CHANHASSEN VILLAGE COUNCIL MINUTES - April 26, 1971
The special Chanhassen Village Council Meeting was opened with
the Pledge to the Flag~ The following members were present:
Mayor Coulter, Councilmen Klingelhutz, Neils and Wolf. Council-
man Bennyhoff was absent.
COUNCIL MINUTES: A motion was made by Councilman Klingelhutz and
seconded by Councilman Wolf to approve the Council Minutes of
April 19, 1971. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Neils and seconded by Councilman Wolf that the Park
and Recreation Commission Minutes of April 20, 1971, be noted
and read. The following voted in favor thereof: Mayor Coulter,
Councilmen Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to hire Jacqueline Anne Nyhammer as an instructor in the
Summer Recreation Program for seven weeks at $450.00. The
following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Mayor Coulter and seconded by Councilman
Klingelhutz to suspend the Agenda. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz and Wolf.
Councilman Neils voted no. Motion carried.
METROPOLITAN SALES TAX: Mayor Coulter presented a Resolution
in support of a Bill imposing a Metropolitan Sales Tax (House
File #2995 and Senate companion File #2636). Mayor Coulter
urged the Council to pass this Resolution.
A motion was made by Councilman Klingelhutz that the Village of
Chanhassen adopt a Resolution supporting House File #2995 and
Senate File #2636. After discussion Councilman Klingelhutz
withdrew his motion.
A motion was made by Councilman Neils and seconded by Councilman
Wolf to table any action on this Resolution until next week.
The following voted in favor thereof: Councilmen Neils and Wolf.
Mayor Coulter and Councilman Klingelhutz voted no. Motion defeated.
A motion was made by Councilman Wolf and seconded by Councilman
Klingelhutz to call for a Special Council Meeting at 7:30 p.m.
April 28, 1971 in the Village Hall, to consider a Resolution on
House File #2995 and Senate File 2636. The following voted in
favor thereof: Councilmen Klingelhutz, Neils and Wolf. Mayor
Coulter voted no. Motion carried.

TRANSIT TAX: Councilman Klingelhutz stated that Transit Com-
missioner,~d Hjermstad, is opposed to the electrical tax for
transit.

A motion was made by Councilman Klingelhutz and seconded by
Councilman Neils that the Council of the Village of Chanhassen
approve a Resolution objecting to the Bill before the Senate
taxing electricity for transit purposes. The following voted
in favor thereof: Mayor Coulter, Councilmen Klinge1hutz, Neils
and Wolf. No negative votes. Motion carried.
STREET LIGHTS: A motion was made by Councilman K1ingelhutz and
seconded by Mayor Coulter to approve the two applications for
street lights, one in front of the Chanhassen Standard and one
in front of the new Chanhassen State Bank. The following voted
in favor thereof: Mayor Coulter and Councilman Klingelhutz.
Councilmen Neils and Wolf voted no. Motion defeated.
A motion was made by Councilman Wolf and seconded by Mayor Coulter
to approve a 23,000 lumen fluorescent street light on West 78th
Street in front of the new Chanhassen State Bank. The following
voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz
and Wolf. Councilman Neils voted no. Motion carried.
A motion was made by Councilman Klingelhutz and seconded by I
Mayor Coulter to approve a 23,000 lumen fluorescent street light
in front of the Chanhassen Standard Oil Station. The following
voted in favor thereof: Mayor Coulter and Councilman Klingelhutz.
Councilmen Neils and Wolf voted no. Motion defeated.

and seconded by Councilman Neils to consider street light appli-
cations upon individual applications and merits. The following
voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
ORDINANCE #36 (SIGN ORDINANCE): There was a discussion on the
proposed amendments to the Sign Ordinance as recommended by the
Planning Commission on April 13, 1971.
A motion was made by Councilman Klingelhutz and seconded by Council~
man Wolf that the Village Attorney reword and submit back to the
Council, for final approval, the recommended amendments to the Sign
Ordinance. This to be discussed at 8:30 p. ~. on May 10, 1971.
The following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
MOTOR BOAT RESTRICTION: A motion was made by Councilman Wolf
and seconded by Councilman Klingelhutz that the Park and Recre-
ation Commission hold a public informational meeting at their I
first meeting in May on a motorized boat ban on Lake Ann.
Abutting property owners on Lake Ann to be notified. The following
voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.

MOTOR BOAT RESTRICTION (contd): A motion was made by Councilman
Wolf and seconded by Councilman Neils that the Village Attorney
draft an Ordinance prohibiting motorized boat traffic on Lake
Ann, to be ready May 10, 1971. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
LEASE (OLD VILLAGE HALL):~ A motion was made by Councilman Wolf
and seconded by Councilman Neils to approve the transfer of the
lease on the Old Village Hall to Fran Michelson, under the same
conditions. Also requiring that the "Antique" sign on the roof
of the garage be removed. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Neils and Wolf. No nega-
tive votes. Motion carried.
KENNEL LICENSE: A motion was made by Councilman Neils and
seconded by Councilman Klingelhutz to approve the Kennel License
renewal for Joe Kenyon. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Neils and Wolf. No nega-
tive votes. Motion carried.
LAKE ANN: A motion was made by Councilman Wolf and seconded by
Councilman Neils to approve the Brauer and Associates agreement
dated April 12, 1971, setting forth the following conditions:
. 1. Surveying and layout includes: setting stakes for
stripping limits; line and grade for rough grading on
the road; blue tops for final road finishing of base
or mat; rough staking for fields and overflow parking;
finish staking for field and parking; and office pre-
paration for field work.
2.
Construction observation is a periodic visit to the
site to interpret to the Contractor and or the Owner
the intent of the plans and specifications. This does
not include inspection or responsibility for construc-
tion means, methods, techniques and the Contractors
failure to perform in accordance with the contract
documents.
3.
Inspections include daily visits to the site to inspect
quality and quantity of work; approve materials; co-
ordinate testing; log progress, weather, working days
and completion date; prevent wasting Owners materials;
provide information for payments; and perform final
and one year quarantee inspections.
This service does not include responsibility for con-
struction means, methods, techniques, sequences or
procedures; approving and processing payments, change
orders, field changes; or contract administration.

4. Contract Administration--service of scheduling the
Contractor; co-ordination between surveying and
construction; acquire proper bond and insurance forms;
hold a pre-construction meeting; provide Contractor
with proper forms for execution of the contract; approve
each vital construction step; review and approve pro-
gress reports; evaluate Contractors performance perio-
dically; review equipment needs for construction; exe-
cute payments, change orders, field changes, and other
contract paper work; process all telephone and other
communications pertaining to the job; review completed
job with the inspector; process final payment and one
year anniversary inspection.
Pees for Services shall be at an hourly rate as follows:
1. Surveying and Layout----------- $3000 estimate
2. Construction Observation------- 3 hours per week
3. Inspection--------------------- 3 hours per day
4. Contract Administration-------- 8 hours per week
FOR THE PLANNER'S BASIC SERVICES as described in Paragraphs 1 I
through 4 above, a fee computed on the basis of the following .
hourly rate schedule:
Principal------------------ $35.00 per hour
Professional Staff--------- 16.00 - 24.00 per hour
Technical Staff------------ 9.00 - 18.00 per hour
Administrative Staff------- 9.00 per hour
Three man survey party----- 32.00 per hour
Two man survey party------- 25.00 per hour
All overtime required by the OWNER'S schedule involving
Technical and Administrative personnel shall be compen-
sated at one and one-half (1~) times the hourly rate shown.
The following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
Councilwoman Neils had a previous commitment and had to leave.
TRANSPORTATION STUDY: It was decided to table any decision on the
Transportation Study until the full Council was present.
FIRE DEPARTMENT: A motion was made by Councilman Wolf and
seconded by Councilman K1ingelhutz to authorize Jerry Schlenk to I
attend the State Fire School and the Village to pay tuition,
mileage and per diem. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, and Wolf. No negative
votes. Motion carried.

SOLID WASTE ORDINANCE: A motion was made by Councilman Klingelhutz
and seconded by Councilman Wolf to table discussion on the Solid
Waste Ordinance. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, and Wolf. No negative votes.
Motion carried.
NORTHERN STATES POWER: A motion was made by Councilman Klingelhutz
and seconded by Councilman Wolf to amend the street lighting
contract to read as follows:
1. Amend the paragraph entitled "SERVICE INCLUDED IN RATE II ,
under Rate Schedule B, to read:
SERVICE INCLUDED IN RATE: Company shall furnish all
electric energy necessary to operate Customer's Ornamental
Street Lighting system, shall make all lamp and globe
renewals, clean the globes, light and extinguish all lamps,
make all ballast renewals, and furnish all the materials
and labor necessary therefore.
2. Delete the word "ballasts" in Line 4 of Paragraph 9,
IITerms and Conditions" on the reverse side of the Street
Lighting Contract.
The following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Klingelhutz and seconded by Council-
man Wolf to adjourn. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz and Wolf. No negative votes.
Motion carried.
