1971 06 21 ~ I I I ~ CHANHASSEN VILLAGE COUNCIL MINUTES - June 21, 1971 The regular Chanhassen Village Council Meeting on June 21, 1971, in the Chanhassen Village Hall was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Council- men Bennyhoff, Neils and Wolf. Councilman Klingelhutz was absent. COUNCIL MINUTES: A motion WãS made by Councilman Bennyhoff and seconded by Councilman Wolf that the Council Minutes of June 7, 1971, be approved. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. WANNINGER BODY SHOP: The Village Attorney reported on the status of his research to date. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that the village Attorney be authorized to institute such legal action as he feels appropriate under the circumstances to abate violations of zoning by Dale Wanninger. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. Councilman Klingelhutz arrived. COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils that the Council Minutes of June 14, 1971, be approved. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Klingelhutz that the Park and Recreation Commission Minutes of June 15, 1971, be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. MAINTENANCE DEPARTMENT: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf authorizing the hiring of one additional, temporary man for the Maintenance Department. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. BOND RATING: A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz to table any action on authorizing Moodys to rate our upcoming Bond Issue. The following voted in favor there- of: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. PRESTIGE DEVELOPMENT CORPORATION (contd): M&MARTIN WARD: I would like the Minutes to reflect that I am not in any way waiving my rights on future road pro- posals or needs. I A motion was made by Councilman Bennyhoff and seconded by Council- man Wolf to grant formal approval, subject to the Village Attorney and Prestige Development Corporation's final agreement on the statement of intent. Property to be zoned as P-2, under the proposed Zoning Ordinance with a zoning contract. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. BLUFF CREEK HIGHLANDS (ORDINANCE #45 VARIANCE REQUEST): A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to grant the variance to Ordinance #45, to Mr. Paul Steiner, for Section 2.02 of Ordinance #45, reducing the size of four (4) lots to the following: Lot 1 - 33,000 square feet Lot 2 - 38,000 square feet Lot 3 - 29,500 square feet Lot 4 - 29,500 square feet Stipulating that the northwest property line on Lot 2 be moved I approximately 30 feet southeast. This approval is given on the basis of the proposed Concept Plan for Bluff Creek Highlands 2nd, dated May 13, 1971, subject to the formal approval of the plat. This action taken under Section 4.01, Hardship clause for a total of 9.6 acres are being divided into 4 lots and 1 outlot. The outlot will not be developed. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz and Wolf. Councilman Neils voted no. Motion carried. UTILITY DEPARTMENT: A motion was made by Mayor Coulter 'and seconded by Councilman Klingelhutz to hire Mark Bielski as of June 21, 1971, at a salary of $2.50 per hour. The fÒllQwing voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. . A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to raise Jerry Schlenk's salary to $675.00 per month as of July 1, 1971, due to his receiving a Class "c" Water Operator's License. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. POLICE REPORT: Sergeant Wallin gave his monthly report. He brought to the Council's attention, the miscellaneouseproblems on Rose Lane. I ~ r-- I I I ~ CHANHASSEN VILLAGE COUNCIL MINUTES - June 21, 1971 -3- POLICE REPORT (contd): A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff that a sign be placed on Christmas Lake at the Rose Lane (62nd Street) access point, stating "No Swimming After 10:00 p.m.". The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Mayor Coulter and seconded by Councilman Bennyhoff to authorize the Police Department to take whatever steps necessary in regulating the chain on Christmas Lake (Rose LAne). The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. BILLS: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to approve the bills as submitted. Also authorizing payment for weekly treats for the Summer Recreation Program. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. WARRANT: Councilman Bennyhoff moved the adoption of the following Resolution: BE IT RESOLVED that the following bills be paid by a warrant: GENERAL FUND: Schoell & Maason- 1971-3, Ck# 2469 -- $3,304.00 GENERAL FUND: Soil Engr. Service-1969-l, Ck# 2470 -- $4,174.50 RESOLUTION SECONDED BY Councilman Klingelhutz. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. SEWER AND WATER RATES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to adopt Resolution #621711, entitled "RESOLUTION ESTABLISHING SEWER AND WATER RATES". The following 'voted in favor thereof: Mayor Coulter, Councilmen BennyhofÎ"Klingelhutz, Neils and Wolf. No negative votes. Motion carried. NORTH SERVICE AREA: The Village Engineer gave a report on project areas that could be set as priority areas. The Administrator was instructed to send a copy of report to the Fiscal Agent. Also to sta~t getting mailing addresses of property owners that'will be affected by this project. COMPREHENSIVE SEWER TRUNK STUDY: A motion was made by Mayor Coulter and seconded by Councilman Klingelhutz to authorize the Village Attorney to set up a contract with Brauer & Associates, naming them as the planner to prepare a report on the comprehensive trunk study. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. . The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. negative votes. Motion carried. The Administrator to contact our County Commissioner and our Representative and Senator. OLD VILLAGE HALL: A motion was made by Mayor Coulter and seconded by Councilman Neils that Fran Michelson be released from her lease on the Old Village Hall as, of July 1, 1971. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. The Administrator to contact the Park and Recreation Commission and the Historical Committee concerning the use of the. Old Village Hall for a historical site. CHRISTMAS LAKE: The Administrator informed the Council of some complaints that he has received on the pollution of Christmas Lake. Some tests have been taken and additional tests were taken on I June 21, 1971. The Council will be notified as soon as these reports are available.
