1971 09 13 ~ I I I CHANHASSEN VILLAGE COUNCIL MINUTES - September 13, 1971 The regular Chanhassen Village Council Meeting on September 13, 1971, in the Chanhassen Village Hall, was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. COUNCIL MINUTES: A motion was made by Councilman Neils and seconded by Councilman Bennyhoff to approve the Minutes of the August 30, 1971, meeting with the following amendments: page 1 Council Minutes- Councilman Wolf abstained as he was absent from the August 16, 1971 meeting. page 3 Sewer Rates - Addition. Councilman K1inge1hutz brought to the Council's attention, that numerous persons had contacted him concerning the sewer charges on residents using their own water systems. page 3 Census - Addition. The reason Mayor Coulter voted no was that he felt that the Census would not be complete in 1971 and could not be certified by the State by the end of the year. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman K1inge1hutz and seconded by Councilman Neils that the minutes of the August 24, 1971, Planning Commission Meeting be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the minutes of the August 17, 1971, Park and Recreation Commission Meeting be noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. COMMECTION TO MUNICIPAL SEWER AND WATER SYSTEM: A number of residents were present objecting to the letters that the Ad- ministrator sent, requiring them to connect to the municipal sewer and water system as per Ordinances 5 and 6. The Mayor stated that the Administrator had not been given specific instructions to send these letters. ,A motion was made by Mayor Coulter and seconded by Councilman Klingelhutz that the letters sent by the Administrator, to the residents of the village, requiring them to connect to the municipal water and seWer be rescinded. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. -, CHANHASSEN VI~LAGE COUNCIL MINU~ER - Se~temÞe~ ~3, L97¡ !?~c;¡e 2 CONNECTION TO MUNICIPAL SEWER AND WATER SYSTEM: (contd) I A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff that individuals with private water systems be allowed to install a meter for the purpose of setting their sewer rate. This policy would in no way hinder the enforcement of the sewer and water ordianaces in the interest of public health. The following voted in favor thereof: MAyor Coulter, Councilmen Bennyhoff, K1inge1hutz, Neils and Wolf. No negative votes. Motion carried. OAKMONT: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to approve the zoning agreement as amended, with the new proposed P-2 District. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. In answer to Mr. Lybeck's inquiry as to when the new Zoning Ordinance would be adopted, the Village Attorney stated that he felt that the Ordinance would be adopted sometime this fall. SHORBA HOUSE: Mrs. Shorba was present requesting that this matter be deferred until a later date as Mr. Shorba was unable to attend. The Council stated that they would defer this item until September 27, 1971 at 10:00 p.m. BUILDING PERMIT APPLICATION: The Building Inspector denied a permit application by Hansen & Klingelhutz Construction for part of Lot 43 and 44, Pleasant View Addition, because Ordinance 45 requires that a private disposal system cannot be placed closer than 125 feet from the lakeshore. I The Board of Adjustments and Appeals met at the proposed building site to consider a variance. However, they felt in their judgement that they could not make a recommendation until they have received a detailed report from the Village Engineer. A motion was made by Councilman Wolf and seconded by Councilman Klingelhutz to instruct the Village Engineer to review the proposed septic system and submit his recommendations at the next meeting. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. SPECIAL STREET COMMITTEE: Councilman Klingelhutz explained to the Council that the Committee had reviewed a number of streets that were under consideration. It appears that at sometime in the past, the Township did maintain the road past the Hedstream property (the east postion of Ivy Street, as shown on the Carver Beach plat map) . I ~ I I I CHANHASSEN VILLAGE COUNCIL MINUTES - September 13, 1971 page 3 SPECIAL STREET COMMITTEE (contd): A motion was made by Councilman Klingelhutz and seconded by Councilman Neils that the Village accept for maintenance, the east portion of Ivy Street as shown on the original Carver Beach Plat between street named Park Drive and Lakeview Drive. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Klingelhutz and seconded by Councilman Neils that the drainage problem along Lake Riley Blvd. be placed on the Agenda for next week and the affected property owners be notified. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. ANIMAL CONTROL: A number of residents were present, from Red Cedar Point, objecting to the Kennel Permit Application submitted by Mr. & Mrs. Ronald Weber. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Administrator be instructed to inspect the property and submit a report at the next meeting. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. This item to be on the Council Agenda at 8:10 p.m. on September 20, 1971. STREET LIGHT: A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to approve the installation of a 250 watt, mercury vapor street light at the corner of Orchard Lane and Highway 7. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. CONDITIONAL USE PERMIT: A motion was made by Councilman Benny- hoff and seconded by Councilman Wolf to approve the renewal of a Conditional Use Permit for Fenstermaker Antique Shop for a period of one (1) year. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. GEDNEY PICKLE COMPANY: Councilman Klingelhutz explained the situation whereby the City of Chaska has requested that the Gedney Pickle Company become detached from the Village of Chanhassen and be annexed to the City of Chaska. A motion was made by Councilman Bennyhoff and seconded by Councilman Klinge1hutz that the minutes reflect that the Village of Chanhassen is not willing to detach the Gedney Pickle Co. property from the Village of Chanhassen. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes, Motion carried/ ~ I ; I CHANHASSEN VILLAGE COUNCIL MINUTES ~ S~~temÞe~ ~3, 1971 r~ge 4 S~NITARY LANDFILL: The Village Administrator informed the Council I of the complaint that has been filed with the Metropolitan Council, concerning the sanitary landfill on the Frontier property, just west of Animal Fair. A letter was sent to Mr. Bloomberg on August 30, 1971, confirming the ~elephone conversation in which the Administrator informed Mr. Bloomberg that no further dumping would be allowed. A motion was made by Councilman Wolf and seconded by Councilman Neils that the Village Council enforce the action as stat ed in the letter dated August 30, 1971, to Mr. Bloomberg. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
