1972 09 18 J""" II III I CHANHASSEN VILLAGE COUNCIL MINUTES - September 15, 1972 The regular Chanhassen Village Council Meeting on September 15, 1972, was opened with the Pledge to the Flag. The following members were present: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. Councilman Bennyhoff was absent. COUNCIL AND PUBLIC HEARING MINUTES: A motion was made by Councilman Wolf and seconded by Councilman Kurvers to approve the minutes of August 14, 1972. The following voted in favor thereof: .Mayor Klingelhutz, Councilman Kurvers, Neils and Wolf. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Wolf that the Planning Commission minutes of August 8, 1972 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Neils that the Planning Commission minutes of August 22, 1972 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Kurvers that the September 12, 1972 Planning Commission minutes be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilman Kurvers, Neils and Wolf. No negative votes. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman Neils and seconded by Councilman Wolf that the Park and Recreation Commission minutes of August 1, 1972 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Kurvers that the Park and Recreation Minutes of August 15, 1972 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Neils that the Park and Recreation minutes of September 5, 1972 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. HUMAN RIGHTS COMMISSION: A motion was made by Councilman Kurvers and seconded by Councilman Neils that the Human Rights Minutes be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. WESTERN HILLS SECOND ADDITION: Tom Klîngelhutz and Robert Schol were both present requesting that they be allowed to use the fi;~ of Schoell and Madson to prepare a plat~ --' CHANHASSEN VILLAGE COUNCIL MINUTES September 18, 1972 Page 2 WESTERN HILLS SECOND ADDITION CON'T: A motion was made by Councilman Neils and seconded by Councilman Wolf that Hanson and Klingelhutz and Robert Scholer be allowed to use the firm of Schoell and Madson to pre- pare a plat in Western Hills and a re-plat in Sunrise Hills. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Neils to approve Resolution #918721 authorizing the Village Engineer to prepare a feasibility study and an preliminary report for the Sewer, Water and Storm Sewer entitled 72-4. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. ~ ! I ~ ¡ i II CHASKA EAST CREEK: A representative of the Corps of Engineering was present to explain to the Village Council the different alternatives for the diversion of the East Chaska Creek. Alternate 1 and 2 would be diverted through Chanhassen. The Corps of Engineering said that the City of Chaska was leaning toward alternate 1 or 3. The Village Engineer will be apprised of the Corps of Engineer's report and will report back to the Village Council. BOARD OF ADJUSTMENTS AND APPEALS: The following minutes of the Board of Adjustments and Appeals were read: REQUEST FOR VARIANCE: (DON FOWLER): Don Fowler, Lots 6 and 7 Sunset View, was requesting a variance for building a garage. He requested a variance from Zoning Ordinance No. 47, Section 7.05, 2. Front Yard Regulations. The variance is for a ten (10) foot front yard setback fro the garage. Mr. Fowler indicated that he would have problems locating the garage further back on the property because the elevation drops off sharply. A motion was made by Dean Scheff and seconded by Anne Neils to approve the variance request under the condition that the garage doors face onto the hard surfaced driveway in front of the house and not onto State Highway No. 101. Motion un- animously approved. A motion was made by Councilman Kurvers and seconded by Councilman Wolf to approve the variance request for Fon Fowler for a 24' x 24' garage under the condition that the garage doors face North onto the hard surface driveway and not onto state Highway #101. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. i 1 i . I The following minutes of the Board of Adjustment and Appeals were read: REQUEST FOR VARIANCE - DWIGHT IMKER: Dwight Imker of Carver I Beach was requesting a variance from Ordinance No. 45, SECTION 2.03. He was requesting a variance to build a house on Lots 1889 to 1893 Carver Beach, the building site is approximately eight thousand (8,000) square feet whereas the Ordinance re- quires a building site of thirty thousand (30,000) square feet. The Board Members felt that this was not an adequate amount of square footage of land on which to build a house. Motion unanimously approved. A motion was made by Councilman Wolf and seconded by Councilman Neils that the request for variance made by Dwight Imker be denied as per recommendation of the Board of Adjustments and Appeals. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. BILLS: A motion was made by Councilman Neils and seconded by Councilman Wolf to approve and pay all bills. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. 7l-lA: A motion was made by Councilman Kurvers and seconded by Council- man Wolf to approve the bills submitted by Hoffman Brothers in the amount of $113,651.62. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. 71-lF: A motion was made by Councilman Neils and seconded by Council- man Kurvers to approve Resolution #918722 entitled Approving Plans and Specifications and Calling for Construction Bids on North Area Sewer and Water Improvement #7l-lF(Bl included in this project). The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils. and Wolf. No negative votes. Motion carried. N.S.A.: The Village Engineer gave a status report. The Village Attorney explained to the Council the status of the necessary ease- ments. 72-2: General discussion was held by the Village Council and it was agreed on both by the Village Planner and the Village Council that the line should continue East to State Highway #101 and connect to the West to the proposed street named Picha. A motion was made by Councilman Neils and seconded by Councilman Wolf to approve Resolution #918723 entitled Directing the Village Engineer to prepare detailed Plans and Specifications for the In- dustrial Sewer and Water Improvement No. 72-2. The following voted in favor thereof:' Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. COUNCIL COMPENSATION: A motion was made by Councilman Wolf and sec- onded by Councilman Neils to approve Ordinance #52 entitled An Ordinance Establishing Compensation for Members of the Village Council. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Ku~vers, Neils and Wolf. No negative votes. Motion carried. ~ VILLAGE Of CBANHAS$EN COUNCIL MINUTES - September 18, 1972 -4- I.C.M.A.: A motion was made by Councilman Neils and seconded by I Councilman Wolf that registration and the necessary expense for the Village Administrator to attend the I.C.M.A. Conference be approved. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. HIGHWAYS: A motion was made by Councilman Wolf and seconded by Councilman Neils to approve Resolution #918724 entitled Request for Semaphores for the Railroad Crossing on #117. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes. Motion carried. The Administrator was instructed to contact either the Railroad or the State Highway Dept. to repair the Highway at the Railroad Crossing on State Highway #101 and County Road #16. HIGHWAY #5: The Mayor read a letter from Representative Jopp which was sent to the Highway Commissioner Lappegaard. A motion was made by Councilman Neils and seconded by Councilman Wolf to adjourn the meeting. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf.
