1972 02 07 ~ II II II ~ j CONTINUATION OF PUBLIC HEARING - NORTH SERVICE AREA - 7:30 P.M. - FEBRUARY 7, 1972 The continuation of the public hearing on the North Service Area was opened at 7:30 p.m., February 7, 1972. The following Village Council members were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. The following interested persons were present: Robert J. Lindberg, Timothy C. Hegman, Mr. & Mrs. Frank J. Natole, Mrs. Warren Schram, M. R. Rogers, Mr. & Mrs. Henry R. Kober, Mr. & Mrs. Robt. Beaugrand, G. W. Pope, E. L. Nubson, Harriet Nubson, J. C. The Village Attorney asked the Clerk-Administrator if all petition signers had been verified as property owners in the village of Chanhassen. Answer no. Questions were asked by a number of persons present about their area and the costs that 'they may be assessed. A motion was made by Councilman Bennyhoff and seconded by Councilman WoIf to close the public hearing for the North Service Area. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. Public Hearing closed at 9:30 p.m. ---------------------------------------------------------------------- CHANHASSEN VILLAGE COUNCIL MINUTES - February 7, 1972 The regular Chanhassen Village Council Meeting was called to order at 9:30 p.m., February 7, 1972, in the Chanhassen Village Hall. A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to dispense with all formalities. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. NORTH SERVICE AREA: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that on February 28, 1972 at 8:10 p.m., the Council will discuss in detail the North Service Area and at 8:10 p.m., March 6, 1972, they will take final action. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. ,..... CHANHASSEN VILLAGE COUNCIL MINUTES - February 7, 1972 -2- ORDINANCE #34: A motion was made by Councilman Neils and seconded by Councilman Wolf to adopt Ordinance #34-A entitled, "An Ordinance Amending Section 10 of Ordinance No. 34, Adopted February 24, 1969, and Entitled IAn Ordinance Licensing and Regulating the Sale and Consumption of Non-Intoxicating Malt Liquors and Providing a Penalty for the Violation Thereof'''. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. VALLEY AUTO PARTS: Mr. Miller was present representing Valley Auto Parts and explained what would be done. A motion was made by Councilman Wolf and seconded by Councilman Kurvers to set the date for the Public Hearing for 7:30 p.m., February 28, 1972, for a Conditional Use Permit for Valley Auto Parts. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Council- man Wolf to dispense with the Agenda. The followin g voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. ZONING ORDINANCE: The Zoning Ordinance was discussed in detail. A motion was made by Councilman Bennyhoff and seconded by Council- man Wolf that the rezoning map indicate that all of Section 36, north of Hwy 212, east of Hwy 101 and South of the Chicago, North- western Railroad be designated as the C-3 District. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Neils to approve Ordinance #47 entitled, "An Ordinance to Promote the Health, Safety, Order, Convenience and General Welfare by Regulating the Use of Land, the Location and the Use of Buildings and the Arrangement thereof on Lots, and the Density of Population in the Village of Chanhassen, Minnesota", as submitted and amended and to authorize the Mayor and the Clerk to sign said Ordinance. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. RED CEDAR POINT: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff authorizing the Village Planner to procede with a development plan for Red Cedar Point, not to exceed $750. Ballhorn under the Emergency Employment Act, as General Administrative Trainee. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. BUILDING PERMIT APPLICATION: The Building Inspector presented an application for a building permit for John Clark, stating that the Council must grant a variance to Ordinance #45, Section 2, Subsection 2.02 before a building permit can be issued. The Council discussed the Palmer property and the subjects property at some length and decided no action would be taken until the Administrator has discussed the platting problem with Mr. Palmer. METROPOLITAN SOLID WASTE DISPOSAL SEMINAR: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils that the Village pay for registration and meeting expense for the Mayor and Councilman Wolf to attend. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative vote5. Motion carried.
