PUBLIC HEARING - PROJECT 70-6 - TRUNK SANITARY SEWER
The Chanhassen Village Council met on December 21, 1970, for the
above special meeting. The following members were present:
Acting Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Pearson.
Mayor Coulter was absent.
The Administrator read the published notice of the hearing.
The Engineer explained the Project.
There was no one present to speak for or against this project.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to adjourn the Public Hearing. The following voted in
favor thereof: Acting Mayor Klingelhutz, Councilmen Bennyhoff, Neils
and Pearson. No negative votes. Motion carried.

CONTINUATION OF PUBLIC HEARING - 4TH STREET STREET IMPROVEMENT
The Chanhassen Village Council met on December 21, 1970, to continue
the above Public Hearing. The following members were present:
Acting Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Pearson.
Mayor Coulter was absent.
The Administrator read the Minutes of the Public Hearing dated
December 7, 1970. He also read the written statements that had
been filed with the Village.
PAUL STEINER stated that the improvement of this road would be
of absolutely no value to his property and that it would only
benefit Top of the Bluff.
RON MONDALE QUESTION: Has another point of access to Top of
the Bluff been considered, such as County Road 14?
ANSWER: The Planning Commission had discussed this. But
because of the 212 Freeway and other items, it was felt
that this was the best access.
DAVE HALLA: I don't want to enter into a verbal contest with
Top of the Bluff but, when we purchased our property, we hoped
that it would remain in this country atmosphere.
We don't intend to go out of business. The dust on the road
does cause a problem by settling on the leaves and not letting
the trees grow properly. Only because of our irrigation
system and by washing off the leaves were our trees able to
grow properly last year.

DAVE HALLA (contd): It has been stated that this improve- I-
ment will benefit Top of the Bluff-more than anyone else.
I again state that I am definitely against this road being
improved if I have to pay any of the costs.
Top of the Bluff should be required to pay all costs.
STANLEY STEINER: The road should be improved to blacktop
condition. I should not be asked to give up any of my land.
I would like to go on record 'stating that I am against any
of this cost being borne by myself.
VILLAGE ATTORNEY: The Village Attorney questioned Mr. Halla
on some of the irresponsible statements made in his letter
dated December 17, 1970, and filed with the Village. Further
stating that Mr. Halla and Mr. Halla's attorney (Gustafson,
Gustafson & Austin owed the Village a public apology.
Acting Mayor Klingelhutz asked if there were any further statements
to be made.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils to adjourn. The following voted in favor thereof: Acting
Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Pearson. No
negative votes. Motion carried.
The Village Council will discuss this improvement on January
at 8:30 p.m.

CHANHASSEN VILLAGE COUNCIL MINUTES - December 21, 1970
The regular Chanhassen Village Council meeting on December 21, 1970,
was opened with the Plèdge of the Flag. The following members were
present: Acting Mayor Klingelhutz, Councilmen Bennyhoff, Neils
and Pearson. Mayor Coulter was absent.
COUNCIL MINUTES: A motion was made by Councilman Neils and seconded
by Councilman Bennyhoff to approve the Council minutes of December 16,
1970, with the following amendment: Page 3, TOP OF THE BLUFF,
change Clubhours to Clubhouse. The following voted in favor thereof:
Acting Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Pearson.
No negative votes. Motion carried.
PARK AND RECREATION MINUTES: A motion was made by Councilman
Pearson and seconded by Councilman Bennyhoff that the Park and
Recreation Commission Minutes of December 15, 1970, be noted and I-
read. The following voted in favor thereof: Acting Mayor
Klingelhutz, Councilmen Bennyhoff, Neils and Pearson. No negative
votes. Motion carried.

YOUTH ADVISORY COMMITTEE: Amotion was made by Councilman Benny-
hoff and seconded by Councilman Neils that the Youth Advisory
Committee Minutes of December 9, 1970, be noted and read. The
following voted in favor thereof: Acting Mayor Klingelhutz,
Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion
carried.
PROJECT 70-4, PARK GRADING SITES: A motion was made by Councilman
Pearson and seconded by Councilman Bennyhòff to approve the
Brenden and Latterner statement in the amount of $4,776.62, with
$1,500.00 to be taken from the Park and Recreation Acquisition
Fund and $3,276.62 to be taken from the General Fund. The following
voted in favor thereof: Acting Mayor Klingelhutz, Councilmen
Bennyhoff, Neils and Pearson. No negative votes. Motion carried.
BILLS: A motion was made by Councilman Pearson and seconded by
Councilman Bennyhoff to approve payment of all bills as submitted.
The following voted in favor thereof: Acting Mayor Klingelhutz,
Councilmen Bennyhoff, Neils and Pearson. No negative votes.
Motion carried.
WARRANTS: Councilman Pearson moved the adoption of the
following RESOLUTION: BE IT RESOLVED that the following
will be paid in a warrant:
GENERAL FUND - To Schoell & Madson - 1970-7 - in the amount
of $14,860.75 Check # 1960
To schoell & Madson - 1969-1 - in the amount
of $5,640.50 Check # 1961
RESOLUTION SECONDED BY Councilman Bennyhoff. The following
voted in favor thereof: Acting Mayor Klingelhutz, Councilmen
Pearson, Bennyhoff and Neils. No negative votes. Motion
carried.
PROJECT 69-2 - SEWER AND WATER - BANK: A motion was made by
Councilman Bennyhoff and seconded by Councilman Neils to approve
the final statement of Midwest Mechanical Services, Inc., as
submitted by the Village Engineer, December 17, 1970, in the
amount of $993.71 for Project 69-2. The following voted in favor
thereof: Acting Mayor Klingelhutz, Councilmen Bennyhoff, Neils
and Pearson. No negative votes. Motion carried.
MAINTENANCE: Gasoline bids were received as advertised and opened
at 2:00 p.m. on December 21, 1970. Only one (1) bid was received.
The one (1) bid was from Minnesota victoria Oil in the amount of
22.1¢ a gallon for regular gasoline and 13.9¢ for 2-D diesel fuel.

MAINTENANCE: (contd) A motion was made by Councilman Bennyhoff I
and seconded by Councilman Pearson to approve the gasoline bid
from Minnesota Victoria Oil for gasoline at 22.~per gallon and
13.9¢ per gallon for 2-D Diesel Fuel. The following voted in
favor thereof: Acting Mayor Klingelhutz, Councilmen Bennyhoff,
Neils and Pearson. No negative votes. Motion carried.
UTILITY DEPARTMENT: There was a discussion on the costs incurred
by the Administration, in the Utility billing, etc. The amount of
the Utility service charges bill be approximately $30,000.00 for the
year of 1970.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff to charge 10% against the Utility Department for Admin-
istration costs to be deposited in the General Fund. The following
voted in favor thereof: Acting Mayor Klingelhutz, Councilmen
Bennyhoff, Neils and Pearson. No negative votes. Motion carried.

UTILITY DEPARTMENT - #112 CHANHASSEN ELEMENTARY SCHOOL: A motion
was made by Councilman Bennyhoff and seconded by Councilman Neils
to set the sewer units at the Chanhassen Elementary School at
21 units. The following voted in favor thereof: Acting Mayor
Klingelhutz, Councilmen Bennyhoff, Neils and Pearson. No negative
votes. Motion carried.

TAX COMMITTEE: A motion was made by Councilman Bennyhoff and
seconded by Councilman Pearson to appoint the following people
to the Tax Committee:

Mrs. Harry Funk

Mrs. Glenn K. Hill

Councilmen Bennyhoff, Neils and Pearson. 'No negative votes.
Motion carried.

PARK AND RECREATION: A motion was made by Councilman Bennyhoff and
seconded by Councilman Pearson to approve the contract for the
LP tank installation for the warming house in the amount of $1.00.
The following voted in favor thereof: Acting Mayor Klingelhutz,
Councilmen Bennyhoff, Neils and Pearson. No negative votes. Motion
carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson to approve the purchase of a heater and the installation of
this irt the warming house. The following voted in favor thereof: I
Acting Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Pearson.

ANNUAL VILLAGE PARTY: A motion was made by Councilman Neils and
seconded by Councilman Bennyhoff to set the date for the Annual
Village Party as January 22, 1971. The following voted in favor
thereof: Acting Mayor Klingelhutz, Councilmen Bennyhoff and Neils.
Councilman Pearson abstained. No negative votes. Motion carried.
A motion was made by Councilman Neils and seconded by Councilman
Pearson to adjourn. The following voted in favor thereof:

No negative votes. Motion carried.
