CHANHASSEN VILLAGE COUNCIL MINUTES - March 20, 1972
The regular Chanhassen Village Council Meeting was opened with
the Pledge to the Flag. The following members were present:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf.
COUNCIL MINUTES: A motion was made by Councilman Wolf and seconded
by Councilman Kurvers to approve the Minutes of March 6, 1972.
The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Kurvers and seconded by Councilman Neils that the Planning
Commission Minutes of March 14, 1972, be noted and read. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
A motion was made by Councilman Wolf and seconded by Councilman
Bennyhoff to commend the Planning Commission on their attendance
and on their excellent studies and reviews of proposed projects.
The following voted in favor thereof: Mayor Klingelhutz, Council-
men Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Neils and seconded by Councilman Kurvers that the
Park and Recreation Commission Minutes of March 7, 1972, be
noted and read. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
ENVIRONMENTAL COMMITTEE: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils that the Environmental Committee
Minutes of March 17, 1972, be noted and read. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
HUMAN RIGHTS COMMISSION MINUTES: A motion was made by Councilman
Bennyhoff and seconded by Councilman Kurvers that the Human Rights
Commission Minutes of February 26, 1972, be noted and read. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
HESSE'S BLUFF CREEK: A motion was made by Councilman Bennyhoff
and seconded by Councilman Kurvers to approve the final plat for
Hesse's Bluff Creek and authorize the Village Clerk and the Mayor
to sign said plat. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.

LAND DEDICATION: A motion was made by Councilman Neils and I
seconded by Councilman Bennyhoff to adopt the following
Resolution #320721, entitled "DEDICATION OF LAND FOR PUBLIC
USE". The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers and Neils. Councilman Wolf voted
no. Motion carried.
BONDS: A motion was made by Councilman Bennyhoff and seconded
by Councilman Wolf to instruct the Fiscal Agent to proceed with
having the Village rated for the next Bond Issue. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.
N. S. P.: General discussion on electrical rates. No action taken.
SOLID WASTE ORDINANCE: Councilman Wolf asked the Village Attorney
when the Solid Waste Ordinance would be available. The Village
Attorney stated that the ordinance will be completed and be
submitted to the Council within 30 days.
LANDFILL SITES: Fritz Coulter was present complaining about two
specific dump sites, (Hansen & Klingelhutz at the end of Frontier
Trail and Ecklund and Swedlund property in the N.E. quadrant at
Highway 5 and County Road 17).
The Administrator was instructed to check out this problem and I
notify the above property owners that they must cease violating
the Village ordinance.
SNOWMOBILES: Fritz Coulter requested that the Village Council
tighten up the Snowmobile Ordinance. Some of his suggestions
were as follows:
1. Section 3.08

for all violations of the village ordinance whether
or not he is the individual operating the snowmobile.
4. Would also like to see restrictions of running

5. Section 3.09 have added, that no snowmobile should be
operated within 100 feet of anyone walking or skiing
in excess of 10 miles per hour.

BILLS: A motion was made by Councilman Neils and seconded by
Councilman Bennyhoff to approve the bills as submitted. The

carried.

BILLS (contd): A motion was made by Councilman Wolf and seconded
by Councilman Kurvers that the Administrator check into the cost
and installation of a water fountain. The following voted in
favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
ANNUAL REPORT: The Village Treasurer was present reporting in
detail on the total 1971 Annual Report.

A motion was made by Councilman Bennyhoff and seconded by Councilman
Wolf to transfer from the Miscellaneous Sinking Fund the amount
of $293.18 to the 1965 Minnewashta Street Sinking Fund. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
LIQUOR LICENSES: Councilman Kurvers moved to amend the motion of
March 6, 1972. Councilman Wolf seconded. To read as follows:
On Sale Non-Intoxicating Liquor License - $175.00; Off Sale
Intoxicating Liquor License - $150.00; Off Sale Non-Intoxicating
Liquor License - $25.00; Club License - $300.00; Sunday Liquor
Sales - $200.00. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Bennyhoff to approve the Licenses for the following businesses
upon receiving applications and License Fees in full:

EASEMENTS: The Village Attorney reported on the progress on
easements for the Lake Ann Interceptor, Lakeview Hills Trunkline
and the North Service Area.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Neils that the Village Attorney and the Administrator be
instructed to proceed with securing easements as per the
Metropolitan Sewer Board Guidelines. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. No negative votes. Motion carried.
ABANDONED VEHICLES: A motion was made by Councilman Wolf and
seconded by Councilman Bennyhoff to instruct the Village Attorney
to prepare an ordinance on abandoned vehicles and submit back as
soon as possible. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
POLICE: A motion was made by Councilman Neils and seconded by
Councilman Bennyhoff that the Police Report for February be
noted and read. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.

ELECTRICAL RATES: Eugene Coulter was present explaining what
action has been taken on the Electrical Rates Study Committee
of the League of Municipalities of which he is a member.
Mr. Coulter recommended the the Council adopt a Resolution
requesting Northern States Power roll back the rate increase
and request that Chanhassen's rate be no more than St. Paul's.
A motion was made by Mayor Klingelhutz and seconded by Council-
man Wolf that the Village Attorney prepare a resolution with
respect to rescinding the increase of electrical rates in
Chanhassen. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Neils and Wolf. Councilman
Kurvers abstained. No negative votes. Motion carried.
FIRE MARSHALL: A motion was made by Councilman Wolf and seconded
by Councilman Kurvers that Harold Lund be appointed as Fire
Marshall. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Neils to adjourn. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
