CHANHASSEN VILLAGE COUNCIL MINUTES - June 14, 1971
The regular Chanhassen Village Council meeting on June 14, 1971,
was opened with the Pledge to the Flag. The following members
were present: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz,
Neils and Wolf.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Bennyhoff and secondéd~by Councilman Neils that the Planning
Commission Minutes of June 8, 1971, be noted and read. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes.
Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Neils and seconded by Councilman Bennyhoff that the
Park and Recreation Commission Minutes of June 7, 1971, be
noted and read. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf.
No negative votes. Motion carried.
PARK AND RECREATION: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils to hire Linda Yanisch for the
Summer Recreation Program for the amount of $85.00. The follow-
ing voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
K1ingelhutz, Neils and Wolf. No negative votes. Motion carried.
BLUFF CREEK HIGHLANDS (VARIANCE REQUEST FROM ORDINANCE #45):
General discussion on the perculation tests submitted and the
Engineer's reports.
A motion was made by Councilman Neils and seconded by Councilman
Wolf to table any action on this variance request until a report
is obtained from the Soil Conservation District (Don Berg), a
more detailed report from the Village Engineer and specific
comments from the Park and Recreation on how this affects the
park concept and the flood plain. All to be submitted back to
the Council at the June 21, 1971, meeting. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1ingelhutz,
Neils and Wolf. No negative votes. Motion carried.
CHANHASSEN ESTATES 2ND: A motion was made by Councilman
Klinge1hutz and seconded by Councilman Neils to table any decision
on the contract with Fox & Weiler and the development contract
for Chanhassen Estates 2nd until approval from the P.C.A. has
been received on the sewer and water extension. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
The Administrator is to contact the P.C.A.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Neils to rescind the former motion. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
K1inge1hutz, Neils and Wolf. No negative votes. Motion carried.

CHANHASSEN ESTATES 2ND (contd): A motion was made by Councilman I
Klinge1hutz and seconded by Councilman Wolf to authorize the
Mayor and the Clerk to sign the Chanhassen Estates 2nd Development
Contract and the contract with Fox & Weiler for project 71-3,
upon written approval on said project from the P.C.A. and the
Village Attorney. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
The Administrator is to notify Fox & Weiler that the P.C.A. has
not given approval, at this time, and if he proceeds with this
project without approval, he will be proceeding at his own risk.
ORDINANCE #36-B: A motion was made by Councilman Bennyhoff and
seconded by Councilman Wolf to approve Ordinance #36-B (amending
sign ordinance #36, as submitted). The following voted in favor
thereof: Councilmen Bennyhoff, Klinge1hutz,
Neils and Wolf. Mayor Coulter voted no. Motion carried.
Mayor Coulter stated the reason for his no vote was that the
final draft was not submitted to the Chamber of Commerce prior
to final adoption.
CENSUS BILL: A motion was made by Councilman Wolf and seconded
by Councilman Klingelhutz that the Village Attorney draft up I
a Resolution approving the action that the Legislature has taken
concerning our Census Bill. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and
Wolf. No negative votes. Motion carried.
FIRE DEPARTMENT: A motion was made by Councilman Bennyhoff and
seconded by Councilman Wolf to authorize the advertising for bids
for the new Fire Department pumper, as per specifications sub~
mitted. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative
votes. Motion carried.
SOLID WASTE ORDINANCE: General discussion on the proposed Solid
Waste Ordinance. The Village Attorney is to revise and submit,
back to the Council, a final draft.
STORM SEWER: A motion was made by Mayor Coulter and seconded
by Councilman Neils to authorize the Village Engineer to prepare
a study on the area affected by the outfall of the main storm
sewer. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative
votes. Motion carried.
BUSINESS DISTRICT: A motion was made by Councilman Wolf and I
seconded by Councilman Bennyhoff that the Council endorse the
Planning Commission's concept of forming a committee of members
from the Council, Planning Commission and Chamber of Commerce to
survey the business district and the needs in the ensuing years.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.

CARVER BEACH AND RED CEDAR POINT: A motion was made by
Councilman Wolf and seconded by Councilman Bennyhoff that the
Council endorse the Planning Commission's concept of forming a
committee of members of the Planning Commission, Park and
Recreation Commission and representatives of the two areas
to survey these areas and the needs in the ensuing years. The
following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klinge1hutz, Neils and Wolf. No negative votes.
Motion carried.
KNOLLWAY ESTATES: The Administrator is to discuss the road in
Knollway Estates with the Maintenance Superintendent and submit
back to the Council for their recommendations.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Neils to adjourn. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
