1972 06 26 ~ I I I ~ CHANHASSEN VILLAGE COUNCIL MINUTES - June 26, 1972 The special Chanhassen Village Council Meeting on June 26, 1972, at 7:00 p~m., was opened with the Pledge to the Flag. All other formalities were dispensed with. The following members were present: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. Councilman Bennyhoff was absent. The following persons were present: Bill Brezinsky, Betty Barnacle, Phillis Page, Rachel Hill, Herb DeVaan, Karen Moreno, Diane A. Nelson, Judith L. Raymond, James A. Brandt, Dean G. Wenger, Bill Moreno, Gail Stone, Tim Stone, Fred Wagner, Jerry Heydt, Gary L. Nelson, Henry R. Kober, Kay Wilson, Dave Wilson, Shirley and Willard· Johnson, Stan Rolfsrud, Jim Cranston, Harrison Winters, Bernice Winters, Dee Kober, Susan Severson, Leslis Nelson, Ellen Jane Cranston, Jan Hill SUMMER RECREATION PROGRAM: Jan Hill was present to request the following: 1. That the babysitters working for the Tiny Tot School be paid 50¢ per hour. 2. That Karen Gustafson (lifeguard and swimming lesson instructor) be paid $3.00 per hour the same as Karen Sernett. They both have the same training and work experience and are doing the same thing in the Summer Recreation Programp but Karen Gustafson is only being paid $2.00 per hour. 3. That Karen Sernett be appointed to teach a course in slimnastics as the park. A motion was made by Councilman Wolf and seconded by Councilman Neils that the babysitters working in the Tiny Tot School be paid 50¢ per hour. The following voted-in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. The Council will discuss the salary of Karen Gustafson with the Clerk-Administrator. A motion was made by Councilman Wolf and seconded by Councilman Kurvers that Karen Sernett be appointed to teach a course in slimnatics during normal life guarding hours at the same salary, at the park. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negat:ive votes. Motion carried. MINNETONKA LABORATORIES BUILDING PERMIT APPLICATION: There was general discussion on the Planning Commission recommendations. Councilman Kurvers stated that the back öf the entire Frontier complex should have fire hydrants installed. Mayor Klingelhutz brought up that if there were fire hydrants installed behind the complex that the Village Fire Class Rating would go down there- fore lowering every residents' and businesses' insurance premiums. Minnetonka Laboratories septic system was discussed and a repre- sentative of the compa§Y stated that they would hook up to the sewer as soon as it was available. ~ CHANHASSEN VILLAGE COUNCIL MINUTES - June 26, 1972 -2- MINNETONKA LABORATORIES (contd): There was discussion on the parking areas. I A motion Building 1. was made by Councilman Kurvers that we approve the Permit Application with certain apecifications: that Minnetonka Lab. have hydrants installed in the rear of their building; 2. that a study be made of the sewer and water system; 3. that all Planning Commission recommendations are met. Minnetonka Lab. questioned whether they would have to pay for fire hydrants in back of the entire Frontier complex as they feel that they should only have to bear the cost of hydrants behind their building. It was explained that Minnetonka Lab. would only be responsible for their hydrants. Councilman Neils moved to amend Councilman Kurvers motion to read that the Village approve the Building Permit Application for Minnetonka Laboratories and Community Investment Enter- prises as per the Planning Commission recommendations as follows: (excerpt from Planning Commission Minutes of June 20, 1972) A motion was made by Tom Gabbert and seconded by Arnie Ryba to recommend the Council approve a building permit for Minnetonka Laboratories, Inc.-Community Investment Enterprises, Inc., including Planning Report #2 from I Design Planning (Addendum #1) but excluding Side Yard Variance paragraph 2, subject to Planning Commission approval of a landscape plan and engineering approval of a drainage plan. These plans to be presented to the Planning Commission on July 11, 1972. The Planning Commission does not allow any loading or unloading on the east side of the new portion of the building. Motion unanimously approved. Councilman Wolf seconded the amended motion. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Kurvers that the Engineer do a feasibility study on bringing sewer and water in to the rear of Minnetonka Laboratories. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. CARVER BEACH TRANSMITTAL: Mayor Klingelhutz stated that he would have to leave the meeting by about 7:50 p.m. to give a speech at the Frontier Days Queen pagent but would like to start discussing the Carver Beach Association transmittal. I I ! --~ r- CHANHASSEN VILLAGE COUNCIL MINUTES - June 26, 1972 -3- III CARVER EEACH (contd): TO THE CHANHASSEN VILLAGE COUNCIL As a member and officer of the Carver Beach Property Owners Association, we would like to set the record straight regarding the letter and list of grievances that was presented to the Chanhassen Village Council last week on behalf of our Association. That letter indicated that Mr. Stone was speaking on behalf of the Association membership. That is not the case. No meeting was called to assess the membership feeling, or to obtain their permission to present or publish that letter or the attached list of greivances in the name of the Carver Beach Property Owners Association. I Further we are dismayed to think that the public may be led to believe that the Carver Beach Property Owners Association is in sympathy with certain individuals in our Community who have seized upon the "Death Trap Tragedy" to further their political ambitions. This Tragedy, like most others, was cause by thoughtlessness, forgetfulness and/or neglect on the part of many people. One of the least of those responsible was the Village Administration. The Village Council' position in the matter is the only sensible position that can be taken. You cannot fracture the community attempting to "place blame" for a tragedy that took so much neglect by so many people that it can almost be classed as an "Act of God". All that can be done, is to learn from one tragedy and take all possible action to prevent the next one. We would also hope that the Chanhassen Village Council would disregard the list of greivances submitted with Mr. Stone's letter. When greivances have been properly submitted to the Carver Beach Property Owners Association membership and have been adjudged, by them, to be matters requiring attention of the Village Council, we would urge that proper action be taken. In summary, our newly elected President, Mr. Stone, exceeded his authority, in presenting the aforementioned letter and grievances to the Village Council, prior to membership approval, and he had no right to publish them in our name. I PROJECT 71-lC: Bill Brezinsky, Village Engineer, was present to request that the Council authorize for the advertisement for bids on the 71-lC Project (Highway 41 west to Minnewashta Heights area) at approximately $586,200 or $3,200. more than report in the Engineer's letter dated May 11, 1972. A motion was made by Councilman Wolf and seconded by Councilman Neils that we authorize the Village Engineer to advertise for bids on Project 71-lC. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. The Mayor apologized to the Carver Beach Association for having to leave. Councilmen Kurvers, Neils and Wolf stated that they would stay and have an informal discussion on the Carver Beach Transmittal with the Association. The Carver Beach Property Owners Association invited the Village Council and any Commission members to attend their meeting on July 13, 1972, in the Village Hall, at 7:30 p.m. A motion was made by Councilman Neils and seconded by Councilman I Kurvers to adjourn.
