIL MINUTES: A motion was made by Councilman Klingelhutz and
seconded by Councilman Bennyhoff to approve the minutes of
November 16, 1970 and November 23, 1970, with the following amend-
ment to the November 16, 1970, Minutes:
WELTER PROPERTY: Resolution #111670-1, Park Development
Project, Section 4 to read as follows:
4. That the execution of an agreement by said officers
on behalf of the Village with the First National Bank of Minneapolis
as Trustee providing that all trust investments made by said Trustee
under the provisions of Paragraph 8 of said trust agreement shall be
made in direet obligations of the United States of America or obli-
gations of its agencies which are guaranteed as to principal and
interest by the United States of America. Further, that the Trustee
may purchase from or sell to itself, as principal or agent, securities
herein authorized; and all investments to be made by the Trustee as
herein authorized shall be made at the risk of the Village, and the
Village shall agree to reimburse the account for any losses sustained
as a result of investments made pursuant to its directions, is hereby
approved and ratified.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Pearson
and seconded by Councilman Bennyhoff that the Planning Commission
Minutes of November 24, 1970, be noted and read. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No negative votes. Motion carried.
PARK AND RECREATION MINUTES: A motion was made by Councilman Neils
and seconded by Councilman Klingelhutz that the Park and Recreation
Commission Minutes of November 17, 1970, be noted and read. The
following voted in favor thereof: Mayor Coulter, Councilmen Neils,
Bennyhoff, Klingelhutz and Pearson. No negative votes. Motion
carried.
DONALD HANUS (BUILDING PERMIT): A motion was made by Councilman
Pearson and seconded by Councilman Klingelhutz to grant a variance
allowing a building to be built within three feet of the north
property line. Also approving the Building Permit Application as
per the plans and specifications. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils
and Pearson. No negative votes. Motion carried.

BUILDING PERMIT (LOT 13, BLOCK 1, WESTERN HILLS 1ST): Anne Neils I
reported that the Board of Adjustments and Appeals met to consider
a variance allowing a house to be placed on Lot 13, Block 1,
Western Hills 1st, 15 feet, 10 inches from the south property line.
The Board of Adjustments and Appeals is hereby recommending approval
of this variance.
A motion was made by Councilman Neils and seconded by Councilman
Bennyhoff to grant the variance requested by James Sorensen,
allowing the structure to be placed 15 feet, 10 inches from the
south property line. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded Councilman
Pearson to suspend the Agenda. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils
and Pearson. No negative votes. Motion carried.
DAN SCHIMMELPFEMNING: The Village Administrator and the Village
Attorney explained what has been done to date. Mr. Schimmelpfemning
requested that the Council grant an extension for removal of his
mobile home.
A motion was made by Councilman Pearson and seconded by Councilman I
Neils that the trailer be removed from the Schimmelpfemning
property by January 15, 1971. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils
and Pearson. No negative votes. Motion carried.
MOBILE HOMES: The Council will make a policy decision on mobile
homes before the end of 1970.
SNOWMOBILES: The Mayor reported that he had received many complaints
on snowmobiles and the use of snowmobiles.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Bennyhoff that on December 7,1970, at 8:00 p.m., we
have a general discussion on snowmobiles and the adopting of a
snowmobile ordinance. Also that on December 16, 1970, at 7:30 p.m.,
there will be a Public Hearing on a Snowmobile Ordinance. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
DALE GREEN COMPANY: The Dale Green Company is requesting a conditional
use permit their property for business purposes. The Village
Council discussed the miscellaneous problems concerning this
conditional use permit.

THE DALE GREEN COMPANY: (contd) A motion was made by Councilman
Klingelhutz and seconded by Councilman Pearson that this request
be presented to the Planning Commission and the Park and Recreation
Commission for their study. Their recommendations to be sub-
mitted to the Council for further action. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No negative votes. Motion carried.
MINNEWASHTA MANOR: A motion was made by Councilman Neils and
seconded by Councilman Bennyhoff to approve the installation of
two, 250 watt, mercury vapor street lights at the two entrances
into Minnewashta Manor from Highway 7 for reasons of traffic
safety. The four other lights requested will be taken under
consideration. The following voted in favor thereof: Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. Mayor Coulter voted
no. Motion carried.
TAX COMMITTEE: The Mayor stated that he had talked to the Tax
Committee members and they will review tax bills that are being
preparèd~for presentation for legislation and report back to the
Council on recommendations on said bills.
TEENS: Mayor Coulter asked what the Council felt should be done
about the teen problem since the Youth Seminar. General feeling
was, that since the teens have organized and are working with the
Park and Recreation Commission that the Council will take no
further action until they have specific recommendations from the
Park and Recreation Commission.
UNIT CHARGE: A motion was made by Councilman Bennyhoff and seconded
by Councilman Pearson that the sewer and water unit charge shall be
paid at the time the connection permits are taken out. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils,
Klingelhutz, and Pearson. No negative votes. Motion carried.
LAKE ANN PARK PROPERTIES: The Village Attorney informed the Council
of his meeting with Mr. Lindahl and stated that he would meet with
the Village Engineer and the Appraiser (Robert Reichert) to discuss
certain aspects of the proposed property.
SEWER: A motion was made by Councilman Bennyhoff and seconded by
Councilman Klingelhutz to authorize the Village Treasurer to pay
the Metropolítan'Sewer Board $200.00 a month for the months of
November and Deê'ember, for the operation of the Lake View Hills
Sewer Plant. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative
votes. Motion carried.
MAINTENANCE DEPARTMENT: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils to authorize the Village Administrator
to advertise for gasoline and oil bids. Bids to be received
December 21, 1970, at 2:00 p.m. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson.
No negative votes. Motion carried.

WEED CONTROL: A motion was made by Councilman Bennyhoff and I
seconded by Councilman Neils that Henry Wrase be authorized to
attend a seminar on pesticides. The Village to pay the fee and
mileage. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative
votes. Motion carried.
INSURANCE: A motion was made by Councilman Pearson and seconded
by Councilman Neils to approve the Village portion of the Blue
Shield Insurance for all employees in the amount of $13.66 per
employee, effective December 15, 1970. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No negative votes. Motion carried.
The Mayor turned the meeting over to Acting Mayor Klingelhutz.
LAZY "C": A motion was made by Councilman Bennyhoff and seconded
by Councilman Pearson that the Village is responsible for
furnishing service to the Lazy "C" property line. The line was
installed by the property owner at a cost which amounted to more
than the normal assessment of $808.00. Therefore the lateral
assessment is considered paid in full. The following voted in
favor thereof: Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson. No negative votes. Motion carried.

Acting Mayor Klingelhutz turned the meeting back over to the
Mayor.
PLANNING COMMISSION: A motion was made by Councilman Pearson and
seconded by Councilman Klingelhutz that the Resolution #112470,
from the Planning Commission be taken under advisement. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz and Pearson. Councilman Neils voted no.
Motion carried.
A motion was made by Councilman Bènnyhoff and seconded by Councilman
Klingelhutz to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson.
No negative votes. Motion carried.
