1972 12 04 r I I I l CHANHASSEN VILLAGE COUNCIL MINUTES - December 4, 1972 -1- The regular Chanhassen Village Council meeting on December 4, 1972, at 8:00 p.m., was held in the Village Hall and opened with the Pledge to the Flag. The following people were present: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. Councilman Neils was absent. COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to approve the Council minutes of the November 20, 1972 meeting. The following voted in favor thereof: Mayor Klingelhutz, Councilman Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. PARK AND RECREATION COMMISSION MINUTES: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf that the Park and Recreation Commission minutes of November 21, 1972 be noted and read. The following voted in favor thereof: Mayor Klingelhutz, Councilman Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. DORN TOWNHOUSE PROJECT: A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff that the application of Dorn Builders, Inc. for rezoning and approval of preliminary Development Plan be denied for the following reasons: 1. The request of the developer to table the application. a 2. Considering the density, the use as proposed by the developer would be detrimental to the present and future land uses in the surrounding area. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. BURNING PERMIT: Jerry Schlenk explained the University of Minnesota Tree Farm is requesting a burning permit to burn the tree trimmings. It was decided that the Council would wait until Spring before taking any action because a Chipper may be purchased. ELECTION PRECINCT RESOLUTION: A motion was made by Councilman Bennyhoff and seconded by Councilman Wolf to approve Resolution No. 124721 entitled Resolution Establishing Election Precincts and Polling Places. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. A motion was made by Councilman Kurvers and seconded by Councilman Bennyhoff that the Administrator is to obtain a letter from the Superintendents of the two School Districts and the American Legion Club granting the use of their facilities for Polling Places. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. MEADOWS (CAR WASH): Mr. Harvey Lehman was present representing the owner explaining how the Car Wash would be used. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. POLICE: The Mayor gave a report on his meeting with the Sheriff on the proposed contracts. A motion was made by Councilmen Bennyhoff and seconded by Councilman Kurvers to approve the contract as submitted in the amount of $50,000.75. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. PAGE HOUSE: A motion was made by Councilman Bennyhoff and seconded by Councilman Kurvers to authorize the Village Attorney to vacate occupancy of the residence known as the Page House. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. 71-1BT: The Administrator submitted the following tabulation of bids that were opened on November 30, 1972 at 2:00 p.m.: BIDDER American Contracting, Corp. Barbarossa and Sons, Inc. PRICE I $71,745.00 80,080.00 71,116.20 70,210.00 73,976.00 74,000.00 70,610.00 81,552.00 79,227.00 82,260.00 A motion was made by Councilman Wolf and seconded by Councilman Kurvers to approve Resolution No. 124722 entitled Resolution Accepting the Low Bid. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. Motion carried. NSA: The Village Attorney gave a report to the Council on the Easement Acquisition Status. The Village Engineer gave a status report on the Construction Progress. JOINT PURCHASING; A motion was made by Councilman Wolf and seconded by Councilman Bennyhoff to authorize the advertising for bids under I the Joint Purchasing Agreement for gas, oil, gravel, sand, hot mix and cold mix for Village requirements for 1973. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and Wolf. No negative votes. The following voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers and wolf. No negative votes. Moticn carried. HOUSE NUMBERS: The Council instructed the Administrator to send letters to all people in the Village instructing them to install their House Numbers. After January 15, 1973, the penalty clause of Ordinance No. 38 will be enforced. A moticn was made by Councilman Bennyhoff and seconded by Councilman Wolf to adjourn the meeting.
