PUBLIC HEARING - PROJECT 70-5 - 4th STREET, STREET IMPROVEMENT -
7:30 P.M.
The Chanhassen Village Council met on December 7, 1970, for the
above special meeting. The following members were present:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson.
The Clerk-Administrator read the published notice of the hearing.
The Village Engineer explained the project.
The Village Attorney explained the road right-of-way.
The reason that this project was initiated by the Council, was
discussed at length.
DAVID HALLA stated that they are definitely against this
street improvement project.
R. A. JOHNSON agreed with Mr. Halla's statement.
PAUL STEINER stated that he was not against the project per se
but felt that the cost of this project should be borne solely
by Top of the Bluff.
A motion was made by Councilman Klingelhutz and seconded by Council-
man Pearson to continue this Public Hearing until December 21, 1970,
at 7:30 p.m. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative
votes. Motion carried.
Anyone interested in this project should file a written statement
on or before December 14,1970, 4:30 p.m., in the Chanhassen Village
Hall.

CHANHASSEN VILLAGE COUNCIL MINUTES - December 7, 1970
The regular Chanhassen Village Council Meeting was opened with
the Pledge to the Flag. The following members were present: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson.
A motion was made by Councilman Klingelhutz and seconded by Council-
man Neils to suspend the Agenda. The following voted in favor there-
of: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Pearson. No negative votes. Motion carried.
SNOWMOBIL~S: There were approximately 75 people present interested
in the snowmobile discussion. The Mayor read a letter from the
Snowmobile Club Chairman, ALi.Sinnen.
The Mayor asked Lt. Francis Klein how many complaints the Police
Department had received on snowmobiles this fall. Lt. Klein said
they had nine complaints, 5 of which were children.

SNOWMOBILES (contd): A general discussion on the pros and cons I
of snowmobile use ensued. The Mayor appointed two representatives
from the Snowmobile Club, one member of the Park and Recreation
Commission, Robert Fayfield, two citizens at large, James Morrison
and Darrell Johnson, and a representative from the Village Council,
Dr. J. D. Bennyhoff as a committee to meet and draft up a pre-
liminary Snowmobile Ordinance.
POLICE REPORT: Lt. Klein was present to give the monthly Police
Report.
COUNCIL MINUTES: A motion was made by Councilman Pearson and
seconded by Councilman Klingelhutz to approve the November 30,
1970, Council Minutes, with the following amendments:
MINNEWASHTA MANOR: The Minutes should reflect that Mayor
ëoulter voted no on the lights in Minnewashta Manor because
he felt that all six lights should be approved.
PLANNING COMMISSION: The Minutes should reflect that the
reason Councilwoman Neils voted no was that she felt that
this Resolution shou¡d be discussed at this time and not
at a later date.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.

PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Pearson and seconded by Councilman Neils that the
Park and Recreation Commission Minutes of December 1, 1970, be
noted and read but should have read Mark Schlenk not Marge Schlenk.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
PERSONNEL POLICY: A motion was made by Councilman Neils and
seconded by Councilman Pearson the Councilman Bennyhoff and the
Administrator be appointed to the Employee Advisory Board. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
TWO-WAY RADIO SYSTEM: A motion was made by Councilman Bennyhoff
and seconded by Councilman Klingelhutz to authorize the Administrator
to advertise for bids on a two-way radio system. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Pearson. No negative votes. Motion carried.
CIGARETTE LICENSES: A motion was made by Councilman Pearson and
seconded by Councilman Bennyhoff to approve the following
Cigarette Licenses when proper applications for 1971 have been
filed and fees have been paid.

WELTER PROPERTY: A motion was made by Councilman Klingelhutz and
seconded by Councilman Neils to approve the lease of the entire
Welter Property for $10.00 per year. The Village Attorney to draw
up the lease. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Pearson. No negative
votes. Motion carried.
PARK BOND ISSUE: A motion was made by Councilman Klingelhutz and
seconded by Councilman Neils to authorize the investment of $30,000
in Federal Inter Credit Banks ilÐRec at 5.700 interest. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
BUILDING PERMITS: A motion was made by Councilman Kdingelhutz
and seconded by Councilman Bennyhoff to approve the pole barn
building permit application for Harold Hesse, for farm use only.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Pearson. No negative votes.
Motion carried.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to approve the plans and specifications for a double
bungalow on Lot 7, Block 3, Highland Park. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Pearson. No negative votes. Motion carried.
COUNTY LIBRARY: A motion was made by Councilman Pearson and
seconded by Councilman Bennyhoff to authorize Anne Neils to repre-
sent the Village of Chanhassen in the Carver County Library dis-
cussion on December 9, 1970. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson.
No negative votes. Motion carried.

PROJECT (RESOLUTION ADOPTED APRIL 15, 1968): A motion was made I
by Councilman Klingelhutz and seconded by Councilman Pearson that
the following amounts be taken from the construction projects and
put in the General Fund:

The following voted in favor thereof: Mayor Coulter, Councilmen

Motion carried.
AMRHEIN PROBLEM: The Administrator was instructed to meet with
Amrheins and explain what the Village is willing to do about their
problems.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Pearson.
No negative votes. Motion carried.
