1972 11 20 ~ I I I CHANHASSEN VILLAGE COUNCIL MINUTES - November 20, 1972 -1- The regular Chanhassen Village Council meeting on November 20, 1972, at 8:00 p.m., was held in the Village Hall and opened with the Pledge to the Flag. The following people were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. Councilman Neils was absent. COUNCIL MINUTES: A motion was made by Councilman Kurvers and seconded by Councilman Wolf to approve the minutes of the November 13, 1972 Council Meeting. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. Councilman Anne Neils entered the meeting at 8:05 p.m. WORK SESSIONS: A motion was made by Councilman Kurvers and seconded by Councilman Wolf to have a meeting of all Commission and Department Heads on November 27, 1972 at 7:30 p.m., in the Village Hall. The purpose of the meeting is to have an informal discussion with each Commission or Department Head in private. Twenty minutes will be allowed for each Department or Commission. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: A motion was made by Councilman Neils ãnd seconded by Councilman Wolf that the Planning Commission Minutes. of November 14, 1972, be noted and read. The following voted in - favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. HENRY WRASEIS TRUCK: December 15, 1972 and on December 19, 1972. of the new trucks. The bids on the new trucks will be openêdc on will be ready for approval by County Commissioners There will be a County auction after the delivery A motion was made by Councilman Kurvers and seconded by Councilman Wolf to order one 4-wheel drive, 3/4 Ton Pick-up truck with a Utility Box and snow plow,' and one 3/4 Ton truck with a Utility Box. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Neils and seconded by Councilman Wolf that the three new trucks being ordered by the Village, be color S08l-D, and this be the color of all future new vehicles. The follow- ing voted in favor thereof: Councilmen Bennyhoff, Neils and Wolf. Mayor Klingelhutz-and Councilman Kurversvoted no. Motion carried. OPERATION IDENTIFICATION: A report was made by Officer Al Wallin about the program Operation Identification. This would be a service that the Village would provide all home owners. The project was tabled until the Councilmen can talk to the Chamber of Commerce, J.C. IS and the Lion's Club for backing. ~ i CHANHASSEN VILLAGE COUNCIL MINUTES - November 20, 1972 -2- POLICE REPORT: A motion was made by Councilman Wolf and seconded by Councilman Neils to approve Resolution No. 1120721 entitled Adopting a Speed Zone on County Road 117. This would include a 35 mph speed limit on County Road 117 beginning 100 yards North of W. 67th Street and continuing to the Hennepin County line and a 50 mph speed limit on County Road 117 between County Road 17 and Minnesota State Highway 5. The following vo~ed in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. COUNCILMAN WOLF MOVED THE ADOPTION OF THE FOLLOWING RESOLUTION: BE IT RESOLVED that the following bill be paid in a warrant: CONSTRUCTION FUND: Hoffman Brothers, Inc. -- 7l-lA In the amount of $176,597.75 Check No. 561 RESOLUTION SECONDED BY COUNCILMAN KURVERS. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. COUNCILMAN WOLF MOVED THE ADOPTION OF THE FOLLOWING RESOLUTION: BE IT RESOLVED that the following bill be paid in a warrant; I CONSTRUCTION FUND: Nodland Association -- 7l-1C In the amount of $61,081.56 Check No. 569 RESOLUTION SECONDED BY Councilman Neils. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. COUNCILMAN BENNYHOFF MOVED THE ADOPTION OF THE FOLLOWING RESOLUTION: BE IT RESOLVED that the following bill be paid in a warrant: CONSTRUCTION FUND: Orfei and Sons -- 71-lD In the amount of $108,035.37 Check No. 572 RESOLUTION SECONDED BY Councilman Kurvers. COUNCILMAN KURVERS MOVED THE ADOPTION OF THE FOLLOWING RESOLUTION: BE IT RESOLVED That the following bill be paid in a warrant: CONSTRUCTION FUND: Metro Sewer Board -- 71-6 In the amount of $43,188.54 Check No. 559 RESOLUTION SECONDED BY COUNCILMAN BENNYHOFF. The following voted in favor thereof: Mayor Klingelhutz, Councilman Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. BOARD OF ADJUSTMENTS AND APPEALS: A motion was made by Councilman Neils and secondéd:by ~Ccn.mcilmatLKurvers to grant a variance from Ordinance No. 45, Section 2.02 entitled Unplatted Lands, because of the unique and pre-existing conditions that caused this particular property to be land locked on all four sides, but the Village does not guarantee that the road willl,be maintained or there be an access to the road. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. ELECTION PRECINCT RESOLUTION: A motion was made by Counclman Benny- hoff and seconded by Councilman Kurvers that the Resolution Establishing Election Precincts and Polling Places be tabled until the Village Attorney has time to examine it. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. STATUS REPORT: Bill Brezinsky from Schoell and Madson was present and gave a report on the North Sewer Area. He stated that all wor~ should be completed by next week. A general discussion was then held by the Council. BUILDING PERMIT: The Council referred to the November 14, 1972 Planning Commission Minutes regarding the Dorn Car Wash. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to administer an injunction prohibiting the use of the car wash and a full report from the Administrator and from Harvey Lehman on the car wash. The following voted in favor thereof: Mayor Klingelhutz, Councilman Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried. A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff for the Administrator to write Dorn Construction a letter and halt all construction on the car wash. Motion carried. ~ CHANHASSEN VILLAGE COUNCIL MINUTES - November 20, 1972 DAVE REED: Dave Reed was present and inquired about the Ordinance I #47, Section 19, Subsection 16 regarding the parking of recreational vehicles and requesting a change in the ordinance and an explaination of the ordinance. It was advised by the Council to take his request up with the Planning Commission. A motion was made by councilman Kurvers and seconded by Councilman Bennyhoff that Dave Reed have a 60 day extension on his November 27, 1972 dead line, for the storage of his recreational trailer. The following voted in favor thereof: Mayor Klingelhutz, Councilman Bennyhoff, Kurvers and Wolf. Councilman Neils voted no. Motion carried. MISCELLANEOUS: In regards to a motion made six months ago the Council wants the Administrator to make up a list of complaints from the citizens every montha and present it to the Council. A motion was made by Councilman Bennyhoff and seconded by Councilman Neils to adjourn the meeting.
