1971 06 07 ~ II I I CHANHASSEN VILLAGE COUNCIL MEETING - June 7, 1971 The special Chanhassen Village Council Meeting was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. Thè Jaycees were present with the reigning Miss Frontier Days to kick off the sale of tickets for the Miss Frontier Day's Pagent, 1971. ------------------------------------------------------------------ PUBLIC HEARING - PRESTIGE DEVELOPMENT CORPORATION The Public Hearing on Prestige Development Corporation was opened. The following persons were present: Tim Bernier, Keith D. Bartz, John Neveaux, Arnold Ryba, Mr. & Mrs. Willard Johnson, Mr. & Mrs. Al Sinnen, Martin Ward, Walt Whitney, Don Goetzman, Sally deLancey, Tom Gabbert, and Claude Sinnen. The Administrator read the official notice of the Public Hearing. Jerry Allen presented the Prestige concept plan. Mr. Martin Ward questioned the use of Township Ordinance #1 and how the new proposed P-2 District would be used. The Village Attorney answered these questions in detail. A motion was made by Councilman Klingelhutz and seconded by Councilman Neils to adjourn the Public Hearing at 9:10 p.m. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Klingelhutz and seconded by Council- man Bennyhoff to defer any action on the PrestigecPublic Hearing until 8:30 p.m. on June 21, 1971. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. The Planning Commission and the Park and Recreation Commission should submit their recommendations before said meeting on June 21, 1971. -------------------------------------------------------------------- CHANHASSEN VILLAGE COUNCIL MINUTES - June 7, 1971 COUNCIL MINUTES~ A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to approve the Council Minutes of May 24, 1971, with the following amendments: Page 1 - FEASIBILITY STUDY - PROJECT 71-4: insert the word "time" in the phrase "set the time for the Public Hearing .....". ~ CHANHASSEN VILLAGE COUNCIL MINUTES - June 7, 1971 -2- COUNCIL MINUTES: (contd) I Page 2 - NORTHERN STATES POWER: insert the name of the Resolution, "Resolution Relating to Northern States Power Company Electric Rate Increase". The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Klingelhutz and seconded by Councilman Wolf that the Planning Commission Minutes of May 25, 1971, be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. SIGN ORDINANCE #36 (CONOCO STATION): A motion was made by Councilman Klingelhutz and seconded by Councilman Wolf to grant John Havlik (Conoco Station) a variance for his revolving sign for the following reasons: It is not a flashing sign. It was in existance prior to the passing of Ordinance #36 and Mr. Havlik feels it is necessary for communicating to the public the varying hours of his operation. The variance would be for the existing sign only and would not extend beyond the life of the existing sign. The following voted in favor thereof: Mayor Coulter, I Councilmen Bennyhoff, Klingelhutz and Wolf. Councilman Neils voted no. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Klingelhutz that the Park and Recreation Commission Minutes of June 1, 1971, be noted and read. The following voted in favor thereof: Mayor Coulter Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. PARK AND RECREATION PROGRAM (PERSONNEL POLICY): Park and Recreation Chairman Arnold Weimerskirch was present to discuss the problems with relationship to hiring brothers for the Summer Recreation Program. A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz that meeting be set up with the Personnel Advisory Committee and whatever decision is made at that time, with re~~rd to the hiring of brother for the Summer Recreation Program, would be final. The following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. Mayor Coulter voted no. Motion carried. WAYNE KELM (COMPLAINT ON WANNINGER BODY SHOP): Mr. Kelm stated I that he was not necessarily against the body shop but is against the accumulation of old cars and junk. ~ ( I I I ~ CHANHASSEN VILLAGE COUNCIL MINUTES - June 7, 1971 -3- WAYNE KELM (contd): A motion was made by Councilman Bennyho££ and seconded by Councilman Wolf that the Administrator and the Village Attorney meet with Mr. Wanninger to see what can be done and the Village AttoDney is hereby authorized to proceed with whatever steps are necessary to correct this problem. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. WATER EXPANSION FUND: A motion was made by Mayor Coulter and seconded by Councilman Bennyhoff that Well #2 Bond payments be paid out of the water expansion fund. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. WATER AND SEWER RATES: WATER RATES: A motion was made by Mayor Coulter and seconded by Councilman Bennyhoff that the Chanhassen municipal water usage charge is hereby established as follows: a) $7.50 minimum charge per quarter, and b) $0.40 per 1,000 gallons or fraction thereof consumed from 10,001 to 40,000 gallons, and c) $0.35 per 1,000 gallons or fraction thereof consumed in excess of 40,000 gallons. The following voted in favor thereof: Mayor Coulter, Council- men Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. SEWER RATES: A motion was made by Mayor Coulter that the sanitary sewer usage charge applicable to premises connected to the municipal water system is hereby established to be $7.50 per quarter plus 55 cents for each 1,000 gallons or fraction thereof of water consumed up to 40,000 gallons and thereafter 45 cents per 1,000 gallons. Motion died for lack of a seoond. A motion was made by Councilman Klingelhutz and seconded by Councilman Wolf that the sanitary sewer usage charge applicable to premises connected to the municipal water system is hereby established to be $7.50 per quarter plus 50 cents for each 1,000 gallons or fraction thereof of water consumed per quarter in excess of 10,000 gallons. The following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. Mayor Coulter voted no. Motion carried. A motion was made by Mayor Coulter and seconded by Councilman Neils that ~he sanitary sewer usage charge for single family residences not connected to the municipal water system is hereby established to be $15.00 per quarter and the sanitary sewer usage charge for apartment buildings not connected to the municipal water system is hereby established to be $10.00 per quarter for each two-bedroom apartment and $7.50 per quarter for each one-bedroom or efficiency apartment. ~ I I CHANHASSEN VILLAGE COUNCIL MINUTES - June 7, 1971 -4- , SEWER (contd): The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. I A motion was made by Mayor Coulter and seconded by Council- man Neils that the sewer usage charges relate to water consumption forthe first, second and fourth quarters and the third quarter to be the same as the second quarter on all residents. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Mayor Coulter and seconded by Council- man Neils that all the above rates be effective on the July 1, 1971, statements. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. HOOKUP CHARGES (UNIT CHARGES): A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff that the unit charges (hookup charges) be set at $320.00 per unit for sewer and $380.00 per unit for water, effective August 1, 1971. These units hereafter will be adjusted in accordance with the Engineers News Index Record. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. I LEAGUE CONVENTION: A motion was made by Councilman Klingelhutz and seconded by Mayor Coulter to authorize any of the Council and the Administrator to attend the League of Minnesota Munici- palities Convention with all expenses to be paid by the Village. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
