CHANHASSEN VILLAGE COUNCIL MINUTES - August 7, 1972
The regular Chanhassen Village Council Meeting on August 7, 1972
was opened with the Pledge to the Flag. The following members
were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf.
COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and
seconded by Councilman Kurvers to approve the minutes of July 24,
1972. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff¡ Kurvers, Neils and Wolf. No negative votes.
Motion carried.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Kurvers and seconded by Councilman Wolf that the Planning Commission
Minutes of July 25, 1972, be noted and read. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Wolf and seconded by Councilman Neils that the Park
and Recreation Minutes of July 18, 1972, be noted and read. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
SUMMER RECREATION PROGRAM:
LIFEGUARD: A motion was made by Councilman Bennyhoffand
seconded by Councilman Kurvers that the salaries be set for
1. Chief Lifeguard - $3.00 per hour - also instructor
2. Lifeguard, Instructor - $2.50 per hour
3. Lifeguard - $2.00 per hour.
All salaries to be retroactive to the beginning of the season.
The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
PARK AND RECREATION:
KARATE CLASSES: A motion was made by Councilman Neils and
seconded by Councilman Bennyhoff that all special lessons
shall be self-supporting. The Village will sponsor the
Karate Classess if they follow the Village policy of being
self-supporting. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. No negative votes. Motion carried.
SEWER BACK UP PROBLEM: The Village Administrator read the
memorandum sent to the Council on the policies of other muni-
cipalities on this type of problem.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Kurvers that the Village pay $150.00 each (to be paid from
the Utility Department) to Jerome Kerber and Gerald Neher for the
sewer back up damage. The Minutes should reflect that the Village
will not support excessive claims of this type in the future.

The Village will not be responsible for any further claims by I
Gerald Neher or Jerome Kerber as they have been instructed to
taken action against any future occurrence. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff and
Kurvers. Councilmen Neils and Wolf voted no. Motion carried.
BOARD OF ADJUSTMENTS AND APPEALS: The following recommendation
was submitted by the Board of Adjustments and Appeals:
REQUEST FOR VARIANCE - JAMES J. LA FAVE: James LaFave was
present to explain a one-story building addition to his
house on lots 3211 - 3212, Carver Beach. He requested one
variance from Zoning Ordinance No. 47, Section 7.05, 3.
Side Yard Regulations. The variance request was for a six
(6) foot side yard depth. The Board continued the hearing
at lots 3211 - 3212, Carver Beach to investigate the site
of the proposed addition.
Chairwoman Anne Neils and Board Member Ward Passe recommended
approval of the variance request. There is no sewage
disposal system on this property that meets the requirements
of Village Ordinance No. 10. The board members felt that
this house should not be occupied until such a time that
sewer is available or ån accepted sewage disposal system
is constructed.

A motion was made by Councilman Wolf and seconded by Councilman
Bennyhoff to accept the recommendation of the Board of Adjustments
and Appeals. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
SEWER AND WATER, INDUSTRIAL AREA~ (PROJECT #72-2): General
discussion on the August 4, 1972, sewer and water proposal.
It was the general feeling of the Council that this report
was incomplete.
A motion was made by Councilman Wolf and seconded by Councilman
Kurvers to table any further action until the next meeting
when a revised report will be submitted. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.
LIQUOR LICENSE: A motion was made by Councilman Bennyhoff and
seconded by Councilman Wolf that a 3.2 On Sale Liquor License
be issued for August 19, 1972, at Lake Ann Park, for $10.00,
to be issued to Jerry's Old West Ball Club. Also that it is
the responsibility of the ball club to police that area after
the tournament. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No I
negative votes. Motion carried.
It shall be the Village policy that the granting of reserved
space on the ballfields shall be for Chanhassen sponsored
tournaments only.

COUNCIL SALARIES: Mayor Klingelhutz proposed that the Council
take action on adopting an Ordinance increasing the Council
salaries. There was general discussion. The Administrator
is to contact other municipalities and compare their salaries
and then submit a report back to the Council. The Village
Attorney is to draft an Ordinance.
NORTH SERVICE AREA: A motion was made by Councilman Bennyhoff
and seconded by Councilman Neils to authorize the advertising
for bids for Project #7l-lD. The following voted in favor there-
of: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. No negative votes. Motion carried.
URBAN CORPS: A motion was made by Councilman Bennyhoff and
seconded by Councilman Wolf that the Village pay $30.00 per week
to the Urban Corps for all Urban Corps employees for the year of
1972. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes.
Motion carried.
ORDINANCE #33: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils to adopt Ordinance #33-A amending
Ordinance #33. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
PRIMARY ELECTION JUDGES: A motion was made by Councilman Benny-
hoff and seconded by Councilman Kurvers to appoint the following
people for election judges and counters at the rate of $2.00
per hour:
