CONTINUATION OF PUBLIC HEARING .- PROJECT 72-1 - STREET IMPROVEMENT
May 8, 1972
PERSONS PRESENT: Walker Whitehill, Willard and Shirley Johnson,
Dale Geving, Robert Scholer, Ken Erickson, Ward Passe, Frances
Jacques, Hubert Forcier, Ivo Schutrop, Gayle Wolff, Eugene Coulter,
Gordon Freeburg, George Beniek, Mrs. George Prieditus, Frank
Krejca, Teunis DeJoode, Arden Hippen, Joyce Hippen, Ann Johnson
and Mary Robertson.
Mayor Klingelhutz opened the Public Hearing. The following members
of the Village Council were present: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf.
The Administrator read the Minutes of the Public Hearing April 3,
1972.
The Village Engineer (Frank Laska) gave an expanded feasibility
report.
The question was asked, "What is the contractors responsibility
in a project of this nature?"
ANSWER: The contractor would be required to replace all sod that
was damaged and that existing driveways would be matched with the
new street approaches.
Eugene Coulter's two letters dated April 25, 1972, were discussed.
There was discussion on priority area two. At this time the
following petition was read:
Honorable Mayor and Members of the Village Council of the
Village of Chanhassen.
We the property owners adjacent to Chan View between Frontier
Trail and Great Plains Blvd. request that the street be
vacated and the property revert to the adjacent owners.
We the people signed below have and can have other entrances
to our property and do not wich to have the Village finance
the improvement for the street.
We request an early hearing on this project before the Village
Council, as this is a dangerous street during the school year
and during the summer when children are playing on the school
ground. Children forget themselves when playing and run into
the street to get a ball and there have been near accidents
because of this. The street being vacated would be a safety
measure as far as the children playing on the school ground
are concerned, and as long as we don't need it for entrances
to our property it would eliminate all unnecessary traffic by
our houses.

IMPROVEMENT
Robert Scholer stated that he would like the minutes to reflect
that Lot I, Block 3, Sunrise Hills 1st had a blacktop street
and had already been assessed.
There was general discussion by a number of persons present at
the hearing.
WALKER WHITEHILL stated that he felt the discussion pointed out
that the general opinion was that they just didn't want the
project to proceed.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Kurvers to adjourn the Public Hearing. The following voted
in favor thereof: Mayor K1inge1hutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.

CHANHASSEN VILLAGE COUNCIL MINUTES - May 8, 1972
Mayor K1ingelhutz called the special Chanhassen Village Council
Meeting to order. The following members were present: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf.
A motion was made by Councilman Kurvers and seconded by Council-
man Wolf to dispense with all formalities. The following voted
in favor thereof: Mayor K1ingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
STREET VACATION: A motion was made by Councilman Neils and
seconded by Councilman Wolf to set 7:30 p.m., June 5, 1972, for
a Public Hearing on the vacation of Chan View between Frontier
Trail and Great Plains Blvd.
After some discussion the second and the original motion were
withdrawn.
No further action will be taken on this vacation until a decision
is made on Project 72-1, Street Improvement.
PROJECT 72-1 - STREET IMPROVEMENT: A motion was made by Councilman
Kurvers and seconded by Councilman Wolf that the Council will
make a decision on project 72-1, at 8:30 p.m. on May 15, 1972.
The Administrator to send notice to all persons affected by this
project. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
HAZARDOUS BUILDING: The Administrator explained the status of a
home in the Minnewashta Heights area, formerly owned by the Pages.

HAZARDOUS BUILDING (contd): Some of the following items were
discussed:
1. Replace electrical wiring.
2. Remove all newspapers from attic and replace with approved
insulation material.
3. Replace all foundation plates and floor joists that are
rotting and header over basement door.
4. Replace and repair all floor boards on the front porch
that are rotting and broken in.
5. Replace floor boards in house that are weak and shrunk.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Kurvers that the Board of Adjustments and Appeals review this
house and submit their report at the May 15, 1972, regular meeting.
The following voted in favor thereof: Mayor Klingelhutz, Council-
men Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
Item to be on the Agenda May 15, 1972, at 9:30 'p.m.
URBAN CORPS: The Village Attorney explained the benefits of
acquiring a Low Clerk under the Urban Corps. program.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Wolf requesting tha the Urban Corps. place a Law Clerk with the
Village of Chanhassen under the Urban Corps Work Study Program.
The following voted in favor thereof: Mayor Klingelhutz, Council-
man Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
ZONING VIOLATION: The Village Attorney informed the Council that
the Wanninger case is scheduled for May 26, 1972, at 9:30 a.m., in
Glencoe.
TITLE IV OF THE INTERGOVERNMENTAL PERSONNEL ACT: A motion was made
by Councilman Bennyhoff and seconded by Councilman Wolf authorizing
the Administrator to look into this and report back to the Council.
The following voted in favor thereof: Mayor Klingelhutz, Council-
men Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
NEXT MEETING: The following proposed ordinances will be discussed
at the next meeting:
1. Abandoned Vehicles
2. Green River Ordinance
3. Dutch Elm Control and Prevention
4-H: The 4-H have requested the use of Lake Ann Park. The Council
referred this request to the Park and Recreation Commission for
their next meeting, May 16, 1972, for their comments.

CLEAN UP WEEK: A motion was made by Councilman Kurvers and
seconded by Councilman Bennyhoff that the Mayor proclaim the
week of May 14, 1972, at Chanhassen Clean Up Week. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.
POLICE: The Administrator is to set up a meeting with Springsted,
Inc., on policing for a Metropolitan Council study.
NONINTOXICATING LIQUOR LICENSE APPLICATION: A motion was made
by Councilman Bennyhoff and.seconded by Councilman Neils that
this item be discussed at the next meeting. The following voted
in favor thereof: Mayor,Klinge1hutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Niels to adjourn. The following voted in favor thereof: Mayor
K1ingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
