CHANHASSEN VILLAGE COUNCIL MINUTES - October 16, 1972

The Chanhassen Village Council Meeting on October 16, 1972, was
opened with the Pledge to the Flag. 'The folldwing members were
present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Wolf and seconded by Councilman Neils that the Park
and Recreation Commission Minutes of October 2, 1972, be noted
and read. The following voted in favor therof: Mayor Klingelhutz,
Councilmen Bennyhoff, ~urvers, Neils and Wolf. No negative votes.
Motion carried.

The Administrator read a letter from the Village Engineer dated
October 13, 1972, recommending that the Council accept the low
bid of $311,729.11.
The low bid was received from Peter Lametti Construction, of
St. Paul, Minnesota. Their base bid also includes the use of a
lift station manufactured by Peabody-Barnes of Mansfield, Ohio.
All other stations used to date are manufactured by Flygt. Use
of the Peabody-Barnes equipment will result in a saving of $2,500
(use of the Flygt equipment is an "Add Alternate" above the base
bid). We· would like to., reserve judgment on use of· the Peabody-
Barnes equipment until we can check it out· further'with owners
familiar with its operating experience. ' I
The Village Engineer recommends accepting Peter Lametti Construction
Company's low bid, using the base bid with the ABS pipe alternate.
A motion,was made by,Councilman Neils and seconded by Councilman
Wolf to accept the low bid from Peter Lametti Construction, Co.
of $311,729.11 using the base bid with the A~ß pipe alternate, and
further reserving the right to specify the Flygt lift station
alternate should the Peabody-Barnes equipment as specif.ied in the
base bid not disclose operating experience resulting in the best
interest of the Village. The following voted infavor thereof:

Project 71-lBWell #3: A motion was made by Councilman
Wolf and Seconded by Councilman Bennyhoff to approve the
plans and specifications and authorize the advertising for bids
for 71-1B Well #3. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.
NSA: The Village Engineer gave a status report of the project
to date. A discussion on the drainage problem in the Minnewashta
Manor area. The Administrator and the Village Attorney are
going to check into the assessment possibilities in the
areas where Shorewood drains into Chanhassen.
POLICE: Officer Wallin was present to discuss the reduction of
speed on County Road 117, south of Highway 5. After considerable
discussion, it was decided that a comprehensive study on all
of #117 would be presented at the first meeting in November.
Officer Wallin explained to the Council that the Police Dept.
met with approximately 30 teenagers at the Village Hall on
October 11, 1972 to discuss Police and Teenage Problems.
BOND ISSUE: A motion was made by Councilman Kurvers and seconded
by Councilman Wolf to approve resolution #1016721 authorizing
the sale of $2.5 million for Sewer and Water improvements. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.

BILLS: A motion was made by Councilman Bennyhoff and seconded
by Councilman Wolf to pay all bills as submitted.
Councilman Neils moved and Councilman Wolf seconded that the
Council take special note of all budgets that are over the ap-
proved 1973 Budget. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf.
No negative votes. Motion carried.
CARVER BEACH: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils to deny request for landfill in
Carver Beach by Hans Petruska. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. No negative votes. Motion carried.
72-3 CARVER BEACH ROAD PROJECT: A motion was made by Councilman
Wolf and seconded by Councilman Kurvers that the Council approve
the re-locating of the proposed road onto the location of the
vacated Dogwood Road in the original Carver Beach plant contingent
upon and an affirmative legal opinion and a temporary easement I
drawn up ~nd signed by the property owner. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.

67-4 PROJECT: A motion was made by Councilman Bennyhoff and sec-
onded by Councilman Neils to authorize the payment to Ken
Erickson in the amount of $50.00 for a tree replacement. Upon
receiving this payment the Erickson's will sign a Utility Ease-
ment across their property in the amount of $1.00. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.
RAILROAD FIRES: A motion was made by Councilman Wolf and seconded
by Councilman Kurvers that all fires started by the Railroad be
billed in the amount of $200.00 per call plus $100.00 per hour.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion
carried.
CAR FIRES: A motion was made by Councilman Kurvers and seconded
by Councilman Wolf that all car fires for non-residents of
Chanhassen be billed $50.00 per call plus expenses. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.

A motion was made by Councilman Neils and seconded by Councilman
Bennyhoff to adjourn the meeting. The føllowing voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. NO::nnegative votes. Motion carried.
