CHANHASSEN VILLAGE COUNCIL MINUTES - January 18, 1971
The regular Chanhassen Village Council meeting on January 18, 1971,
at 7:30 p.m., was opened with the Pledge to the Flag. The following
members were present: Mayor Coulter, Councilmen Bennyhoff, Neils,
Klingelhutz and Wolf.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Neils
and seconded by Councilman Wolf that the Planning Commission
Minutes of January 12, 1971, be noted and read. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
The Planning Commission Minutes should reflect that Anne Neils
was present at this meeting.
CHANHASSEN ESTATES: A motion was made by Councilman Klingelhutz
and seconded by Councilman Bennyhoff to set the Public Hearing for
February 8, 1971, at 7:30 p.m., for the rezòn~ng for Chanhassen
Estates to run concurrently with the Planning Commission Public
Hearing on the preliminary plat. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils
and Wolf. No negative votes. Motion carried.
BILLS: A motion was made by Councilman Bennyhoff and seconded
by Councilman Wolf to approve the $547.58 to be withdrawn from
the Park Requisition Fund. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Wolf that the Magnuson & Morse Electric Co. bill be
paid in full only when we have received a written statement that
they will install guide wires before June 1, 1971. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Klingelhutz to approve the bills as submitted. The following
voted in favor thereof: Mayòr Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
PROJECT 67-3 - 78th STREET IMPROVEMENT: The Administrator is
instructed to pursue the collection of the State bill from the
County.
PARK AND RECREATION: A motion was made by Councilman Bennyhoff
and seconded by Councilman Wolf to approve the payment of $50.00
to Lyman Lumber Company for warming house material. The total
bill was $122.00. Lyman Lumber is donating $72.00. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.

BUDGETS: A motion was made by Councilman Klingelhutz and seconded
by Councilman Neils that all surplus funds from all budgets
revert to the General Fund. The contract for the Transportation
Study that was approved by the Council in 1970, will be paid out
of the General Fund. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No
negative votes. Motion carried.
FIRE DEPARTMENT: A motion was made by Councilman Neils and seconded
by Councilman Bennyhoff to note the annual report from the Fire
Department. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative
votes. Motion carried.
VIOLATION BUREAU: The Village Attorney gave a brief report on the
Violation Bureau.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Bennyhoff that the motion made on January 4, 1971,
pertaining to non-moving violation tickets be amended as
follows. The fine schedule will be as follows.
$5.00 - First Offense
$7.50 - Second Offense
$10.00 - Third Offense
All offenders with over three (3) offenses that occur
within a twelve (12) month period must appear before
the municipal court.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
4TH STREET: Discussion on 4th Street, Engineer's report, costs,
etc. The Village Attorney stated that he had received the
Halla Nursery Abstract today. This was requested in December
at the Public Hearing. Consequently, he has not had time to
research this abstract.
Anne Neils asked if the existing Halla fence is on the right-of-way.
The Village Engineer answered, "Yes I, I believe so."
DAVE HALLA: I feel that a study of 4th Street should be
done so that you can tell us what will be done.
STANLEY STEINER-stated that he was against straightening
the road which would continue thru the ravine.
Dave Halla submitted a memo pertaining to the right-of-way,
boundary lines, etc., from his Attorney.

4TH STREET (contd)
DAVE HALLA stated that it was his understanding that Vogel
(previous owner of the Top of the Bluff property) gave a
piece of land 53~' by 1236.75' to Lenzmeier (previous
owner of the Halla property) inreturn for an access to
Highway 101.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Neils to defer any action on 4th Street until all
facts are present. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
The Village Attorney stated that he thought the facts would be
~vailable in approximately 60 days.
MAINTENANCE REPORT: Mr. Halla stated that the Maintenance
Department was intentionally plowing an unfair portion of the
snow on his property and knocking down his fence.
It was explained, to Mr. Halla, that the Maintenance Department
plows from the center line of the road both directions and that
normally the snow drifts on the north side.
COUNCILMAN KLINGELHUTZ stated that he felt that Dave Halla's
statement was unfair as the Maintenace Department was only
doing their job properly.
VILLAGE ENGINEER~stated that this is normal procedure.
COUNCILMAN KLINGELHUTZ stated that he felt that the Township
Board members should explain to the Council, what author-
ization they gave to Halla Nursery.
COUNCILMAN BENNYHOFF stated that he felt that the problem
could not be resolved until a definite property line was
established by survey.
It was felt, by the Council, that the facts that will be presented
for the 4th Street, Street Improvement would also resolv~ this
problem.
TWO-WAY RADIO SYSTEM: A motion was made by Councilmen Bennyhoff
and seconded by Councilman Wolf that we purchase the following:

$1,088.83 be paid this year from the General Fund.
$2,000.00 conditional contract with bank. $1,000.00 on
February 1, 1972 and 1973. The maintenance agreement
be paid each month.
The Utility Department will pay $805.02, plus pay each
month on the maintenance agreement.
All of the above upon approved acceptance.
The following voted in favor thereof: Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. Mayor Coulter voted no. Motion
carried.
The Mayor stated that the reason he voted no was that he felt
we should buy better units.
POLICE: The monthly report was given by Acting Police Chief
Al Wallin. Miscellaneous problems were discussed.
WEEDS: Councilman Klingelhutz stated that he and Henry Wrase
attended the Annual Weed School on January 18, 1970, in Cologne.
SOLID WASTE: General discussion on the proposed solid waste
ordinance.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils to adjourn. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No
negative votes. Motion carried.
