CHANHASSEN VILLAGE COUNCIL MINUTES - August 30, 1971
The special Chanhassen Village Council Meeting on August 30, 1971,
was opened with the Pledge to the Flag. The following members
were present: Mayor Coulter, Councilmen Bennyhoff, Klinge1hutz,
Neils and Wolf.
COUNCIL MINUTES: A motion was made by Councilman K1ingelhutz and
seconded by Councilman Neils to approve the Minutes of August 16,
1971. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, K1ingelhutz, Neils. No negative
votes. Motion carried. Councilman Wolf abstained because he
was absent.
The Mayor stated that the Minutes should reflect that on page 2,
Knol1way Estates, the word blacktop should be deleted.
Councilman Klingelhutz stated that he had not talked to Mr. Shorba
yet.
SNOW PLOWING: General discussion on plowing of snow on roads that
have not been accepted for Maintenance.
Councilmen K1ingelhutz and Neils were appointed as a committee to
study this and report back at the next meeting.
DRAINAGE PROBLEM (GOULETT): The Maintenance Superintendent explained
what the problem is and how he feels the problem can be resolved.
The Village Engineer was instructed to look into this and report
back to the Council.
AL BARNACLE: A motion was made by Councilman Neils and seconded
by Councilman Klingelhutz to adopt the following Resolution #830711:
That Mr. Barnacle as a charter member of the Chanhassen
Planning Commission and later its Chairman, helped to
guide the Village in orderly development.
That his knowledge, dedication and integrety have enriched
this community.
That the Village of Chanhassen extends its condolences to
the family of Mr. Albert Barnacle.
The following voted in favor thereof: Mayor Coulter, Councilmen
Báhnyhoff, Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
KENNEL APPLICATION: Mrs. Weber was present to explain her request.
A mbtion was made by Mayor Coulter and seconded by Councilman
K1ingelhutz to recommend that the Webers apply for a Conditional
Use Permit for a commercial kennel., The following voted in
favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
This Conditional Use Permit would require a public hearing.

BLUFF CREEK HIGHLANDS 2ND ADDITION: John Neveaux, Chairman of
the Planning Commission, gave the Planning Commission's reco-
mendations.

Paul Steiner stated that he would not give Outlot A to the Village
free of charge. He stated he would agree to some specific terms
such as, 1/3 down and two equal payments of the balance or four
payments of $500.00 each plus 5% interest.
Sally deLancey stated, as a member of the Park and Recreation
Commission, that they did not plan to spend any money at this
time for this Outlot.
A motion was made by Councilman Wolf and seconded by Councilman
Bennyhoff to accept the preliminary plat of Bluff Creek Highlands
2nd Addition and authorize the Village to enter into an agreement
to purchase Outlot A in four, $500.00 payments with 5% interest
on the unpaid balance. The following voted in favor thereof:
Councilmen Bennyhoff, K1ingelhutz and Wolf. Mayor Coulter and
Councilman Neils voted no. Motion carried.
Councilman Neils explained that she voted no because Outlot A,
in her opinion is unbuildable land.
Mayor Coulter stated that he voted no because he felt that there
should have been a motion on each question.

Councilman K1ingelhutz stated that the reason he voted yes was,
once the variance had been granted to Ordinance #45, with the
understanding that we would purchase this 6 acre tract of land,
we were obligated to purchase this lot at this time.
PROJECT 71-4 (DORN): Bids for this project were opened at 2:00 p.m.,
August 26, 1971. Correct bid tabulations as submitted by the
Engineer were as follows:

A motion was made by Councilman Bennyhoff and seconded by Councilman
K1ingelhutz to accept the low.bid of $56,780.00 from G. & L.
Contracting, Inc., of Hopkins, subject to a letter of approval from I
the PCA. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative
votes. Motion carried.

1971 CENSUS: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils to authorize the Village Treasurer
to write a c~eck for $1,405.00 to the Bureau of the Census and
authorize the Mayor to sign a formal agreement with the Bureau
of the Census. The following voted in favor thereof: Councilmen
Bennyhoff, K1ingelhutz, Neils and Wolf. Mayor Coulter voted no.
Motion carried.
THe Administrator is to have seven (7) maps of the Village
available and certify that they are official.
SOUTHWEST SERVICE AREA ADVISORY BOARD: A motion was made by
Councilman Bennyhoff and seconded by Councilman Klingelhutz
to appoint Councilman Wolf to serve as~a;member of the Southwest
Service Area Advisory Board. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff,· Klingelhutz, Neils
and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Bennyhoff to appoint Adolph Tessness the alternate member of
the Southwest Service Area Advisory Board. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Neils,
Klingelhutz, and Wolf. No negative votes. Motion carried.

SEWER RATES: A motion was made by Councilman Bennyhoff and
seconded by Councilman Klingelhutz to set a minimum sewer rate
for the State Bank of Chanhassen for the 2nd and 3rd quarters
because of the unusual amount of water being used on their lawn.
The following voted in favor thereof: Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. Mayor Coulter abstained as he
is on the Board of the Bank. No negative votes. Motion
carried.
SOLID WASTE ORDINANCE: Councilman Wolf asked when this Ordinance
would be available.
The Village Attorney stated that it would be completed in
approximately 3 weeks.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Neils to adjourn. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Neils and Wolf. No negative votes. Motion carried.
