1971 01 06 ~ I I I CONTINUATION OF PUBLIC HEARING ON SNOWMOBILE ORDINANCE - JANUARY 6, 1971 - 7:30 P.M. The Chanhassen Village Council met on January 6, 1971, to continue the above Public Hearing. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. There were approximately 25 people present. Mayor Coulter opened the meeting and requested the Village Attorney to give a report of the snowmobile ordinance committee's meeting on January 3, 1971. The Village Attorney then briefly outlined the results of that committee meeting, and the committee members present at the public hearing acknowledged that the report was correct. Arthur Taylor of Lake Riley urged the Council to adopt a curfew and an age limitation on snowmobile operaters. Marlene Roufs recom- mended that the Council adopt a curfew and age limitation on snow- mobile operators. Snowmobile Club President Al Sinnen spoke in opposition to the age limitation issue. With regard to the issue of littering and obstructions, the Village Attorney recommended the enactment of a new Section 9 to read as follows: 9.01 No person shall deposit paper, litter, rubbish or debris on public or private property, or throw paper, litter, rubbish or debris from a snowmobile. 9.02 No person shall place obstructions, including ice blocks, on publicly owned lands or frozen waters so as to interfere with the lawful use thereof by the public. After a full discussion of all issues by Council members and those members of the public present at the hearing, the Council informally voted on the following issues: a. Prohibit snowmobile operation on the boulevard of the rights- of-way of platted streets. VOTE: Unanimous in favor of prohibition. b. Age limitation on operators of snowmobiles on public lands and waters except streets. VOTE: Unanimous against an age limitation. c. Curfew. VOTE: For curfew - Neils and Klinge1hutz. Against curfew - Bennyhoff, Coulter, and Wolf. d. Littering and obstructions. VOTE: Unanimous in favor of proposed section. PUBLIC HEARING (contd) -2- e. Prohibit operation of snowmobiles on streets where road- ways abut sidewalk or private property. VOTE: Unanimous against prohibition. f. Require pennant for operation on public streets. VOTE: For - Neils. Against - Coulter, Bennyhoff, Klinge1hutz and Wolf. g. Council authorization for snowmobile races and sporting events. VOTE: Affirmative - K1ingelhutz, Bennyhoff and Coulter. Negative - Neils and Wolf. h. Amend Section 3, subdivision 3, to include the following: Notwithstanding anything in this section contained to the contrary, snowmobile operation shall be permitted on public bodies of water within the Village provided said operation complies in all respects with the other provisions of this and all other Village ordinances. The Village Clerk will notify the President of the Chanhassen Snowmobile Club when the final draft of the ordinance is pre- sented to the Council for formal consideration. A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to adjourn. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, and Wolf.
