1972 01 03 I I I CHANHASSEN VILLAGE COUNCIL MINU'J:'ES - J~nua.;¡:;-y 3,;1.972 The Chanhassen Village Council meeting on January 3, 1972, was opened with the Pledge to the Flag. The following members were present: Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. COUNCIL MINUTES: A motion was made by Councilman Wolf and seconded by Councilman Neils to approve the Council Minutes of December 20, 1971. The following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. PUBLIC HEARING: A motion was made by Councilman Neils and seconded by Councilman Bennyhoff that the Public Hearing Minutes of December 15, 1971, be noted and read. The following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Park and Recreation Commission Minutes of December 21, 1971, be noted and read. The following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion carried. ITEMS TO BE ACTED UPON THE FIRST MEETING IN JANUARY: A motion was made by Councilman Wolf and seconded by Councilman Neils to accept Councilman Klingelhutz's resignation and declare the office formerly held by him vacant. The following voted in favor thereof: Councilmen Bennyhoff, Neils and Wolf. Councilman Klingelhutz abstained. Motion carried. OATH OF OFFICE: Oaths of office were taken by newly elected Mayor Klingelhutz, Councilman Bennyhoff and Councilwoman Neils. All oaths were signed and filed with the Village Clerk. ACTING MAYOR: A motion was made by Councilman Neils and seconded by Councilman Wolf that Councilman Bennyhoff be appointed Acting Mayor to serve in the absence of the elected Mayor. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. RULES OF ORDER: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that the Village adopt the procèdures set forth in the Handbook for Minnesota Villªges and use the revised edition of Roberts Rules of Order to supplement. CHANHASSEN VILLAGE COUNCIL MJ:NUTES - Ja.nuary 3, ;1,972 -2- OFFICIAL NEWSPAPER: A motion was made by Councilman I Bennyhoff and seconded by Councilman Neils that the Excelsior-Deephaven Sun be the Village of Chanhassen's official newspaper until March 19, 1972, when the Carver County Sun shall become the official Village newspaper. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. OFFICIAL BANK: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that the State Bank of Chanhassen be designated as the official depository for all Village monies. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. The Minutes should reflect that none of the Councilor the Mayor are officers, directors or shareholders in the State Bank of Chanhassen. MEETING NIGHTS: A motion was made by Councilman Neils and seconded by Councilman Bennyhöff that the regular Village Council meeting nights be the first and third, Monday, of every month at 8:00 P.M. Motion carried. : AGENDA SYSTEM: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that all meetings be conducted on the agenda system and said agenda to be closed on Thursday, 1:00 P.M., prior to the next meeting. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. VILLAGE ATTORNEY: A motion was made by Councilman Neils and seconded by Councilman Wolf that Russell H. Larson be appointed the Village Attorney at a fee rate to be charged on an hourly basis. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. FINANCIAL CONSULTANT: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that Ehlers and Associates be appointed as Financial Consultant. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. AUTOMATIC BILLS: A motion was made by Councilman Wolf and I seconded by Councilman Bennyhoff that all utility bills, salaries and wages be paid automatically. Salaries and wages shall be payable on the 1st and the 15th of every month. Overtime shall be paid on the next pay period after submitted. COUNCIL SALARIES: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils that the Village Council salaries be set according to MSA 421.181, Sub. 1-9, as follows: Mayor, $50.00 per month; Councilmen, $35.00 per month, shall be paid quarterly. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. PURCHASING: A ,motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that purchasing may be made by the Clerk-Administrator up to $500.00, subject to approval of Council, in each case, prior to payment. FINANCIAL AUDIT: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils that the firm of Hoffman and Hoffman be hired to prepare the audit to be presented to the Council no later than June 30, 1972. Treasurer 2. Mayor 3. Clerk-Administrator To enter the safety deposit box it shall be required that two of the three persons sign the entrance card. ENVIRONMENTAL COMMITTEE: A motion was made by Councilman Wolf and seconded by Councilman Neils that Fritz Coulter be appointed to the Environmental Committee. INDUSTRIAL COMMISSION: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to appoint Eugene Coulter to the Industrial Commission for a term of three years. Motion carried SHO~A HOUSE: A motion was made by Councilman Neils and seconded by Councilman Wolf to authorize the Village Attorney to start formal action to remove the Shorba house. Motion carried. ~ CHANHASSEN VILLAGE COUNCIL MINUTES - January 3, 1972 -6- BLUFF CREEK HIGHLANDS: A motion was made by Councilman Benny- hoff and seconded by Councilman Neils that the certified check in the amount of $5,120.00 be reduced to $2,000.00, based upon the Village Engineer's letter dated December 14, 1971. The $2,000.00 be retained by the Village for a period of two years. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. No negative votes. Motion carried. I I PERSONNEL POLICY: A motion was made by Councilman Wolf and seconded by Councilman Neils that the following amendment to the Personnel Policy be adopted: Section 5, Probationary Period, subsection D. Affects Leave Benefits. During the initial probationary period, but not during a promotional probationary period, an employee will not be entitled to sick leave or vacation leave. SKATING RINKS: General discussion on maintaining skating rinks on lakes and ponds. No Village Maintenance trucks, tractors, etc., will be allowed on any lake or ponds to maintain skating rinks. WESTERN CONCRETE: A motion was made by Councilman Wolf and seconded by Councilman Neils to require Western Concrete to fill out an application stating how they will maintain the deposit area and that only inorganic material will be allowed.
