CHANHASSEN VILLAGE COUNCIL MINUTES - December 18', 1972

The regular Chanhassen Village Council meeting on December 18, 1972
at 8~OO p.m., was in the Chanhassen Village Hall and opened with
the Pledge to the Flag. The following people were present: Mayor
Klingelhutz, Councilmen Kurvers and Neils. Councilmen Bennyhoff
and Wolf were absent.
VILLAGE COUNCIL MINUTES: A motion was made by Councilman Kurvers
and seconded by Councilman Neils to approve the minutes of the
December 4, 1972 meeting. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Kurversand Neils. No negative votes.
Motion carried.
Councilmen Benny~off and Wolf entered the meeting.
PAGE HOUSE: A motion was made by Councilman Neils and seconded by
Councilman Kurvers to delay any action on the Page House'until
after Christmas. The Administrator and Village Attórney are in-
structed to proceed with legal action to vacate the premises
after December 26, 1972. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf.
NG negative votes. Motion carried.

PARK AND RECREATION COMMISSION MINUTES: A motion was ,made by
Councilman Bennyhoff and seconded by Councilman Kurvers ~hat the
Park and Recreation Commission minutes of December 5, 1972 be
noted and read. The following voted in favor thereof: Mayor
Klingelhutz, 'Councilmen Bennyhoff, Kurvers, Neils and Wolf.
No negative votes. Motion carried.
A motion was made by Councilman Kurvers and seconded by Councilman
Bennyhoff that the Park and Recreation Commission study the pos-
sibilities of all Chanhassen residents to have a stamp for their
car for recreational purposes. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils
and Wolf. No negative votes. Motion carried.
The Village Council requests that the Park and Recreation Com-
mission discuss the winter use of Lake Ann Park in greater detail.
PLANNING COMMISSION MINUTES: A motion was made by Councilman
Bennyhoff and seconded by Councilman Neils that the Planning
Commission minutes of November 12, 1972, be noted and read. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No ne~ative votes. Motion
carried.

A motion was made by Councilman Neils and Seconded by Councilman
Wolf that the Planning Commission minutes of the November 28, 1972
meeting be noted and read. The following voted in favor thereof:
Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf.
No negative votes. Motion carried.

INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilman I
Wolf and sëconded by Councilman Bennyhoff that the Industrial Com-
mission minutes of the December 13, 1972 meeting be noted and read.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
N.S.A.: A petition was presented to the Council from James Hardy
repreienting Pleasant Acres, 2nd Addition in regard to sewer.
A motion was made,by Councilman Bennyhoff and seconded by Councilman
Wolf to start action on a Public Hearing fro those people owning !
property in Pleasant Acres 2nd Addition, but if 100% of the property
owners sign the petition before the Public Hearing, the Administrator
and Village Attorney are to acquisition the Engineer to make up de

INDUSTRIAL COMMISSION MINUTES: A motion was made by Councilman I
Wolf' and-seconded by Councilman Bennyhoff that the Industrial
Commission minutes of the December 13, 1972 meeting be noted and read.
The following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
N.S.A.: A petition was presented to the Council from James Hardy
representing Pleasant Acres, 2nd Addition in regard to sewer.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Wolf to approve Resolution No. 1218721 entitled Resolution Calling for
a Public Hearing on 73-1. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
If 100% of the property owners of the area being considered sign a
petition requesting the improvement, the Public Hearing will not be
necessary.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Wolf to approve Resolution No. 1218722 instructing the Village
Engineer to prepare detailed plans and specifications if 100% of
the property owners sign the petition. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.

ANIMAL CONTROL: Larry Smieja, President of Metropolitan Animal
Patrol Service gave a presentation on the services his company
provides and a report on his building and operating procedures.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Wolf to approve the proposed contract from Metropolitan Animal Patrol
Services covering the periods from January 1, 1973 to December 31, 1973
with the corrections recommended by the Village Council.
BILLS: A motion was made by Councilman Neils and seconded by Councilman
Wolf to approve the paying of bills. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.
COUNCILMAN WOLF MOVED THE ADOPTION OF THE FOLLOWING RESOLUTION: BE IT
RESOLVED that the following bill be paid by a warrant:

of the 1973 Budget and the remaining amount to be paid out of the 1974

BIDS ON 3/4 TON PICK UPS CON'T: A motion was made by Councilman I
Bennyhoff and seconded by Councilman Neils to accept the low bid
from Jerry Brady Motors for the 3/4 Ton Utility Pick Up, in the
amount of $4,l02.19. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No
negative votes. Motion carried.
BIDS ON 2~ TON TRUCK: Carver County opened bids on trucks at 10:00 a.m.
on De6ember 15,-1972. The low bid for a 2~ Ton Truck that the Village
of Chanhassen is participating in was submitted by Waconia Ford in the
amount of $9,151.55.
A motion was made by Councilman Wolf and seconded by Councilman Kurvers
to accept the low bid from Waconia Ford in the amount of $9151.55 for
the 2~ Ton Truck including Live power and paint. The following voted
in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers,
Neils and Wolf. No negative votes. Motion carried.
BIDS ON GAS, OIL, GRAVEL, HOT AND COLD MIX: A motion was made by
Councilman Wolf and seconded by Councilman Bennyhoff to reject the
County's bids of 25.3 and 22.2 on gasoline and accept the hid of
13.5 from Mihnesota Victoria Oil for Chanhassen only. The following
voted in favor thereof: Mayor Klingelhutz, Councilmen Bennyhoff,
Kurvers, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman I
Kurvers to accept the low bids as submitted under the'Carvet County
bids on the following items: Oil, Gravel and Hot and Cold Mix. The
following voted in favor thereof: Mayor Klingelhutz, Councilmen
Bennyhoff, Kurvers, Neils and Wolf. No negative votes. Motion carried.
CIGARETTE LICENSE APPLICATIONS: A motion was made by Councilman Neils
and seconded by Councilman Bennyhoff to approve the 1973 paid Cigarette
License Applications. The following voted in favor thereof: Mayor
Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
WANNINGER PROBLEM: There was a general discussion held on the Wanninger
problem.
N.S.A: The Village Attorney and the Village Engineer gave progress
report on the North Sewer Area. A discussion followed.
FIRE DEPARTMENT: A motion was made by Councilman Bennyhoff and sec-
onded by Councilman Wolf to authorize the Village to advertise for bids
on a new Rescue truck. The following voted in favor thereof: Mayor
Klingelhutuz, Councilmen Bennyhoff, Kurvers, Neils and Wolf. No negative
votes. Motion carried.
BUILDING INSPECTOR: Bill Ballhorn, the Building Inspector, will be I
attending a Building Inspection School in Madison, Wisconsin from
January 8 through'-January 19, 1973.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Neils for the Village to pay $87.40 for the Village's portion of the

BUILDING INSPECTOR CON'T: schooling. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.
LIQUOR: The Administrator was instructed by the Council to send
letters to all Sunday liquor License restaurants instructin~ them to
close at l2:00 a.m. on Sunday, December 31, 1972, as per state law.
The Administrator will also write a letter to the Frontier Dinner
Theatre stating that they must serve food in all bars on Sunday to
qualify for the Sunday liquor sales.
HAZARDOUS BUILDINGS: The Administrator reported that one of the condemned
houses on Carver Beach has been torn down and the other one will be
torn down as soon as the equipment can get in the area.
OPERATION IDENTIFICATION: A motion was made by Councilman Kurvers and
seconded by Councilman Bennyhoff for the Administrator to go ahead with
the plans for Operation Identification. The following voted in favor
thereof: Mayor Klingelhutz, Councilmen Bennyhoff, Kurvers, Neils and
Wolf. No negative votes. Motion carried.

Neils to adjourn the meeting. The following voted in favor thereof:
