1972 05 15 ~ I I d '~ CHANHASSEN VILLAGE COUNCIL MEETING - May 15, 1972 The special Chanhassen Village Council Meeting on May 15, 1972, was opened with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. Councilman Neils was absent. COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Council Minutes of May 1, 1972, be approved with the following amendments: Under Federal Grants - Council Minutes of April 3, 1972, ADD - A written report as to the progress that is being made should be submitted to the Council prior to each meeting. Page 4 - Burning Law Motion amended to read "shredder to handle branches and leaves. The fOllowing voted in favor thereof: Mayor Klingelhutz, Council- men Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Council- man Wolf that the Council Minutes of May 8, 1972, and the Public Hearing Minutes of May 8, 1972, be approved with the following amendments to the Council Minutes: Page 3 - Urban Corp Motion amended to read "benefits of acquiring a law clerk". The following voted in favor thereof: Mayor Klingelhutz, Council- men Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman Wolf and seconded by Councilman Kurvers that the Park and Recreation Commission Minutes of May 2, 1972, be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Planning Commission Minutes of May 9, 1972, be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. STERLING ESTATES: Mr. Merz, Mr. Mogan, Mr. Jasin and Mr. Boyer were present requesting a change in the sewer alignment as pro- posed by the Engineer for Sterling Estates. The Council indi- cated that they would be talking about this project later in the evening and that they should come back at 10:00 p.m. BILLS: A motion was made by Councilman Kurvers and seconded by Councilman Wolf that the bills be approved as submitted. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. ~ ~ í ¡ CHANHASSEN VILLAGE COUNCIL MEETING - May 15, 1972 -2- SEWER AND WATER EXPANSION FUNDS: A motion was made by Council- I man Bennyhoff and seconded by Councilman Wolf that the schedule as submitted for the sewer and water expansion funds be approved for payment to the individual Sinking Funds. Sewer Expansion Fund 66-1 $4,269.69 67-4 $1,846.00 Water Expansion Fund 65-1 $2,210.00 68-2 $2,530.00 The following voted in favor thereof: Mayor K1inge1hutz, Council- men Bennyhoff, Kurvers and Wolf. Councilman Neils abstained as she was not present for the entire discussion. Motion carried. PROJECT 72-1 - STREET IMPROVEMENT: General discussion on this proposed project. Each Councilman was polled on his individual opinion on this project. A motion was made by Councilman Kurvers and seconded by Council- man Neils to approve the improvement of West 76th Street from Iroquois to Great Plains Blvd. (east) and south on Great Plains Blvd. to Chan View. Discussion on the motion. Second was withdrawn and the original motion withdrawn for II further study. A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that we do not proceed with the street improve- ment project on Frontier Trail and West 77th Street from Frontier Trail to Great Plains Blvd. and Chan View from Frontier Trail to Great Plains Blvd. The following voted in favor thereof: Mayor Klinge1hutz, Councilmen Bennyhoff, Neils and Wolf. Councilman Kurvers voted no. Motion carried. CHAN VIEW: A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff that a Public Hearing be held June 5, 1972, at 7:30 p.m., in the Village Hall, on the vacation of Chan View between Great Plains Blvd. and Frontier Trai1~ Also that a report from the Police Dept. and the Fire D.Bpt. on~the vacation of this road be submitted to the Council before the Public' Hearing. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. ND negative votes. Motion carried. The Council will meet with interested citizens on the corner of West 76th Street and Great Plains Blvd. at 7:30 p.m. on May 24, 1972, to discuss the street improvement project. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. ¡ . , /1 ".. -- rJ II CHANHASSEN VILLAGE COUNCIL MEETING - May 15, 1972 -3- LOT DIVISION: A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to approve a resolution allowing the division of Lot 2, Block 1, Te~aAcres as per survey submitted and the Planning Commission's recommendations of May 9, 1972, as follows: "A motion was made by Dan Herbst and seconded by Nick Waritz to recommend the Council approve the subdividing of Lot 2, Block 1, Terera Acres based on impending improvements of sewer and water and Section 13.02 of Ordinance #33, Hardship. Motion unanimously approved. The plan submitted by the property owner was the most reason- able solution for the subdivision." The following voted in favor thereof: Mayor K1ingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. ABANDONED VEHICLES: A motion was made by Councilman Neils and seconded by Councilman Wolf to approve Ordinance #48 entitled, "AN ORDINANCE RELATING TO WRECKED, ABANDONED, PARTIALLY DIS MANTLED VEHICLES, DECLAR¡NG THE SAME TO BE A NUISANCE, PROVIDING FOR THE REMOVAL OF SUCH VEHICLES FROM PUBLIC AND PRIVATE PROPERTY AND IMPOSING PENALTIES." The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. PAGE HOUSE: Councilman Neils gave a report for the Board of Adjustments and Appeals that met at the Page house. No one was present so a detailed review was not possible. A motion was made by Councilman Neils and seconded by Councilman Wolf that the Historical Society look into the Page house as a possible historical site and submit a report back to the Council. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. NORTH SERVICE AREA: The Sterling Estates problem;was discussed in great detail. No decision was made at this time. PROJECT 7l-1A: A motion was made by Councilman Wolf and seconded by Councilman. Bennyhoff to approve an agreement between the Village of Chanhassen and Carver County entitled "AN AGREEMENT BETWEEN THE COUNTY OF CARVER AND THE VILLAGE OF CHANHASSEN FOR IMPROVEMENT OF A PORTION OF COUNTY STATE AID HIGHWAY #15", and authorized the Mayor and the Clerk to sign said âgreement. The following voted in favor thereof: Mayor Klinge1hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to authorize the advertising for bids for Project 7l-lA. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. CHANHASSEN VILLAGE COUNCIL MEETING - May 15, 1972 -4- CHASKA: A motion was made by Councilman Neils and seconded by Councilman Kurvers that the joint use rental agreement signed by Chaska and the Metropolitan Sewer Board does not in any way set a precedent for any future agreements between the Village of Chanhassen and the City of Chaska for use of other sewer lines in the City of Chaska. The following voted in favor thereof: Mayor ~lingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. PLEASANT ACRES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Certified Check on deposit with the County Auditor dated January 8, 1957, guarantying proper drainage of Pleasant Acres, be released. The following voted in favor thereof: Mayor Klinge1hutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
