1971 05 17 r I I I ~ PUBLIC HEARING - JOHN DEVLIN - CONDITIONAL USE PERMIT The Chanhassen Village Council met on May 17, 1971, for the above special meeting. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf. Councilman Neils was absent. The Village Administrator read the official notice of the Public Hearing. The Village Attorney explained why this Public Hearing was necessary. No one was present objecting to this Conditional Use Permit. A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to close the Public Hearing. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, and Wolf. No negative votes. Motion carried. ----------------------------------------------------------------- CHANHASSEN VILLAGE COUNCIL MINUTES - May 17, 1971 The Council Meeting was called to order. It was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf. Councilman Neils was absent. COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz to approve the Council Minutes of May 10, 1971, with the following amendment: ORDINANCE #45 ( VARIANCE REQUEST) - MRS. LES ANDERSON: pages 2 and 3, between the first and second motion there was considerable discussion. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, and Wolf. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Planning Commission Minutes of May 11, 1971, be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,Klingelhutz and Wolf. No negative votes. Mbtion carried. . CONDITIONAL USE PERMIT - JOHN DEVLIN: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to grant John bevlin a Conditional Use Permit for three (3) years, for the parking of two (2) vehicles on his property. The Village Attorney to draft up a Conditional Use'Permit. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf. No negative votes. Motion carried. ~ .,! CHANHASSEN VILLAGE COUNCIL MINUTES - May 17, 1971 -2- NORTHERN STATES POWER: Cliff Stahlke and Cliff Sundem were I present to explain, to the Council, why it was necessary for Northern States Power to raise the electrical rates. COMMERCIAL BUILDING PERMIT .(HENDRICKSON BROS.): Councilman Wolf explained his reasons for requesting this item be put on the Agenda. A number of persons were present stating that they were in favor of this permit being granted. A motion was made by Councilman Wolf to rescind the motion made on May 10, 1971, approving the Building Permit Application for Hendrickson Bros. Motion died for lack of a second. BILLS: A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz to approve the bills as submitted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf. No negative votes. Motion carried. WARRANT: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to adopt the following Resolution: BE IT RESOLVED that the following bill be paid by a warrant: I GENERAL FUND: Schoell & Madson -- 1970-7 in the amount of $1,415.00, Check #2381 The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf. No negative votes. Motion carried. POLICE DEPARTMENT REPORT: Sergeant Wallin gave the reports for March and April. He also stated that he has had requests for nSlow Childrenlf signs on 63rd Street and Cardinal, also on 96th Street. PRESTIGE DEVELOPMENT CORPORATION: A motion was made by Council- man Bennyhoff and seconded by Councilman Wolf to hold a Public Hearing on a planning unit development for Prestige Development Corporation on June 7, 1971, at 8:00 p.m. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, and Wolf. No negative votes. Motion carried. STREET LIGHT: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve the installation of a street light at the entrance to Minnewashta Shores. The fol- lowing voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf. No negative votes. Motion carried. I J, ~/ ~ I I I ~ CHANHASSEN VILLAGE COUNCIL MINUTES - May 17, 1971 ~~~e 3 AUDITOR'S SUBDIVISION #2: A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz authorizing a division of the assessments on Lots 10 and 11 of Auditor's Sub- division #2. Assessment to be split equally for each lot. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf. No negative votes. Motion carried. SIGN ORDINANCE #36 - PROPOSED AMENDMENTS: John Havlik, Dick Peacha, Bob Mayer and Lyle Ricklefs were present to discuss the proposed amendments. After considerable discussion, the Village Attorney was instructed to rewrite the proposed amendments and submit them back to the Council for final approval. A motion was made by Councilman Klingelhutz and seconded by Councilman Wolf to grant the Chanhassen Mileage a variance from Ordinance #36 to allow his Conoco revolving sign. Specific reason being that the sign is existing and removal would create a hardship. The Administrator informed the Council that this motion was out of order as Ordinance 36-A states that a variance request must be submitted to the Planning Commission first. Councilman Wolf withdrew his second and Councilman Klingelhutz withdrew his motion. BOND ISSUE - $775,000: After some discussion, Cbuncilman Benny- hoff introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING THE ISSUANCE AND PROVIDING FOR THE PUBLIC SALE OF $775,000 GENERAL OBLIGATION WATER AND SEWER REVENUE BONDS BE IT RESOLVED by the Council of the Village of Chanhassen, Minnesota, as follows: 1. This Council has investigated the facts and hereby determines that it is necessary to issue and sell its general obligation water and sewer revenue bonds in the amount of $760,000 pursuant to Minnesbta Statutes, Section 444.075, to finance the construction of the following water and sewer improve- ments: Designation of Improvement Trunk Sewer 70-6 Chan-Estates Sewer & Water 71-3 North Area Sewer & Water Dorn Sewer & Water Lake Ann Trunk Sewer No. 1 Total Cost $50,020 96,384 21,000 90,000 409,596 $667,000 93,000 760,000 Capitalized Interest " CHANHASSEN VILLAGE COUNCIL MINUTES - May 17, 1971 page 4 BOND ISSUE $775,000 (contd): I and, to obtain the best offer for said bonds at public sale, to issue and sell an additional 15,000 principal amount of like bonds together with said bonds pursuant to Minnesota Statutes, Section 475.56. 2. This Council shall meet at the Village Hall on Monday, July 12, 1971, at 8:00 o'clock P.M., to receive, open and consider sealed bids for and award the sale of said bonds on the terms and conditions specified in the following Official Notice of Sale: 3. The Clerk is hereby authorized and directed to furnish a copy of the Official Notice of Sale to any interested person and cause it to be published once in the official news- paper, and once in the Commercial West, a financial periodical published in Minneapolis, both publications to be at least 10 days before the date of said meeting. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Wolf, and upon vote being taken thereon, all present voted in favor thereof, and none voted against the same, whereupon said resolution was declared duly I passed and adopted. PERSONNEL POLICY: The Council agreed to follow the Personnel Policy with regard to hiring of relatives of employees. ASSESSOR: A motion was made by Mayor Coulter that the County Assessor be hired for only 1971. Motion died for lack of a second. TAX STUDY COMMITTEE: Lyle Ricklefs read a list of recommenda- tions from the Tax Study Committee. No action was taken at this time. A motion was made by Councilman Bennyhoff and seconded by Council- man Wolf to adjourn. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf.
