CHANHASSEN VILLAGE COUNCIL MINUTES - July 26, 1971
A special Chanhassen Village Council meeting on July 26, 1971, in the Chanhassen
Village Hall was convened at 8 p. m. by Mayor Coulter. The following members
were present: Mayor Coulter, Councilmen Klinge1hutz, Neils and Wolf. Council-
man Bennyhoff was absent. All formalities were dispensed with.
ACTING CLERK: A motion was made by Councilman Klingelhutz and seconded by
Councilman Wolf that Russell H. Larson be appointed acting Village Clerk in the
absence of Mr. Tessness. The following voted in favor thereof: Mayor Coulter,
Councilmen Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
FIRE TRUCK BIDS: Assistant Fire Chief John Kreger discussed the fire truck bids with
the Council. A motion was made by Councilman Klingelhutz and seconded by Coun-
cilman Wolf that the Assistant Fire Chief, the Village Attorney and the Fire Committee
of the Council consisting of Councilmen Klingelhutz and Bennyhoff review the bids
and report back to the Council in one week. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
ROSE LANE: Robert Bowen, William King and Malvin Herz, residents of the Christmas
Lake area, commented on the policing problems at Rose Lane. The Village Attorney
listed possible solutions of the Rose Lane problem, including vacation of the lake end
of the road I but he cautioned that this might be a controversial remedy. Councilman
Wolf suggested the Christmas Lake Association investigate the possibility of acquiring
the Hennepin County well site located at the lake end of the road. Councilman Klingel-
hutz stated that he would vote against vacating any part of Rose Lane until Chanhassen
had established a swimming beach. He pointed out that he had heard from approxi-
mately six persons opposing the vacation of the road. Further, he feels that Chan-
hassen should take steps to acquire the Hennepin County site. Councilman Neils
recommended that the Village discuss the Rose Lane problem with Shorewood in an
attempt to seek a solution to the problems presented by the road. Mayor Coulter
spoke against vacating any lake shore access, pointing out that people who do not
have lake shore should have the right to enjoy lake shore public access. He further
feels that the use of the chain to govern acces s to the lake should be continued and
that he would vote against vacation of the road. Sgt. L. Wallin advised that the Police
Department records for the period from June 1 to July 23,1971, showed that 31 parking
tags were issued on Rose Lane and that there were approximately 28 calls during said
period to open the chain.

CHANHASSEN ESTATES 2nd ADDITION. The Village Attorney advised that the final plat
of Chanhassen Estates 2nd Addition was ready for approval subject to acceptance by
the Council of the deeds conveying Outlots Band C to the Village, containing a
reservation as to Outlot B that the grantor would have the right for five years to im-
prove the lot for recreational purposes I and with a reservation in the deed of Out-
lot C to allow the developer to construct a channel from Rice Marsh Lake across

Outlot C to Outlot B at any time during a 3-year period.
There was discussion by the Council to the effect that these reservations in the
deeds were new to the Council, and that the Council could not act on the approval of
the plat or acceptance of the deeds until it had received the views of the Village Park
and Recreation Committee. A motion was made by Councilman Klingelhutz and
seconded by Councilman Neils that the Council defer approval of the final plat and
acceptance of the deeds until recommendations of the Park and Recommendation
Committee are received by the Council. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
NSP RATE INVESTIGATION COMMITTEE. Mayor Coulter reported that the Northern States
Power rate investigation committee had received a financial commitment of $5,000 from
NSP to investigate the employment of a rate consultant.
RILEY-PURGATORY CREEK WATERSHED DISTRICT MANAGERS MEETING. The Village
Clerk was instructed to supply to each member of the Council a copy of the agenda of
the proposed meeting of the Watershed District Board with the Council, and that the
agenda should be supplied by the Clerk by the Friday preceding the meeting.
URBAN-RURAL TAX CLASSIFICATION ORDINANCE. A motion was made by Councilman
Neils and seconded by Councilman Wolf that a Council Committee consisting of Mayor
Coulter and Councilman Klingelhutz be appointed to consider changes in the Urban-
Rural Tax Classification Ordinance. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
LAKE VIEW HILLS SEWER PROJECT PLANS. Councilman Klingelhutz requested a report
from the engineers on the status of the Lakeview Hills sewer project plans. He pointed
out that he has received calls from Lake Riley residents asking for a progress report on
this project.
COUNTY LIBRARY SYSTEM. A motion was made by Councilman Neils and seconded by
Councilman Wolf that the Village Council approve the establishment of a county library
sys tem. The following voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
WHEELAGE TAX. Mayor Coulter spoke in favor of the Carver County Board assessing a
wheelage tax.
A motion was made by Councilman Neils I seconded by Councilman Wolf, to adjourn.
The following voted in favor thereof: MayouH Councilmen Klingelhutz, Neils
and Wolf. No negative votes. Motion rried.
