CHANHASSEN VILLAGE COUNCIL MINUTES - May 3, 1971
There was a special Chanhassen Village Council Meeting in the
Chanhassen Village Hall on May 3, 1971, at 7:30 p.m. The
following members were present: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. The meeting was opened
with the Pledge to the Flag.
COUNCIL MINUTES: A motion was made by Councilman Klingelhutz and
seconded by Councilman Wolf to approve the Council Minutes of
April 26, 1971, with the following amendment:
Page 2, STREET LIGHTING POLICY, changed to read as follows:
A motion was made by Councilman Klingelhutz and seconded by
Councilman Neils to consider street light applications upon
individual applications and merits pertaining to public
safety.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Wolf to approve the Council Minutes of April 28, 1971. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion
carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Wolf
and seconded by Councilman Klingelhutz that the Planning Commission
Minutes of April 28, 1971, be noted and read. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
CONDITIONAL USE PERMIT (JOHN DEVLIN): A motion was made by
Councilman Klingelhutz and seconded by Councilman Bennyhoff to
set the date for a Public Hearing for a Conditional Use Permit for
John Devlin for May 17, 1971, at 8:00 p.m. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
TRANSPORTATION STUDY: A motion was made by Councilman Wolf and
seconded by Councilman Neils to approve the preliminary Transportation
Study and forward back to the planner for finalization. The
following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
The Administrator is to check with the Village of Shorewood to see
if our Transportation Study would in any way conflict with Shorewood's
plans.
BURDICK PLAT: A motion was made by Councilman Klingelhutz and
seconded by Councilman Bennyhoff to approve the recommendations of
the Planning Commission as stated in the Minutes of April 28,1971,
as follows:

BURDICK PLAT (contd): I
A motion was made by Tom Gabbert and seconded by Arnie Ryba
that the Planning Commission recommend the preliminary plat
approval be delayed by the Village Council for a period not
to exceed 90 days as a result of the request by the Developer
in his letter dated April 21, 1971. This action is without
prejudice of the rights of the Village of Chanhassen to again
review and approve or disapprove the plat under the provisions
of Ordinance #33. The Developer agrees to furnish the Village
a written statement agreeing to these recommendations. Motion
unanimously approved.
The decision also to be delayed, on the zoning. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff,Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
STREET LIGHT (STANDARD OIL): A motion was made by Councilman
Bennyhoff and seconded by Councilman Klingelhutz to approve the
installation of a 23,000 lumen fluorescent street light at the
south entrance off Highway 101 in front of the Standard Oil Station.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz and Wolf. Councilman Neils voted no.
Motion carried.
Councilman Wolf would like the minutes to reflect that upon new I
information submitted, that he felt for safety reasons that this
light is necessary.
STREET LIGHT POLICY: A motion was made by Councilman Wolf and
seconded by Councilman Neils to request the Planning Commission
to study and submit back to the Council, a detailed policy f6r
establishing new street lights and the specific requirements
that each street light must meet. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,Neils
and Wolf. No negative votes. Motion carried.
CHANHASSEN ESTATES - OUTLOTS 1 & 2: The Village Attorney read
his letter dated April 29, 1971, giving his legal opinion on
these Outlots. Various residents from Chanhassen Estates voiced
their objections to this rezoning.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Klingelhutz to approve the rezoning of Outlot #1 to the proposed
zoning District C-3 and Outlot #2 to the proposed zoning District
C-2. The Village Attorney to prepare a zoning agreement to be
submitted back to the Council for final approval. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz and Neils. Councilman Wolf voted no. Motion
carried.

SOLID WASTE: A motion was made by Councilman Wolf and seconded
by Councilman Bennyhoff to set the date for the Public Hearing
on the Solid Waste Ordinance for May 24, 1971, at 8:00 p.m.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
PROJECT 71-4 (DORN PROPERTY): A motion was made by Councilman
Bennyhoff and seconded by Councilman Klingelhutz to authorize
the Village Engineer to proceed with the sewer and water feasi-
bility study for the Dorn property. The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
KENNEL LICENSES: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils to approve the Kennel License
renewal for John Malakowsky. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Neils to approve the new Kennel License for William S. Kelly,
Jr. The following voted in favor thereof: Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. Mayor Coulter voted no. Motion
carried.

COMPREHENSIVE SEWER TRUNK STUDY: The Village Engineer gave a
report on the study.
A mo~ion was made by Councilman Bennyhoff and seconded by Council-
man Wolf to approve the Comprehensive Sewer Trunk Study and
authorize the Village Administrator to submit the study to the
Metropolitan Sewer Board. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
PROJECT 71-3 (CHANHASSEN ESTATES 2ND, SEWER AND WATER): The

PROJECT 71-3 (CHANHASSEN ESTATES 2ND, SEWER & WATER): I
A motion was made by Councilman Klingelhutz and seconded by
Councilman Bennyhoff to accept the low bid from Fox & Weiler
in the amount of $80,320.50. Contract to be signed upon approval
of the Pollution Control Agency. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
VILLAGE PLANNER: It was generally felt, by the Council, that
we should interview more planners.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Bennyhoff to set the starting time of all Council
Meetings, commencing the next meeting until Central Standard
Time is resumed, at 8:00 p.m. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Council-
man. Neils to adjourn. The following voted in favor thereof:
