The regular Chanhassen Village Council Meeting on November 6, 1972,
at 8:00 p.m., in the Chanhassen Village Hall was opened with the
Pledge to the Flag. The following people were present: Mayor
Klingelhutz, Councilmen Kurvers and Wolf. Councilmen Bennyhoff and
Neils were absent:
CIVIL DEFENSE: Mayor Klingelhutz presented Charles Anding with a
certificate for attending the Civil Defense Seminar and commended
. him for his work in Civil Defense.
PARK AND RECREATION MINUTES: . A motion was made by Councilman Kurvers
and seconded by Councilman Wolf that the Park and Recreation Com-
mission Minutes of October 17, 1972, be noted and read. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers and
Wolf. No negative votes. Motion carried.
Anne Neils entered the meeting.
PLANNING COMMISSION MINUTES: A motion was made by Councilman Wolf
and seconded by Councilman Kurvers that the Planning Commission
Minutes of October 10, 1972, be noted and read. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and
Wolf. No negative votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Kurvers that the Planning Commission minutes of October 24, 1972,
be noted and read. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes.
Motion carried.
VILLAGE COUNCIL MINUTES: A motion was made by Councilman Wolf and
seconded by Councilman Neils to approve the minutes of the September 18,
1972 meeting. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Kurvers, Neils and Wolf. No negative votes.
Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Kurvers to approve the minutes of the October 2, 1972 meeting. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Kurvers, Neils and Wolf. No negative votes. Moiton carried.
A motion was made by Councilman Wolf and seconded by Councilman
Kurvers to approve the Public Hearing Minutes of October 9, 1972.
The following voted in-favor thereof: Mayor Klingelhutz, Councilmen
Kurvers, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman
Kurvers to approve the Council minµtes of the October 9, 1972
meeting. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Kurvers, Neils and Wolf. No negative votes. Motion
carried.

VILLAGE COUNCIL MINUTES CaN'T: the October 16, 1972 meeting be I
approved. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Kurvers, Neils and Wolf. No negative votes. Motion
carried.
A motion was made by Councilman Wolf and seconded by Councilman
Neils to approve the minutes of the October 30, 1972 meeting. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Kurvers, Neils and Wolf. No negative votes. Motion carried.
PLUMBING INSPECTOR: Hubert Forcier was present to explain the
problems he's had with Mr. Hanus.
A motion was made by Councilman Wolf and seconded by Councilman
Neils that the Administrator contact the state Plumbing Inspector
to inspect this property and submit a complete report to the
Council. The following voted in favor thereof: Mayor Klingelhutz,
Councilman Kurvers, Neils and Wolf. No negative votes. Motion
carried.
NSA: A motion was made by Councilman Wolf and seconded by Councilman
Kurvers to approve Resolution No. 116721 entitled Request to Board
of County Commissioner of Hennepin County, Minnesota, for Grant of
Easements. The following voted in favor thereof: Mayor Klingelhutz,
Councilman Kurvers, Neils and Wolf. No negative votes. Motion
carried.

Koehnen Addition Area
General discusssion was held on the Red Cedar Point Area.
The following petition was presented to the Council:
We the property owners along E. Koehnen Circle and Audubon
and other concerned neighbors do object to the plan to
join these two road. We wish to see E. Koehnen Circle
remain a cul-de-sac.

NSA CON'T: North end of Audobon and not continue the roadway through
North to Koehnen Circle East. The following voted in favor thereo£:
Mayor Klingelhutz, Councilman Kurvers, Neils and Wolf. No negative
votes. Motion carried.
The Village Engineer gave a report on his letter dated November 3, 1972,
which related to the Cost recap on the North Chanhassen Sewer. It
indicated that the total project was approximately $53,000.00 less
than the original estimate.
71-lB: The Administrator presented a tabulation of bids opened
on October 31, 1972 at 2:00 p.m. as follows:

The Village Engineer recommends awarding the contract to the low
bidder, Layne Minnesota Company, Inc., in the amount of $33,850.00
A motion was made by Councilman Wolf and seconded by Councilman
Kurvers to approve Resolution No. 116722 entitled Accepting the
Low Bid for Project 71-lB, Water Supply Well No.3. The fOllowing
voted in favor thereof: Mayor Klingelhutz, Councilmen Kurvers,
Neils and Wolf. No negative votes. Motion carried.
71-lF: The Village Engineer recommends that the Village Council
accept the alternate Flygt Lift Station.
A motion was made by Councilman Kurvers and seconded by Councilman
Wolf to accept the alternate in the Peter Lametti Construction bid
using the alternate Flygt Lift Station in the additional amount of
$2,500.00. The following voted in favor thereof: Mayor Klingelhutz,
Councilmen Kurvers, Neils and Wolf. No negative votes. Motion
carried.
MUNICIPAL STATE AID STREETS: A motion was made by Councilman Wolf
and seconded by Councilman Kurvers to approve Resolution No. 116723
entitled Resolution Establishing Municipal State Aid Streets. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Kurvers, Nèils and· Wolf. No negative votes. Motion carried.
A motion was made by Councilman Wolf.and seconded by Councilman
Kurvers to authorize the Village Engineer to pr6ceed to prepare a
need sutdy for the Municipal State Aid Streets. The following
voted in favor thereof: Mayor Klingelhutz, Councilman Kurvers,
Neils and Wolf. No negative votes. Motion carried.

HUMAN RIGHTS COMMISSION: A motion was made by Councilman Kurvers and I
seconded by Councilman Wolf to accept Norman Pavey's resignation
from the Human Rights Commission and instruct the Administrator
to write a letter of appreciation to Mr. Pavey for the work he has
done on the Human Rights Commission. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Kurvers, Neils and Wolf.
No negative votes. Motion carried.
CARVER BEACH: A motion was made by Councilman Kurvers and seconded by
Councilman Wolf to certify that the parcels of land hereinafter listed
are all of the lands which have been classified by us as non-con-
servation lands, from the list of lands forfeited to the state of
Minnesota for non-payment of taxes for the years 1964-1966 as pro-
vided by Minnesota statutes 1945, Section 282.01:

FIRE DEPARTMENT: Fred Dickison was present to expalin to the Council
some changes that the Fire Dept. is making with its rescue squad.
Mr. Dickison also stated that the Rescue truck is badly in need of
being replaced and should be replaced as soon as possible. It was
agreed on by the Council that a new Rescue truck should be purchased
as soon as possible. The Fire Dept. will draw up specifications and
submit them to the Village Council for approval.

Kurvers to approve Resolution No. 116724 entitled Approving Plans
and Specifications and Authorizing for Bids for North Area Trunk Water
Project 71-lBT. The following voted in favor thereof: Mayor Klingelhutz,
Councilman Kurvers, Neils and Wolf. No negative votes. Motion
carried.
DELINQUENT TAXES: A motion was made by Councilman Kurvers and seconded
by' Councilman Wolf to approve resolution no. 116725 entitled Resolution
Regarding Penalties on Delinquent Taxes. The following voted in favor
thereof: Mayor Klingelhutz, Councilman Kurvers, Neils and Wolf. No
negative votes. Motion carried.
7l-lF: A motion was made by Councilman Wolf and seconded by Councilman
Kurvers to approve theAssurance of Compliance with the Department of
Housing and Urban Development Regulations under Title VI of the Civil
Rights Act of 1964 and authorize the Clerk-Administrator to sign I
the document for the HUD application. The following voted in favor
thereof: Mayor KlingelhÜtz, Councilmen Kurvers, Wolf and Neils.
No negative votes. Motion carried.

71-lF CONTINUED: A motion was made by Councilman Kurvers and seconded
by Councilman Wolf that the Village of Chanhassen hereby assures that
it has authority under applicable state and local law to comply with
Section 210 of the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970, Public Law 91-646, 91st Congo S. 1
84 stat. 1894 (1971), and certifies, assures, and agrees that, not-
withstanding any other provision set forth in any application, contract,
or agreement with respect to the application identified as Hun Sewer
and Water (Red Cedar Point). The following voted in favor thereof:
Mayor Klingelhutz, Councilman Kurvers, Neils and Wolf. No negative
votes. Motion carried.
A motion was made by Councilman Wolf and seconded by Councilman Kurvers
to approve resolution No. 116726 entitled Resolution authorizing Filing
of Application with the Department of Housing and Urban Development,
United States of America, for a grant under PL 89-117. The following
voted in favor thereof: . Mayor Klingelhutz, Councilmen Kurvers, Neils
and Wolf. No negative votes. MotiDn carried.
JOINT PURCHASING: A motion was made by Councilman Wolf and seconded by
Councilman Kurvers to approve resolution No ~/b'~'h1ti tIed Resolution
authorizing Cooperative Purchasing Agreement with Carver County and
other Municipalities. The following voted in favor thereof: Mayor
Klingehutz, Councilmen Kurvers, Neils and Wolf. No negative votes.
Motion carried.
BOND PAYING AGENCY AGREEMENTS: A motion was made by Councilman Kurvers
and seconded by Councilman Wolf to authorize the Mayor and the Clerk-
Administrator to sign an agreement relatingyto the Paying Agency.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Kurvers, Neils and Wolf. No negative vo~es. Motion carried.
